View Full Version : CBI Instant Criminal Check Denial???

Hey all,
I recently went to purchase a rifle that I had ordered in at an area sporting good shop. I filled out the background check the same as I always have and after a few hours (there were lots of checking being ran that day) I got a call from them saying I had been denied and that they had a paper for me to send it to see why I had been denied.
So of course I have done that and am now awaiting their response in the the mail. I have looked through all of the CBI's info and I meet none of the criteria for being denied so i'm sure this is a paper work error that i'm going to have to get corrected. I also just recently started a new job at which they ran a full background check (thought the same agency) and everything was fine. Also I had purchased a firearm back in July 08 and several more earlier in the year with no issues at all. So whatever is messed up has happened recently (within the last 2 months).
My question for you all is how many of you have wrongfully been denied and how long did it take to get it all straightened out? I had to buy the rifle because it was special ordered so now it setting at the shop waiting for me to either get this all fixed or tell them to sell it so i can get my money back....
Sorry this is so long Im just really frustrated at the whole process and worry about how long its going to take me to get this corrected. I checked my credit and even ran a CBI report on my self to see if they have a record of anything and the report didn't even know who I was, so I don't think I have to worry about Identity Theft at least. Any ideas and thoughts would be greatly appreciated.

Sometimes it happens. It happened to me 12 yrs ago. They have gotten alot better since then.They had no info on me at all.(new to CO) Even been delayed in last 2years. Have you ever been charged with anything? I've heard a DUI can even through it off. I know police officers that have had problems.
You have to appeal because you have 30 days to get rid of all your weapons.

Did you put in your social? Lots of times you will get confused with somebody who DOES have a record and they have the same name as you...

Yes I did put in my social and NO I have never ever been convicted or arrested for anything, in fact i've only been pulled over once and I got a warning.. lol I just want to get this corrected good to hear that mistakes happen at least I guess is makes me feel a little bit better. Now whats this about getting rid of all my weapons? The shop owner said nothing of that and according to the CBI website it could take 30 days for them to get you a decision and thats after you go through all the steps before...

Seriously-I've had a few friends go through what your talking about and it's usually a typo on SS # or a screw up on close names-hopefully you'll get it cleared up-it also could be due to the high volume right now-Good Luck. [Beer]

Ok that makes more sense, I was going to say that I don't even know the reason for denial yet how can they make me surrender my weapons. I guess Ill just wait for the reason for denial to come in the mail and fight it from there. I think its probably because I have a common name but with all the background checks being placed right now it wouldn't surprise me if they are simply messing up or even throwing randoms ones out to cut down the work load. Got to love our government sometimes [Bang] I have a feeling the fun part will be proving that their records are wrong, after all it seems to be guilty until proven innocent in this country anymore.

i'm sure something got mixed up... with the spike in background checks, i'm sure this is happening more often.

I appealed and WON.[Ole][OLA]. Took less then 30 days.

I do background checks when working for Alan all the time and there are many reasons that you could get denied.
First off the person entering your info could have fat fingered a single letter in your name, SS#, date of birth, address ect. and that got you denied. I had a young lady who was purchasing a hand gun for her new husband. Her husband was shipped off to Iraq just after they tied the knot. She used her new last name and it was denied. I re-entered her info useing her maiden name and it went right through.
I always double sometimes even tripple check the info I entered before I submit the check. My guess would be that since you gave your SS# the idiot who entered your info for the check screwed up.
Let us know what you find out

That's my guess. With the volume it's probably easier to deny and have the applicant follow-up. They could get a bunch more checks done in the same amount of time that it would take to work through each application that has some kind of mistake that can't be verified.

My buddy Jason had a FTA for a fishing ticket, lol.....
and he got denied. So he got it paid, and it still took 3 weeks.
Randy had the same thing happen with an old driving ticket. Took 2 months.
Might wanna check.

Ya i've definitely sent in the paper telling them i'm appealing the decision and to send me the reason for the denial, so now i wait.... So question, i was told that your address didn't matter and I have recently moved so I used my new mailing address rather than the one on my drivers license. The guy at the shop told me that the address didn't matter and that wasn't the reason for the denial. Is that true or could all this be because I didn't use the address on my drivers license? Also he wouldn't re-run it even when I asked him to, said once your denied they wouldn't let any other applications through. Is that true also?

My bet is he fat fingered it they were so busy and he didnt like his job enough to double check all the info. Thats the only time I have been denied. One lady fat fingered it twice so I had to sit through 3 checks.... This was a while before the gun craze though...

The 3 years I worked for an FFL we had quite a few get denied because the person had identity theft they didn't know about. I had the securtiy chief for the Governer get denied once. All his cronies were laughing their tailes off. He came back a couple weeks later. His was identity theft as well..
Fat fingering gets the application rejected, not denied. Anything that doesnt jibe with the name, or SSN will get it thrown back to the dealer to fix, or a phone call from the CBI going WTF are you smoking.

I have a friend of mine that had a firearm shipped to Hickman rifles. When earl phoned it in CBI was like "no, the real SSN" Earl told the woman that he was looking right at the Military ID and that was the SSN.
It did go through finally but the man was from NY and had a SSN like 101-01-1101
