I know that if you are "at" the gun show. Whether it be in the building, or in the parking lot, etc. you are required by law to have a background check, by a licensed gun dealer, on the person buying the firearm.

My question is, how long do you have to wait, if you meet someone at the show, that wants to buy a firearm you have (you don't have it with you) to consider it a private sale?

I may have been under the mistaken impression? that you had a time period you had to wait after the show (like 3 days) before you could do a private sale of a firearm, with someone you met at the show.

I have been through CRS 12-26.1-101 - 108 and can not find any reference to a time period.

The closest I can find is this.....


12-26.1-101-(3) If any part of a firearm transaction takes place at a gun show, no firearm shall be transferred unless a background check has been obtained by a licensed gun dealer.

Does this mean that if I just mention that I have a certain firearm, that "might" be for sale, if I EVER sell it to that person, it has to go through a dealer? What constitutes "any part of a firearm transaction" ???

Other than what I have already found, can anyone give me any specific CRS that pertains to this?

"Any part" is something that would be interpreted by a judge or jury.

What they would decide, who knows.

I think it's reasonable to assume that if you have a gun you want to sell, and you speak at all about that gun to a person at the gunshow, and that person later purchases that gun from you that this statute would apply.

Does it matter if you sell it to the person the next day, pretty good chance.

Does it matter if you sell it to the person a year later? Still a pretty good shot I would bet.

Just post it here, I think the idiot quotient will be exponentially lower than at most any funshow. For wider exposure (including idiots) then put it up on arfcom, of course giving us cool locals a few days headstart :)

A guy that you meet there who insists on a FTF probably isn't someone who you want to do business with anyway (agent or felon, who knows).
