View Full Version : Do I need to establish a new trust or can I use an existing one?

I have a revocable living trust already for investment accounts, real property, etc. Do I need to create yet another trust if I want to hold NFA items like suppressors?

Assuming the original trust COULD hold NFA items, does that change if the trust is registered out of state? In a state where suppressors are NOT allowed even if the suppressor would be kept in CO?

It's probably easiest to just generate another trust but I hate making new legal documents. OTOH, I'm interested in putting a can on my new Tavor so ...

Must be in the state where NFA items are legal. A CA, NY, NJ or MA trust will never get approval.

Do you want your NFA assets handled in the exact and identical way that your current trust does things? Does your trust handle things like prohibited persons being part of the trust?

My current trust doesn't address prohibited persons but none of the people named in it as benefactors or alternate/successor trustees are prohibited anyway. Macht nicht since that trust is registered in a state that is unfriendly to guns in general and NFA items in particular so I guess I'll have to gin up an NFA trust locally. Any recommendations for an NFA trust lawyer in or near Colorado Springs?

Sorry for the slow response, Mr. Aloha_Shooter. I had a 5th grade graduation ceremony to attend today. [My niece, not me!] Thanks for the endorsement, kwando.

I'd be happy to help you set up an NFA Trust. My process is automated so the fact that you're in the Springs and I'm in Loveland shouldn't be a factor. I rarely actually meet my NFA Trust clients in person. It's all done by email. To get started, just send a blank email to NFATrust@WoodardLaw.com.

As others have said, aside from the fact that your existing Trust is "domiciled" [for lack of a better word] in an unfriendly state, it legally would have worked for your NFA items. I still wouldn't suggest lumping everything together because (a) the odds of somebody screwing something up in the future are higher when the trust doesn't specifically address handling regulated items and (b) it is highly likely that at some point you'll want your NFA items handled slightly differently than the rest of your assets. With everything lumped into one Trust, it's more complicated than it's worth to try to parse out NFA items for special treatment.
