W. Va. teen who refused to remove NRA shirt at school could face jail time in related charge

A West Virginia teen who was arrested after refusing to change out of his National Rifle Association T-shirt at school could face a fine and even jail time on a related charge.

A judge in Logan County Court is allowing prosecutors to charge 14-year-old Jared Marcum with obstructing an officer in the April 18 incident, reported CBS affiliate WTRF-TV (http://www.wtrf.com/story/22587338/14-year-old-at-the-center-of-nra-t-shirt-controversy-now-facing-possibility-of-1-year-in-jail).

The arresting officer in Logan, a city about an hour south of Charleston, said that Marcum wouldn’t stop talking during the frenzy at Lincoln Middle School, the station said.

The judge’s decision last week against Marcum now means prosecutors can seek a $500 fine and up to a year in jail for the former eighth-grader.

But the teen’s stepdad vows the family won't back down.

“Me -- I’m more of a fighter, and so is Jared. And eventually we’re going to get through this,” Allen Lardieri told WTRF. “I don’t think it should have ever gotten this far.”

The clothing kerfuffle began when Marcum wore a shirt bearing the NRA’s logo and a hunting rifle. As he stood in line in the cafeteria, a teacher ordered him to either change shirts or turn it inside out.

Marcum declined and was sent to the office, where an officer was dispatched after he again refused to comply with the school’s request.

Cops arrested him and charged him with disrupting the educational process and obstructing an officer.

Marcum’s attorney, Ben White, said the teacher went too far in targeting the teen, and believes he didn’t violate the school’s dress code.

Marcum said he spoke calmly when he told administrators that he was exercising his right to free speech.
The county schools' dress code lists several rules (http://lc2.boe.loga.k12.wv.us/manhigh/code.htm) students are expected to follow.

Logan County prosecutors and school officials couldn’t immediately be reached for comment Sunday.

“Every aspect of this is just totally wrong,” Lardieri told WTRF, adding that Marcum doesn't have a criminal background.
“It just seems like nobody wants to admit they’re wrong,” he added.

Marcum is due back in court July 11. His lawyer is trying to get the charges dropped.

Having spent more time then most non residence in WV, I'd have thought an NRA shirt was mandatory...along with at least two original teeth.

I'd like to see them all in un-logo'd uniforms. I wish my school had had that dress requirement.

With that said: If you can have a shirt with a Nike logo on it, you should be able to have an NRA logo on your shirt as well. Or anything else for that matter.

I'm here now and OMG there is an acute lack of dentistry in this state.

Easy to spot the outsiders though...



WV also seems to be a relatively gun friendly state.

Having been born and raised in West Viginia I can say it is very gun friendly but the government is horribly corrupt and incompetent at all levels and it worse in the sourthern part of the state where this happened. As far as it being poor, there are parts that are not as poor as you would think but there are also areas that fit about every sterotype you can imagine.

Can you be convicted of obstructing an officer if the officer shouldn't even be there in the first place?

Smart-ass teenager and an over zealous educator. Half a brain should have told both parties what was reasonable and what wasn't.

Wearing a shirt with a gun on it to school?
Having the punk arrested for not taking it off?

How about the kid spends the day with the principal and then has to have mom and/or dad pick him up before they're off work?

He was wearing an NRA t-shirt with a PICTURE of a gun on it. I fail to see how this was "obstructing the educational process", especially since he was approached while at lunch in the cafeteria.

Plus, I read the "dress code". Nothing in there about clothing with pictures of guns.

The over zealous anti-gunner is 100% at fault for this one.
