View Full Version : Trust bypass of CLEO possibly going away??
This may be old news for some, but I came across this today.

Sounds like the ATF wants to change the rules in the wrong way. Why would you need CLEO's background check, when the ATF background check should be more comprehensive?

You Don`t need now, or will need CLEO s/off. Re-read it and or do a search in the archives. It says you would need to inform them after the fact.
Looks like it is going through, sucks for people who live in counties with a non signing CLEO.

Any recommendations on moving forward at this point?
I just got my trust set up last month and was planning on doing my Form1 for an SBR build soon (possibly a Form4 for a suppressor too).
I just moved so I just put in for a new DL so I can go to an FFL transfer the lower from my ownership to my Trust. (was planning on including that documentation when I send in the Form 1.
Ordered fingerprint cards over the weekend (thinking it might be best just to have these done anyway, yes/no?)
Should I get Sheriff Maketa to do the CLEO sign off, just in case?
I figure if this was a 2-3 week process I would just push it through but since this is a 10-12 month process, who knows what the rules will be by the time they look at my paperwork.
Any thoughts??
If you have your trust ready to go, and if your submitting now (using the trust) there "shouldnt" be an issue. Would be very hard for them to say "We have 8 months of (trust) backlog that we are going to stop and send back because they don't have CLEO and fingerprint cards".. Not that it is impossible, but I don't think it will go down that way.
Yup, asked my lawyer who did the trust. If you do it now there should be no problems...... Except that HUGE hole in your pocket ;)
Here is a link to the Federal Register with a copy of the Proposed Rule. It includes a link to comment on it. It also has instructions on how to comment by paper mail. It appears the 90 day comment rule officially starts Monday Sept 9.

I think people are being optimistic to think this won't effect applications already sent or NFA items already in a Legal Entity.
