Weld District Attorney Ken Buck says he won’t prosecute flood evacuees who give their firearms to other people for safe keeping, although he says that’s a direct violation of a new law that requires universal background checks for any transfer of guns.

Do we know if any law enforcement agencies tried to charge flood vicitms for this? I assume Buck's press release was a result of someone's stupidity.

I believe it was preemptive as the WCSO had stated that they wouldn't be enforcing the law anyways.

Is it going to be Ken Buck this time or the pompous Udall again?

Why would someone feel the need to make it public information that they "gave their firearms to a friend for safe keeping".

Not specifically public but I could see it mentioned to the police when coming out of a flood area with a load of crap. They are going to want to talk to you and make sure you aren't a looter.

I suspect since he is running for the US Senate he wants it to be known that he is not in favor of bloomberg's gun laws in Colorado.

I'm ok with the statement. If nothing, it shows the stupidity of it when Theory meets Reality.

So would this set presidents for any future prosecutions; those unrelated to the floods?

It's the same mentality you see posted here and other gun forums when the OP ask, "If i have CCW and the sign says NO GUNS, What should i do?"

I'm glad he's not not going to charge people.

it just baffles my mind why some people would ask him.

A precedent usually comes from a related court decision, not a DA's stand on a particular law.

I'd be curious to see how Rhonda fields would respond to this little predicament...

I don't think Rhonda Fields understands anything about guns or how the new gun laws work.

ETA: Or should I say, how the gun laws don't work.

The stupid fuds that showed up in support of this crap would do exactly that to show that they are good subjects, right up until they try to take away their toys then they'd act all outraged and shocked.

Didn't the Larimer County Sheriff say the same thing? Matters not to me why they're taking this stand as long as they keep their word.

Ken kept his word regarding illegals in weld cty, BUT the flag burners (ACLU) and liberal leaning judge ruled otherwise.

While i don't feel Ken Buck has the chance for a R win. He and the Buck Family are nice folks, unfortunately nice doesn't guarantee a win.
