View Full Version : Warrenty return issues on gun/mags over 15 rounds?

I have a S&W M&P 9 with the standard 17 rounds mags that it came with. I have had it prior to the new laws. I am having issues with the magazines sticking really bad and won't release freely. I called S&W to ask them about it. They said, yes they have had issues with the mags and would replace them. When I said I was in Colorado they told me they cannot exchange my mags or replace them with 17s again.
Does anyone understand how the law works for warranty stuff like this? Regardless he said there is no way he would replace them so I am screwed. The guy was a jerk on the phone. Think I am done with S&W after that phone call.

I think the way the law is written S&W is playing it the "legal" way....
Your basically screwed, and it is not their fault.
Tho it won't be free or under warranty... wyoming is only a couple hours north.....
just use your imagination. have any relatives out of state?

ANY mfg is going to tell you the same think, Sorry. I can't order items from my vendors to an OOS addy, as my billing addy is CO.

Is this something you could find out from S&W what the problem is and have a local smith fix it.?
Just a thought, don't know how that would play into laws either.
(I know you said mag issue, but is it more than just the mag was my question)

They said it was a mag issue that's all I know. He didn't even suggest sending the gun back just wanted to exchange the mags so I am guessing this is a problem they are well aware of with the magazine itself.

Smith & Wesson can't change the law. The law provides for no exceptions for exchange. Indeed, there isn't even an exception for handing the gun to a gunsmith with magazine for repair - although the current temporary injunction includes such an exception based on a memo from the Colorado Attorney General. But note that that exception may disappear if the Independence Institute led lawsuit fails.

If the gun has shrunk and the mag well has gotten tight this may be the problem. I had it happen to me. I put the lower in hot water and after it was soften up I inserted a mag with one layer of duck tape around it and let cool. The mags dropped free after that.

Thanks for the tip! I started to (very very lightly) sand the inside of the mag well to remove any high spots but I don't think that is getting me anywhere. I can see where they are rubbing.
How hot did you get the water? Hot out of the tap or on a stove?

Worked like a champ! mags are dropping right out now. Put the handle in some barely boiling water for a few minutes then inserted a mag with a layer of painters tape on it and let it cool. Had a hell of a time getting the mag out (should have not taped near the mag catch I think was the problem). Not sure how long it will last but it works good now.

Am in the same boat with a CZ-75 mag 16rds, Mec-gar won't touch me with a 10 foot pole neither will the place I bought it from. I have more but it still make me make to break something over a certain persons head

Great idea Superior and glad it worked. Gonna have to remember that one.
On the injunction-does anybody have a link to it, especially the exemption for gunsmithing purposes?

I would think that cooling it quickly would make it brittle .......... or maybe that is only metals..

I have some very thin SS shim sheet stock, like paper thin. if you want to use some as a backer for the mags pm me.
So how is a company from out of state not allowed to send a magazine in the state? Will Colorado authorities travel to the state where the mags came from and press charges? Wouldn't it be all on whoever accepts the mags within the state? Seems dumb for a company to refuse unless I am missing something.

Yes, Colorado would indict the company's officials in Colorado. Then Colorado would extradite those officials from their state and that state would as a regular course of business go arrest those officials and put them on a plane to Colorado. Why do you think it would happen any other way?

The vendors have put CO. on their do not call list. Just as CA , NY, NO, DR MA and cities like Chicago.
Why risk a major lawsuit, if not indictments, for sales of items, prohibited by law.

Well my excitement was short lived. After the gun sitting overnight it went back to it's original form. It's better then before but not all mags are dropping freely now :-(.
Looks like I am Going to have to figure out how to get them exchanged.

I can't find the article but I did hear from a good source at a local police department in CO that a person was placed on a 72 hour mental health hold. They're guns were taken for safe keeping at the request of the gun owners. Once the person was released from the mental health hold the police department returned all the firearms to the owner. A anti-gun group is attempting to take suit against the pd because they do a background check to return the guns to the owner and they returned the magazines to the owner which in some cases were able to hold more than 15 rounds.
I am still searching for it and I know the person that told me this would not lie about it.

My point was that a PD is possibly in violation of the law when returning the property to its rightful owner when the magazines capacity is above 15 rounds. So I wouldn't attempt to exchange or send your mags anywhere.
Based on your first post about the 17 round mags, I didn't read the whole thread.

I see where you are going now. S&W already said they would not return my mags if I sent them so it's not a option right now from Colorado.
A baby-killing criminal would probably just mail them to a friend or relative in another state and let them exchange them through S&W.

I certainly agree. But there are numerous sources that want to remove that from you and try to interpret the law differently. I just wouldn't risk it personally.

No one checks ID to buy magazines.
So of course you can go to Wyoming and buy magazines there. If you bring any of capacity greater than 15 to Colorado, however, you are committing a crime. Been seeing Jensen's ads?

Slight change in the possible issue. Stoppped by DCF today while I was up that way and they had a brand new M&P 9 on the shelf. They let my try those new mags in my frame. Same issue so it my be the gun after all?

Not compared to the fireworks some folks "hypothetically" purchase. We can digress on the semantics of one vs the other. However like magazines IF, [key word] IF someone in LE wanted to add a few arrest under their belt you're screwed either way.
