Yes. My wife is a legal user of MMJ and the state will not issue her a CCW and the sheriff told her that she could not pass a BGC as long as she held a valid CO state MMJ license. Doesn't mean she can't own a gun that she owned before the private transfer BGC law went into effect July 1, 2013.

So the "are you an unlawful user" question on the 4473 is not asking due to some prohibition in federal law? If that doesn't make you a prohibited person, why is it on the list of questions at all?

And here's the even better part...
Answering "no" to this question and having a MMJ card at the same is an instant felony. You have also documented your felony for the prosecutor.
No one is getting popped for this, but the Feds could make a lot of people prohibited persons overnight.

And how would the Sheriff's office know that she has a red card, unless she told them... If they denied her because of "knowing" that she has a red card, then she could sue the State, the Dept of Health & Environment, etc. because Amendment 20 sets rules that the database for red cards MUST remain protected....

No, it is not.
From the CDPHE website: "The Colorado Department of Public Health and Environment takes the role of data security seriously and incorporates all statutory requirements in its computer systems. The computer system used by the Medical Marijuana Registry (MMR) uses the same computer security methods that are used by the computer system housing birth records. Only MMR employees have access to the MMR computer system, and that access is controlled by defined roles. For example, an employee can only access the portion of the MMR computer system necessary to perform the functions of his/her job.
Statute requires that the department respond to law enforcement inquiries to verify that an MMR certificate is valid. MMR employees manually look up records for law enforcement using procedures that comply with Colorado law. The department is working with law enforcement to automate those queries. Any future automated queries will be subject to the same submission requirements as the current manual inquiries, and the information released in response to such inquiries would be identical to what is currently being supplied manually. All queries will be recorded and logged for audit purposes."
Basically, if a red card is presented to an officer of the law, then that officer can contact CDPHE and an employee will validate if the card is valid and if it is indeed held by the person who is presenting it. But if a person who holds a red card goes and applies for a CCW or a background check, then unless that person has previously presented a red card to a police officer, there is no way for an officer to know that that person holds a red card.

According to the Sheriff's office, when a CBI check is done the data is there to know if a person has a red card. It is in the state data base and law enforcement can access it when running a background check. In Larimer county you cannot get a CCW if your have a valid MMJ license, the sheriff will not grant the permit. We found this out when she applied for her permit. She was denied because she uses MMJ. We did not tell them up front and she has never been in any altercation with the law. They found out during the BGC. If you say we can sue the count and make them issue one to her, then please direct me to a lawyer that will take the case and open your wallet to pay him, I certainly can't afford a lawyer to sue the county. It would be a lot less expensive to pay the court if she ever got caught carrying her little Smith, which she does not as we are law abiding and besides, she is with me when she goes out and I legally carry for both of us.
You're crazy to believe that they don't cross search databases. Sure, they may tell you it's "protected" but get real, this is the government.

My med records are HIPPA Protected MY SCRIPT OF XXX is not. IF ANYONE has been to a pharmacy in the last few years with a NARCOTIC script, they make a copy of your DL.
1- to verify you are you
2- to have on file every script filled
3- to be able to track you down (GUN REGISTRATION) if a mass amount or even small one is found on the street.
THAT INFO is available to LE's ,DA's, fed's, ABCD, AGENCY. WITHOUT needing a warrant to obtain said info. Everyone who says the state / LE does not have access, try again.
The state makes you show ID for OTC pseudo whatever, like allerest. This keeps track in case they bust a meth lab. ARE you the supplier / cooker ?? Same for the red card.

I have a hunch that they'll require an official CO id to purchase. At which point, they'll have to scan to verify it's authentic. Just a guess though.

I bet your right. Also just like some people dont believe the government IS tracking our gun purchases. Dont believe for one minute they are not doing the same for MMJ or soon to be recreational pot.
