DENVER - Colorado voters may get to weigh in on a controversial gun control topic that has gone all the way to the state Supreme Court. It involves guns on public college campuses.
Colorado is one of two states with no legal restrictions on concealed carry permit holders who want to carry handguns on campus.
A group called Safe Campus Colorado wants to change that.
"We believe that concealed guns on college campuses are a threat to everyone," said Ken Toltz, a former adjunct professor and the father of two college-age daughters. "We also believe that Colorado citizens should have a voice on gun policy through an initiative."
The safe campus group is proposing a ballot initiative to add the words "public college or university" to the existing statute which restricts concealed weapons at K-12 schools.
But opponents say even if voters approve an initiative, "there are questions about constitutionality."
William Perry Pendley, president of the Mountain States Legal Foundation, said the state Supreme Court did not address constitutional questions when it ruled on a case involving the University of Colorado in 2012.
CU had its own concealed weapons ban in place, but that ban was challenged by three students and a group called Concealed Carry on Campus, LLC.
Eventually, the high court ruled that CU's ban was illegal because it was not approved by the legislature.
Under current statute, concealed carry restrictions apply only to K-12 schools.
Earlier this year, state lawmakers tried, but failed to add college campuses to the statute.
The Mountain States Legal Foundation, which represented the students who filed suit against CU, said Democratic lawmakers overreached with their legislation.
Toltz admitted that the political climate wasn't right for lawmakers to tackle the issue. Now, he said, there are Republicans and Democrats who will get behind a citizen-led initiative.
On Thursday, the state's Title Setting Review Board will hold a hearing to set the wording of the title for the group's proposal.
When asked why he decided to lead the effort, Toltz said, "I don't want to send my daughters to a place where concealed guns are carried on that campus."
He said there are some places that guns should not be allowed.
"Airplanes for example," he said. "Schools are another."
Pendley called the initiative effort an attempt to override both the Legislature and the Supreme Court.
He said banning guns could put more people in danger.
He recalled the testimony of a college coed from Nevada, who told lawmakers that she was brutally assaulted.
"She testified that if she had had a weapon that night, she would not have been raped," Pendley said. "And her attacker would not have gone on to rape others."
Pendley added that there is a difference between K-12 schools and colleges and universities.
"We have veterans who have served in Iraq and Afghanistan… and they're returning to college to get advanced degrees," he said. "They're of an age where they have the right to carry and have a proper permit."
Toltz said his group needs to collect more than 86,000 signatures to get the issue on the ballot.
College kids and their liberal ideas are a threat to everyone. Not law abiding citizens carrying a concealed handgun.

All what one needs to do is look to the recent event at AHS to see how a properly prepared, armed individual can keep an institution of learning safe.

As a college student, I will always vote to help people conceal carry on campus.
Then I hope that you will be a strong and ACTIVE VOICE on your campus and work your hardest to stop this ill conceived attempt to strip your freedoms form you and your classmates.

I seriously doubt they'll have the enthusiasm to get enough signatures to get this on the ballot ... and if it does I bet it dies a horrible death in the election.
If this actually makes it on the ballot we need to take a long hard look at their organization because there's no reason we shouldn't have a mag ban repeal to vote for next election too.

This is what I'm afraid of, and anyone that thinks the ballot doesn't have a snowballs chance in passing, could end up sadly mistaken.

The point that needs to be stressed just like the overall CCW issue way back a few years ago is this. They claimed that there would be bloodbaths in the street, did not happen.
Since the bans were overturned how many students have been killed or shot by a CCW? Been over a year now. Just like many things the anti's always scream for the children's safety but as always there reasons are misplaced. Not a matter of keeping their little slut safe it is just a tool to use to bash the second. That and they are afraid of things they know nothing about. Guns bad um,OK.

You can bet your backside that I will. This is not only about my freedoms, but my safety as well. I go to UC Denver where people have been allowed to carry concealed on campus for a while now, and i have yet to hear of one single issue that has arisen from that at all.

Those various students that go around with clipboards on the campus centers getting signatures for save the whales/free Tibet/Greenpeace/Etc. could probably get 86K inside of five days if they want it bad enough.

I see people like this on campus all the time. I believe that many people sign petitions for the sake of signing petitions. A while ago there was a video going around to promote the orwellian police state. [facepalm] Often times I think I am the only one who listens to what the petitioners want before making a decision on signing anything.
Think back to the PoliceOne.com survey of thousands of police officers around the country and what they said about CCW:

And of course, 80% said an armed everyday person would have stopped something like Newtown, Aurora, VT, etc. Of course the dolts like these "Safe Campus Colorado" folks don't listen to reason. I just want to know, what's the difference between college campuses and everywhere else where people can legally carry concealed? It's not like a campus suddenly makes it a more dangerous place... I don't differentiate between locations, unless it's a government building and/or has a magnetometer.

You hit it and campus PD is supposed to show up in 60 seconds or less. Too bad that a police response isn't as fast as a draw and fire.
Those stations are a fucking joke. I'm not saying they've never worked. But distance to one plus distance to police. Just way too much time.
I explain ccw to people like time travel. If you could get the police there instantly it'd be great. Next best, be armed.

Good thing that the illegals are flooding campuses now with them getting in state tuition. Half the signatures collected at colleges will be invalid.
