A federal appeals court ruled Thursday that a California high school did not violate the rights of its students when it ordered children wearing American flag t-shirts on Cinco de Mayo to turn them inside out.
Administrators at Live Oak High School in Morgan Hill had argued that concerns over violence between white and Latino students during the holiday celebration were serious enough to override questions of free speech, according to a report (http://www.huffingtonpost.com/2014/02/27/american-flag-shirt-ban_n_4870160.html) by the Associated Press.
A three-judge panel from the 9th circuit court of appeals agreed unanimously that prior problems between students on the holiday raised sufficient security concerns to justify the order.
Seriously? WTF? Instead of dealing with the root of the problem, they choose to penalize the victims. Essentially the 9th Circuit says "Es por los Ninos!"....

I tried posting this three times yesterday and once this morning, but couldn't post the links. Your title is almost word for word what I came up with . And yes, it's totally nuts. A friend told me that Google is really expanding their hardware team and is looking for experience hires in that area. I told him no freaking way would I move to California, even for a large pay increase and better benefits.
Its for the children.
The other way to handle this is for more violence to happen on the 5th of May - then by the courts own ruling they would have to prevent the donning of the Mexican flag as well.

What is not detailed in the article is if they made students wearing shirts with the Mexican flag also turn them inside out. If they actually did (I doubt it) I would be less angered by the event.
Fort Collins school did roughly the same thing three weeks ago.

I find it appalling that the American flag could be banned in a public place for any reason, but the flag can be burned in a public place as a protest.
We have lost our way as a nation by bowing to the bulls#!7 feelings of non-Americans or anti American religions of peace.
Old Glory should fly high and proud at EVERY public place or proudly emblazoned on any fixture on any and every day of the year.

They tried that in Ft. Collins and all hell broke loose. My solution is to display the French flag. Its red/white/blue and only those who actually know what May 5th is about would understand.

Well, I don't think so. Those that do violence or violate laws or school policy are squarely to blame. Not the schools or the kids wearing American flags on their t-shirts. Wearing uniforms is almost no different than telling kids they can't wear a t-shirt with a flag on it. Although I understand what you're getting at, I think if personal responsibility was given a higher priority and taught at home and at school, we wouldn't have things like this happening.
Makes my blood boil every time I see something like this come out of CA or anywhere else.
I wish it was still cool to be proud to be American.

The celebration always makes me laugh. Don't care if they burn a flag. They are celebrating beating the french, once.

This would have been the largest single shipment of mayonnaise ever delivered to Mexico. But as we know, the great ship did not make it to New York. The ship hit an iceberg and sank, and the cargo was forever lost.
The people of Mexico, who were crazy about mayonnaise, and were eagerly awaiting its delivery, were disconsolate at the loss. Their anguish was so great, that they declared a National Day of Mourning, which they still observe to this day. I always laugh at the 5th of May for that very reason... Real big achievement Mexico. Like that's a big feat. [LOL] And it wasn't until the US stepped in (after we ended our own Civil War here) that the French retreated back to France.
I still don't understand how the celebration got big in America, it didn't even happen here, Lincoln remained neutral in the conflict.

I am not going to argue about the merits of wearing the flag. Its OK either way to me. But I think what the school was trying to do was keep the kids from killing each other. Its a school, kids really don't have the rights like adults to wear what they want. Just like some schools ban thing that are gang colors.

Don't care what would happen. I will fly the flag where and when I choose. I try to follow flag etiquette as best I can and will deal with any consequences when the time comes.

In retrospect, while I agree the school has some ability to limit speech that would cause serious disruptions, it would seem to me their ruling barring American flag t-shirts as opposed to ALL expressions of nationality is a violation of US Code 36 ยง 175 (c) (i.e., the U.S. Flag Code, Position and Manner of Display):
(c) No other flag or pennant should be placed above or, if on the same level, to the right of the flag of the United States of America, except during church services conducted by naval chaplains at sea, when the church pennant may be flown above the flag during church services for the personnel of the Navy. No person shall display the flag of the United Nations or any other national or international flag equal, above, or in a position of superior prominence or honor to, or in place of, the flag of the United States at any place within the United States or any Territory or possession thereof: Provided, That nothing in this section shall make unlawful the continuance of the practice heretofore followed of displaying the flag of the United Nations in a position of superior prominence or honor, and other national flags in positions of equal prominence or honor, with that of the flag of the United States at the headquarters of the United Nations.

Little bit of sarcasm in my post. I'm more concerned about the ones who fly other countries' flags the rest of the year, regardless of country. Got a Union Jack on your car? Maybe moving to Wales or N. Ireland is better suited to you.
