A Broomfield man rescued from the September floods has filed papers indicating he might sue his rescuers, including the North Metro Fire Rescue District.
Roy Ortiz was rescued by North Metro and others who responded to the scene after his car was washed off the road Sept. 12.
He says crews took too long to respond to his accident after he became trapped in his upside-down car near the intersection of U.S. 287 and Dillon Road in Lafayette.
No lawsuit has yet been filed, but Ortiz's lawyer, Ed Ferszt, has filed a legal document that is a typical precursor to filing a lawsuit against a government agency, said Sara Farris, a spokeswoman for North Metro.

In order to bypass Governmental Immunity, he would have to prove gross negligence or that they ignored some type of prior notice. Tough road ahead for that kind of claim.

Unless a petitioner can get past governmental immunity in the hearing, a lawsuit won't go anywhere.

Reminds me of the claimant I had that complained about how rude the officer was, who drove him to his house after the accident, THEN to the rental car place!

I think it's fair to assume that the guy that was stuck in the car wasn't the one that hatched the idea to bring a lawsuit. I'd be curious to know how many different lawyers contacted him with that bright idea.

This might be the case since lawyers get around 30 to 35% of total money awarded to someone who wins there case.

Got a very similar complaint about a week ago. DUI arrest, passenger is hammered drunk and from out of town. I gave her a ride to the hotel. That one was booked so I gave her a ride to a second hotel. I got a complaint the next day that I was rude.

If he gets a settlement, which is what it appears he's hoping for, the floodgates will open (no pun intended) for other scumbags and the payouts will probably be more than the cost to fix the damn roads, etc. The scummy-type attorneys must be drooling.

Can't be nice to drunk people. Not worth your time. They never remember what happened and their complaint percentage the day after the incident is unusually high.

My cousin had a Denver cop drive him and a girl around looking for a hotel with a room at 2:00am. They had called a cab from a house party and when he saw the crown vic coming down the street he assumed it was a cab. Turned out it was the cop and he was like, "Where you goong? I'll take you." Drove them to 2 or 3 different places.

And that's why cops are bad. :p
