I wouldn't prosecute the guy, but I wouldn't be surprised if someone else did. He was out of the danger zone, acknowledged that the police needed to be called, and then took matters into his own hands. I wish we still had some good old Western justice, but that's not the reality. I would definitely have a lawyer ready if I were him.

EDIT:
Leaving the pistol in the car kinda defeats the purpose of a carry license, too. What if they had strolled into the Quizno's instead? And if they gotten violent in that instance, he'd have been up a creek.

That sucks for that pharmacist. But the thing I've always bed taught from the Marine Corps to civilian self defense classes is that you only pull your weapon when you're going to use it, especially if they are armed.

It's Texas. Even if there's an aggressive DA that wants to prosecute, this will get 'no billed' by a grand jury and the Marine will likely be left alone.

A while ago (pre-hacker-crash?) I proposed that we start an email chain sort of thing to spread the word about folks defending themselves so more folks would hear about stories like this. IIRC I got 0 replies. Posting this on a gun forum is great but the antis still won't see it.

This was in Houston, not Austin. This was also a Marine taking out the trash, not giving a local PD a bunch of attitude.

I wonder where the assailant got a ".9mm" pistol? Bore diameter .0356? [facepalm]

I'm sure the NY comPost thought it was ok for him to have a gun, being a former cop and current security guard...an ordinary citizen would have been crucified.
