View Full Version : Laws for private sale
I was searching through the forums trying to find any information on fed/state laws that apply to selling a firearm privately. Does anyone know what laws apply or can someone link me to another thread with this info? I'm going to be selling one of my firearms privately.
Thanks
Brian
A Colo. resident may sell a gun to another Colo. resident without any restriction other than if you know the person is not legally entitled to own a gun (known felon, known non resident, known under age).

If it's between two parties that are citizens of the same state, and the purchaser is not barred from owning a firearm, then state law dictates the requirements of the transaction.. in Colorado, if the above requirements are met, there is no paperwork required...
if the transaction takes place across state lines, or between citizens of different states, then Federal law has jurisdiction, and the firearm must be transferred through a FFL (Federal Firearms License) holder in the receiving state... some FFLs will not accept shipments from non- FFLs, so a FFL may be required in both states..
all that being said, I am not a Lawyer, so this is not a professional opinion- just how I understand it.. and it is accurate to my knowledge.

So one can not sell a pistol to someone under age? Just curious. I haven't but thought it to be ok???

You have to be 18 to purchase a gun. You can sell a pistol to a person who is 18, but when they say under age, they mean 18.

Great link. Pretty complete except it didn't say if a C&R FFL has to follow the FFL rules for transferring non-C&R guns in their collection.
This might be considered bigoted, but I'd never sell to someone that couldn't speak fluent english or has tats that I think are gang related. Ditto for gang hos. Last thing I want is a ATF trace coming back to me or worse, some kid getting blasted in a drive-by.

<- no english.. can I play mute. As far tats.. I dont know one marine without tats so far. :D
I am full of tats. (removed really long rant prior to posting). What has been said here about Private Party sales is correct for the State of Colorado. You must not have any knowledge of the purchaser being barred from possesion of a firearm & both you & the purchaser must be a legal resident of the same state. Typically a Drivers License or State ID will prove residency. Also purchaser must be of legal age, 18 for rifle & 21 for handgun. (I could be wrong on the age, but that is how it is for FFL transfer.)

Slightly off topic but near.....So if you can not do a pistol FTF sale (but I beleive you can) to someone under the age of 21 but over 18 can say a 19 year old be in possession of a pistol. Say like in an open carry scenario or in a vehicle or hunting, etc? I thought someone over 18 by a minute could own pistols bought from private sales. I'm 30 so I could care less but it still might be useful for the young pups to read the info.
I'll have to research this again but I thought it was 18 and up for a rifle and 21 and up for a pistol.

That's only from an FFL. It's 18 and up for both rifle and pistol for private sales. Only FFL's are federally regulated to not sell hand guns to people under 21.

I wonder if that is the case for that big coastal state that starts with a "k". Ill have to check opencarry.
The gentleman who wants to buy the weapon offered to show me his lease and utility bills that demonstrate he resides here. Due to his job being in CA, he still lives there until the transfer goes through, his wife is a CO resident though... I'm guessing the signs are leading towards going through an FFL? Also, this guy is supposedly an officer for one of the fed agencies.

What other proof do you need?

Well, if he is some sort of Fed, his badge could be pretty convincing proof he can legally own a weapon. Those can be verified with a simple phone call. If he doesn't want to show you his badge, I'd tell him to walk.

So you mean when I joined the Coast Guard I could've bought a handgun through a private sale back in the day?! I didn't get my 1st pistol until I was 24!
I hate my life.[Mad]
