GRAND JUNCTION, Colo. -- A man is facing a felony menacing charge, because two Colorado sheriff's deputies say they thought a banana he pointed at them was a gun.Nathan Rolf Channing, 27, was arrested Sunday, according to the Grand Junction Daily Sentinel (http://www.gjsentinel.com/news/articles/man-tells-deputies-aiming-a-banana-was-stunt-hes-j).
According to an arrest affidavit, Mesa County deputies Joshua Bunch and Donald Love said Channing pointed the fruit at them while crossing a street.
The deputies said they feared for their lives even though they saw that the object was yellow. Bunch wrote in the affidavit that he has seen handguns in many shapes and colors.
He wrote that Love was drawing his service weapon when Channing, of Fruitvale, Colo. yelled, "It's a banana!"
Yes, the man accused of pointing a banana at police is from Fruitvale.
And yes, one of the police officers he pointed the banana at is named Bunch.
And, no, we didn't make this up.
The deputies say Channing told them he was doing a trial run for a planned YouTube video and he thought it would "lighten the holiday spirit."

He probably got arrested because the cops were PISSED that they almost shot him over a banana.

If a banana is considered a full sized deadly fruit, would a plantain be a compact or subcompact deadly fruit?
If they seized the fruit illegally, would it be considered fruit of the poisonous tree?
How many bananas in a bunch before they are considered high capacity?

If he's convicted of felony menacing [with a banana that appeared to be a firearm], he can no longer own an actual firearm. I can't decide if that's ironic or just fucking stupid.

To some extent, I can see the officers' point although I think prosecution for felony menacing is over the top. Once upon a time, you could generally tell a firearm from fruit or a toy with a quick glance. You can't do that these days with all the different stylings and colors and what have you. I used to be very supportive of kids having toy guns but these days you can't tell if it's a toy or whether the kid is playing around (as opposed to being just freaking stupid or psycho). I'm glad I don't have to deal with that problem like beat cops.
I think he should have ACTUALLY had something to qualify for felony menacing. Those cops were never in any danger, except for making a terrible mistake.

just wow all the way around... only one to benefit will be the lawyer (unless it's pro bono- then this is just an all around waste of time & money)
but I wasn't there, maybe they charged him with that because there's no law against being an asshole.

This whole thing is completely idiotic, and I hope the first judge to get a whiff of it dismisses it with extreme prejudice, and frankly, the two cops involved should be suspended without pay for a few weeks to give them some time to think about their moronic actions.
Pathetic stuff like this is why so much of the public has such a mistrust of LEOs.

How many other professions actually have their own internal affairs? The police among police. If you think their are members of the public who dislike cops, ask the average cop what they think about IA.
I imagine these two deputies out on the Western Slope are enjoying all of the attention they are receiving from their peers. How many bananas can you stuff into a locker? Banana scented candles in the break room or banana scented air freshners in the car. Lots of fun with photoshop around the station. Nick names that will last years. I would guess the charges get reduces if not completely dismissed, but that is only a guess on my part. I think these stories make news because they are not that common. I also have a suspicion that along with focusing on gun crimes, the media has been intensifying their interest into police misconduct. It gets people to hit their web sites, and the editors have an agenda. That is just my opinion, however, and I have no evidence, other than anecdotal to support that opinion.
I know where Fruita is, but didn't know the area just east of GJ and west of Clifton was called Fruitvale. I always assumed it was part of Clifton.

We've all seen the Awkward Eye Contact campaign on the sides of RTD buses lately, promoting making awkward eye contact with people in vehicles before crossing the street. When something is so awkward that a felony comes out of it, I'd say it was successful. Poor guy is just trying to follow the Public Safety Announcements.
