That scumbag isn't likely to victimize another homeowner.

Noting like taking down a bad guy to put you in the holiday spirit.
Didn't the scumbag know that he has to break into a home in like denver or aurora, to have a better chance at facing an unarmed liberal homeowner?

Not likely, however his offspring and anything in that blood line already has a lawyer filing a civil suite. Who was a referral from their criminal attorney.

They can't file a civil suit. MMD provides immunity from criminal prosecution or civil liability.

Technically, they can,it's the Defendant's obligation to file motion to dismiss based on MMD to dismiss it. Nothing keeps anyone from filing something - even if its bullshit.
I'm sure you know all of that, just like to clarify it for others.
Technically, you're right. Although I don't think the defendant has to necessarily file the motion. I've heard of courts just dismissing based on the law. Either way, it won't do the "filer" much good if it's a MMD case.

The homeowner then ran to his room to get a gun for protection, according to a news release from the sheriff's office.
Police say Liebreth began making his way up to the staircase and confronted the homeowner, who pointed his weapon at him and told him to leave.
After Liebreth failed to comply, police say the homeowner and intruder got into a physical altercation, and Liebreth tackled the homeowner to the ground.
That's when the homeowner fired his weapon at the suspect, hitting him in the leg and head.
A lesson for what can happen if you wait too long to fire.
