View Full Version : Senate Bill 175 - New Push To Repeal Mag Limit

Just read on completecolorado web site that a new senate bill introduced today (friday) to overturn the mag limit bill. Senate Bill 175 even has 4 Dem co-sponsors believe it or not.
The rub is it all depends on what committee its assigned to to hear the measure. Don't really have high hopes, but the fight goes on.
Just thought it was very interesting.

Well, I'll stay hopeful and give it my full support. I'm going to be making quite a few phone calls again. Hopefully someone could post up that list of senators again, or if it's the same folks we need to talk to, we could just use the last list.

Hopefully this one goes different this time.

Here's a link to the bill: http://tinyurl.com/n7bxvb3

Note the 21 Senate sponsors, including all 18 Republicans and 3 Democrats. The bill is assigned to the Senate Judiciary Committee.

This is an opportunity to apply effective advocacy techniques. There is no need to urge, strongly urge, plead with, or encourage the 21 Senate sponsors to support or vote for the bill. They (we) already DO support the bill. Please consider calling, emailing, or sending a note by mail to those 21 sponsors just to say, "thank you." As for the other 14 Senators, consider asking them how they intend to vote on this bi-partisan effort to repeal an ineffective and, frankly, insulting law. I'm especially grateful to Democrat Senators Leroy Garcia (Pueblo), Cheri Jahn (Jefferson County), and Kerry Donovan (Vail). On the House side, Democrat Representative Ed Vigil (San Luis Valley) has made this a bi-partisan bill in both chambers. Please reach out to Rep. Vigil to say "thank you." He voted against HB 13-1224 and has maintained opposition ever since. All Senate and House sponsors are listed at the top of Page One of the bill.

For those Senators and Representatives who are not listed as sponsors (prime or co-), please consider starting any advocacy effort with one or two questions. It's OK to ask a legislator if he/she is familiar with a particular bill and, if so, how he/she intends to vote. I appreciate people asking so that I have the opportunity to explain my position and how I intend to vote. If a legislator is unfamiliar with the bill or remains undecided, THEN explain the bill and why you're asking for a particular vote.

The voters of Colorado provided balance in our state legislature. Thank you for that opportunity. Four Democrats have stepped up to make this a bi-partisan, bi-chameral repeal effort. My hope is to appeal to others, especially in the House, to take this opportunity to repeal this exceptionally bad law.

Finally, a special shout out to Senator John Cooke, former Sheriff of Weld County. The Sheriff's WILL be heard this time and it's great to have John as a member of the Senate to help advance this bill. I love the photo of John and I in this story: http://blogs.denverpost.com/thespot/2015/02/06/democrats-sign-bill-repealing-ammo-magazine-limits/117125/

It's an honor and privilege to serve.

Respectfully yours,

- Chris

Use the following link, which should display the 35 Senators already sorted by Party. Please thank Democrat Senators Donovan, Garcia and Jahn, plus all 18 Republicans. The remaining 14 Democrats are not co-sponsors.

It's assigned to Senate Judiciary. Senators Roberts, Lundberg and Cooke are already signed on as sponsors… so they already support the bill. Senators Guzman and Merrifield also serve on Senate Judiciary and are not co-sponsors.

Here's the contact list for Senate Judiciary:

Keep in mind that there is no need to urge a co-sponsor to support the bill. 21 of us already DO support the bill.

Received this from the NRA in my email this morning. It looks like Salazar needs to be hearing some voices.

Colorado: Bill to Repeal Magazine Ban Introduced in State Senate
Due to the unfortunate and politically motivated dismissal (https://www.nraila.org/articles/20150203/colorado-a-long-day-in-denver-sees-mixed-results-for-gun-owners) of House Bill 1009 (http://www.leg.state.co.us/CLICS/CLICS2015A/csl.nsf/fsbillcont3/EC5D2CD33A7C558387257D9000776992?Open&file=1009_01.pdf) by anti-gun legislators in the House Committee on State, Veterans and Military Affairs (http://www.colorado.gov/cs/Satellite/CGA-LegislativeCouncil/CLC/1251634987752) earlier this week, Senators Chris Holbert (R-30) and John Cooke (R-13) reintroduced legislation yesterday that would repeal the rights-infringing legislation passed into law during the 2013 legislative session that arbitrarily limits the number of rounds of ammunition you can use to protect yourself and your family to 15.
Senate Bill 175 (http://www.leg.state.co.us/CLICS/CLICS2015A/csl.nsf/fsbillcont3/04A8999CD8214F1587257D9000781424?Open&file=175_01.pdf) has already received 16 cosponsors, with a bipartisan group of both Senators and Representatives signing on to this critical legislation. Please begin contacting your state Senator (http://www.leg.state.co.us/CLICS/CLICS2015A/csl.nsf/DirectorySen?openframeset) in support of this bill restoring your Second Amendment rights.
Unfortunately, if SB 175 passes through the state Senate, this legislation will most likely once again be referred to the House Committee on State, Veterans and Military Affairs. Your help is needed to convince members of the Committee to reconsider their stance on your constitutional rights. The Vice-Chairman of the Committee,Representative Joseph Salazar (D-31) (http://www.leg.state.co.us/CLICS/CLICS2013A/directory.nsf/MemberDetailPage?OpenForm&district=31&Chamber=House), needs to hear from you. Urge him to change his vote to support of SB 175. Tell him to repeal the right-infringing ban on magazines holding more than 15 rounds of ammunition, so that you are able to truly protect yourself and your family, without limitation.
Representative Joseph Salazar (D-31)

I never said give up, I simply stated the facts. I doubt you will get near the support that we did last year in the recalls. Most people seemed to have forgotten or just don't care anymore and they showed that during election time.

Do you honestly see anyone orginizing more recalls after the others went to waste? I would love to see it but I just don't think there is enough people that give a shit anymore?

I could definitely see more recalls coming around. I think the only reason it's not like last time, where it's all people talk about, is because they got overturned in the elections. A lot of people gave up because of this. The problem is, the recalls happened not long enough before the election, to make a difference.

When things get difficult, you just have to push harder. NOW is the time to push for recalls, so the newly elected will have time to make changes before another election.

I hope your right but I honestly am shocked at the number of people (gun owners) that I have run across lately whether online, in person ,gun shops etc. that have already become complacent and make statements like "I think the BGC is a good thing" "I'm all for it". If gun owners are already saying that I hate to think what average Joe public thinks.

Trust me, I'm pissed off. I thought we were on a roll after the recalls. So disappointment that those seats went right back to anti-gunners. People have a short memory and have already accepted the new "norm"

Joe Salazar is a total POS... some young male should set him up in a sting to agree to statutory...
Maybe he'd be threatened by a recall.. but in Adams county? I don't know the area well enough.

I'm just as pissed about the last election results as I am about the BS bills rammed down our throat without due process.
I was starting to pick out areas in East Texas (not that it's perfect, but at least I could warn people there they're next)

I am too, and you are correct that people, sheep, have very short memories. The whole thing ticks me off, how it was orchestrated and bulldozed through the committee process. It was criminal what happened here in Colorado last year, and I am just stunned that so many people just accept it, or don't fully understand what happened to their right of due process.

Senate Bill 15-175: Repeal of the "mag ban" will be heard by the Senate Judiciary Committee on Monday, February 23, 2015. The hearing will be held in the new committee room, Room #271 in the Capitol Building. The committee will convene at 1:30 p.m.

There are three bills on the Judiciary Committee Calendar, with SB 15-175 scheduled third. The first two bills are fairly easy and should take about 30 minutes each. If you wish to come testify for repeal of the mag ban, then you might plan to arrive at the Capitol at or about 1:30 p.m., proceed through security (basement-level below the south stairs at the south entrance or first floor, up the stairs at the north entrance), then to the second floor of the Capitol. Room 271 is located between the elevators on the second floor. When you arrive at Room 271, look for the sign-on sheets for SB 15-175. If you wish to testify, then add your name and contact information to the sign-in sheets. PROPONENTS (those in favor of the bill) will testify first. We'll allow those who oppose the bill to wait as we did in prior years.

There are five members of the Senate Judiciary Committee. One of those five committee members, Senator John Cooke, is my prime co-sponsor on the bill. In addition, Senator Ellen Roberts, chairman, and, Senator Kevin Lundberg, vice-chairman, are both co-sponsors of the bill. Three of the five committee members support the bill. Please keep that in mind if you wish to call or email Senators in support of the bill. If you contact one or more of these committee members, then please remember to say "Thank you!" rather than urge them to support a bill that they already support.

The five members of the Senate Judiciary Committee are listed here along with "clickable" links to their respective state email account.

Senator Holbert, I am a competitive shooter from the springs, and my competition firearm that I owned for several years, holds more than 15 rounds. From years of hard use, the feed lips on some of my mags have seen better days and need replaced. With these laws in place I can not replace them. This is only a secondary issue to me.

First and foremost Is the manner in which a very large portion of the populous was ignored and bullied.

Thank you for fighting this, and know that tons of people all over Colorado are rooting for you. I will do my part and call all the senators mentioned in your post, and urge the non supporters to change their vote.

I realize that governments all over the world do much worse things to their people other than make stupid laws. Even if I transfer a firearm without a BCG, there won't be any caning.

Not that "our side" is a pack of angels either. The R from Montana gets into session and wants to ban Yoga pants. I'm sure we'd have a person hood bill ready to go if the house had changed power too [dig]. Then we have all the sheriffs fighting for us, only to have one the front men, Makita, get caught in a scandal and resign. Now there's a report they "misused" $700k in grant money. http://www.denverpost.com/news/ci_27521191/federal-audit-colorado-sheriffs-misspent-700-000-grant But hey, it was done by the DOJ, and I wouldn't trust them with the take a penny, leave a penny tray.

Some days its not worth chewing through the leather straps.

Good to hear! I don't anticipate that this will have any trouble passing through the Senate, since it already has bipartisan support and more than the required number of votes in just the co-sponsors. Hopefully, that will carry some momentum into the House, and it won't get killed in committee there.

I understand that the southwest corner of the state will get ~3 feet of snow above 10,000 feet. Since Senator Ellen Roberts (R - Durango) is chairman of the Senate Judiciary Committee and a co-sponsor of SB 15-175, it's probably best that we schedule the hearing on that bill before her committee on a day that we know that she can be there. :-)

It's not for the dozens of legislators who live in the metro Denver area, it's for the hundreds of thousands of constituents who live in areas that are receiving WAY more snow that we are here in the metro area and to assure that their Senators can get to the Capitol to represent them.

I'll post here when I know when SB 15-175 will be heard by the Senate Judiciary Committee.

Be safe and keep warm.

Senator Cooke (former sheriff) has the list. They're tack-on charges to crimes committed while in possession of a magazine that holds more than 15 rounds. Apparently, one of the nine is an error by law enforcement or a district attorney entering an incorrect statute code. Thus, the total is apparently eight, not nine. The charge under CRS § 18-12-3 (mag ban) can be a misdemenaor or, if related to a crime of violence committed while in possession of a magazine that holds more than 15 rounds, a felony. Contact Senator Cooke if you'd like more information… or wait for the hearing in Senate Judiciary Committee.

NEW HEARING DATE

Senate Bill 15-175 to repeal the "mag ban," will be heard by the Senate Judiciary Committee on Monday, March 9, 2015 at 1:30 p.m. in Committee Room 271. The new committee room is located between the elevators on the second floor of the Capitol Building. The plan as of today is to have only that one bill on the calendar. We hope to have as little waiting as possible for those who wish to testify in favor of the bill. Proponents (those who support repeal) will testify first.

If you wish to contact members of the Senate Judiciary Committee, then please consider saying "Thank you" to Senators Roberts, Lundberg, and Cooke who are all co-sponsors of the bill. They already support the bill, there is no need to urge, strongly urge or plead with them to support the bill because THEY ALREADY DO. However, I can testify how rare and appreciated a "thank you for supporting the bill" email can be to a legislator.

Please also note that Senator Cooke is my co-prime sponsor. The two of us will present the bill to the committee.

Thank you for your time and effort to repeal the ineffective and insulting "mag ban."

Is there a reason for this sarcastic comment?

Live under rocks much? This point has been argued from day one....

Does there have to be a reason? Besides, only the rock part was sarcastic, the rest was very serious. Where have you been?

I don't hide under rocks. Just my bed. Living in denial that this happened in the great state of Colorado to begin with.

Well rock me to sleep, I guess I'm unaware. No offense was intended.

Remote testimony is a new service being offered this year. It's available from Colorado Mesa University in Grand Junction and from Otero Junior College in La Junta. Guidelines for remote testimony are provided at the top of Page 4 in the following document:

http://tinyurl.com/pu3mdn2

Remote testimony will be available for the upcoming hearing before the Senate Judiciary Committee, which is scheduled for Monday, March 9 at 1:30 p.m., Room 271, second floor of the Capitol. SB 15-175 is the only bill scheduled and proponents (those in favor of repeal of the "mag ban") will testify first.

I wish I could remote testify from work!
