Apparently stupid knows no age... This teen, who is 17 years old, by the way, thought that no one could touch him because he's 17. Not only that, but the driver learned how to be a Tiffany Tough Tits with the police by watching YouTube videos. The internet is not a good place to find legal advice, especially if it's from YouTube or social media. The Taser and OC spray are great tools to coax an idiot 17 year old out of the back seat of a 2-door coupe. [taze]

It was pretty funny, this video was posted on a left leaning forum with a pretty hostile description, supporting the kid. All but a couple comments were calling the kid an idiot and calling him an annoying douche canoe.

I don't know if the cops did the right thing. It depends on if the kid was suspected of a crime, doesn't it? And doesn't that depend on if the cop actually smelled marijuana? And doesn't that depend on if they actually found marijuana in the car?

But if the cops really deleted the video, that always should result in a felony tampering with evidence charge against the cop. I would think the guilty party's face would be right there in the video when he/she picked up the phone and pushed the stop button. Why would a cop ever delete a video unless they were trying to cover something up?

Edit: regardless, the 17 year old was really irritating.

On January 10, around 9 p.m., Courtney Griffith was driving a vehicle along with Brandon Wyne and another friend. Griffith said they were returning to her home on Darnell Drive when her car was surrounded by police. Griffith then asked Wyne to start recording. Police officers told Griffith she and her friends were not being arrested, but were being detained for the smell of marijuana. The situation escalated when Wyne wouldn’t get out of the car. He told police he was going to wait to get out of the car until his mother arrived because he was a minor. Officers pepper sprayed then tased him. He then told the officer he would get out of the car, but before he could, he was stunned again.
On Monday morning, Virginia Beach Police Chief Jim Cervera said the officer’s use of the taser violated the department’s excessive force policy. The fallout for the officer can be anything from retraining to dismissal, said Cervera. The officer now has a legal opportunity to respond.

Cervera also said after their investigation it was determined the officer stopped the cell phone recording the video of the traffic stop, but he said “right now we can’t determine if or when it was in fact deleted.”
The Commonwealth’s Attorney’s Office also reviewed the use of force to determine whether the officers acted criminally, not appropriately per VBPD policies and procedures. The Commonwealth’s Attorney determined there was no evidence of a crime, therefore declined prosecution of the officers relating to use of force.

I don't they actually attempted to delete the video, considering whoever posted the video stated the cops assaulted the kid. I call BS. He was an idiot, and being a minor has nothing to do with following a police officer's lawful orders (such as getting out of the car). He refused, they escalated, maybe that was not a great call, but regardless, being stupid is no excuse. When a cop tells you during a traffic stop to get out of the car, you get out of the damn car, or they will make you. Did he need to be OCed and Tazered? Maybe not, but his refusal lead to their actions.

I've been asked on a few ocassions to "step out of the vehicle" by an officer. I complied and I was never sprayed with anything or tazed or shot. Heck, I was never even physically assaulted.

It's not really all that difficult. Just do what they ask and everything is cool. Not sure why people resist following simple instructions and then act all surprised when the officers are forced to take action.

The whiney little kid is probably lucky they didn't shoot him dead. Seems to be a bit of that going around these days.
