COLORADO SPRINGS, Colo. — A man was cited Thursday afternoon for firing a pellet gun in his backyard.
Police said around 12:30 p.m., they got a call about shots fired in the 6500 block of Gemfield Drive, which is in the area of Vickers Drive and Rangewood Drive. The caller told police his 4-year-old daughter was playing in the backyard when she saw a neighbor with a “small rifle” and heard three or four pops. The father wasn’t sure whether the gun was a small-caliber rifle or a pellet gun, so he had his daughter lay down in the backyard until police arrived.
When they arrived, officers talked to the suspect and learned he had been shooting a realistic-looking rifle pellet gun at a target on his deck. The suspect, 18-year-old Brennan Lucero, told police he had been firing the pellet gun at a railroad tie. He was served and released on a misdemeanor summons for discharging a weapon under city code 9.7.104.
Colorado Springs police are reminding residents that the discharge of weapons, including firearms and BB/pellet guns, is illegal within city limits.

Sounds more like a disgruntled neighbor to me.
Not quite sure what the big deal is. Just about every place I've ever lived had laws or ordinances that prohibited the discharge of a firearm, including air rifles, BB guns, or whatever you want to call them. Although, the part where the neighbor had his daughter lie down in the yard until help arrived was kind of odd and amusing.

It doesn't say how long it took for the police to arrive. I really do believe that should be part of the story, full disclosure and all.

I'd guess about twenty-four minutes. But who knows. Maybe a report of "shots fired" cuts that response time in half.

Yeah.... I have been quietly and tactfully eliminating them at dusk from my backyard to avoid my idiot neighbors calling the cops on me for doing them and their landscaping a service. Damn rabbits have destroyed hundreds of dollars of landscaping in my yard and my 2 neighbors' yards. [Mad]
I like the rabbits around our place, but all we have is grass and they're welcome to it. But the squirrels....those vandalous fuckers and my bird feeders..... Fortunately, their numbers seem to be mysteriously dwindling.....

I've been "quietly" doing the same thing. They seem to attack every part of yard that I'm working on. I wish I could rent a coyote for the evening.

Curious where the line is on this... Is an airsoft gun considered a BB gun (and therefore illegal to fire in my suburban back yard?) How about a paintball gun?

Meh, a tin of pellets is a lot cheaper than a new feeder.

A lot of cities have passed laws that anything that shoots anything out of it by any means constitutes a firearm...air soft, BB guns, even nerf guns can now be considered a firearm.
The side of this that no one has followed up on yet is forcing back ground checks to purchase...but I bet it is coming.

My neighbors have high school aged kids that have all out neighborhood wars with airsoft guns. Kinda annoying, kinda fun to watch.
My son & his friends used to do that until the day the police decided it met the firearm criteria in COS (a week earlier a CSPD Sgt told the kids they were okay).
CSPD had my son call me to the "crime scene" & I was almost tazed when I arrived & started asking questions (long explanation about that, but I was being as non-confrontational as I thought was possible, just started asking questions).

After the hands went to the tazers in the situation I just mentioned above, I was a bit miffed & when I was told what constituted a firearm I asked if that would make a 5 year old using a Super Soaker squirt gun guilty as well. They told me not to be ridiculous. When I pressed the point they conceded that, technically, it would be illegal based on the verbiage of the law.

What a BS law. That would mean no airsoft, no basement bb or pellet range. We did that when we were kids. Take a cardboard box and stack Mom's Goodhousekeeping magazines in it for a backstop. Be breaking the law now.

We had neighborhood spanning BB gun fights when I was a kid. The part about "gas operated gun" would include paintball guns I think. The law is BS. Nothing in it about human powered rodent slayers though. Blow gun, slingshot, spear, bow etc....
Wow, that is insane. I just assumed they put no discharge of firearms in there and tried to classify a BB gun as a firearm.

Yeah, thats what I thought. I was leaving my neighborhood last night and my neighbors were shooting their bows in the front yard. I had no complaints because I want to do the same. haha.

I agree the law is BS and couldn't believe it when I found it a few years ago. There are already laws and remedies available if someone is firing their bow, BB gun, pellet gun, etc. recklessly. I'd love to get a citizens' movement together to repeal that section of code.
