View Full Version : Traveling to New Mexico
I'm traveling to New Mexico this week with the family. From what I found New Mexico accepts CO permits. Is there anything I should be aware of?
Buy magazines and check out New Mexico armslist for private sales.
Not all Green Chile is equal.

LAS VEGAS NM Spic N Span diner. Is it a great place, depends on your expectations & taste buds. Is it a place to sit and enjoy the food, yes. Their pastry selection is worth the stop.
I suggest you get one of the eclairs with whipped cream (oh yeah) Forget the cream puffs ;)

Almost forgot. They don't call it The Land of ENTRAPMENT for nothing. AND BE OFF REZ LAN BEFORE SUNSET. If near or on watch for vehicle just sitting in the middle of the road, with semi aware highly intoxicated people.
Some odd restrictions concerning the number of weapons you can carry, and carrying in locations that serve alcohol.

Yes as with any small town and out of state plates. Knowing some people in the area where one might be "pulled over" doesn't hurt. So where you headed? Over to Chaimayo to see XX. Oh really she's my aunt's, sisters, cousin. Have a great day.

Sorry I'm late to the game. The answers depend on where you're going. Most local LE in the state are alright as far as ccw is concerned. State police are pretty ruthless though Santa Fe and Albuquerque cops are like any big city cops. Rez cops have no problems screwing with tourist.
Whittington is great, but food in Raton is hit or miss, depends on which cook is working that day. As said by Jim, Spic n Span in Vegas is great. Best breakfast in Santa Fe is the Santa Fe Baking Company. Good beer and food at 2nd Street Brewing. Any of the Wecks in Albuquerque are good for breakfast and I like Chama River Brewing for food and beer. Could list a dozen other cities and towns, just depends on where you are going.

Not meaning to imply that speeding is acceptable on I-25 in NM but I do drive from Raton to Albuq a couple/few times per month and while I am driving their speed limit (75mph) I normally have vehicles passing me like I am standing still. thvigil11 is certainly correct in that there are are a lot of NM State cops around Santa Fe so watch your speedometer in that area especially.

If you go over the pass to Taos eat at Michael's Kitchen. Great food.

Ya, mostly miss for Raton food from what we have seen. We just bring our own food and cook at Whittington. If somebody has found good food, we would love to hear about it. Next time we go down we will try it.

Prob too late, but there's a gun show in Albuquerque on 2/3 May, at the Fair Grounds. Agree about the state police near Santa Fe and Abq being a bit overzealous at times, but also watch out south of Raton and near 'Vegas. I'm heading south on Friday. *ahem*
I also believe ccw on reservation land is restricted .... This includes many major highways.

Yes to the first part. No to the second.
"New Mexico has state preemption of firearms laws, so local governments may not restrict the possession or use of firearms. However, local jurisdictions may restrict or ban the discharge of firearms within their boundaries. In 1986, Article 2, Section 6 of the state constitution was amended to say, "No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms."[5] (http://en.wikipedia.org/wiki/Gun_laws_in_New_Mexico#cite_note-5)
State gun laws do not pre-empt tribal laws on Native American reservations, which cover a significant portion of the state. The only exception to this is when one is traveling through the reservation on a state-owned highway (includes US and Interstate highways), in which case state firearms policies do apply. While some tribes have established gun control policies that match New Mexico state law and honor New Mexico concealed carry permits, other tribes do not recognize any concealed carry permit regardless of where it was issued, and have far more restrictive gun control laws. Tribes with laws that do not match New Mexico state law have policies on open and concealed carry that vary from No-Issue to Shall-Issue, depending on the tribal nation. Some Native American reservations that do allow open or concealed carry (but do not honor the New Mexico Concealed Handgun License) typically have established their own permitting systems, where applications for concealed carry permits are processed and adjudicated by the respective tribal council or tribal police. Permits on such reservations may be available to the general public or limited to tribal members, depending on the tribal nation policies."

Tom, that is comforting for me to hear that it's OK to travel (as listed above) through the Rez as long as we stay ON the Interstate. So, exit I-25, for the less expensive fuel at Domingo, could potentially cause a problem IF carrying.

That's on State Hwy 22, so technically no, per what I stated before. There is a Federal Peaceable Journey law that would preempt any other laws on the Nations, providing you are transporting under the Fed ruling (see below). But then again, New Mexico is "Extended Domain" where your vehicle (car, truck, RV, cycle or even horse) is considered an extension of your home, so carrying of a loaded firearm concealed or unconcealed is good to go (without a permit even). There could be an argument about whether or not the "Extended Domain" preempts Rez Law. So if you were to exit at Santo Domingo or any other exit, you'd be probably be covered, provided that the gun stayed in the vehicle. I'd think it be a good idea to not even have an empty holster on you when you go in to pay and get a soda. One thing to think about is places like that truck stop and the casinos thrive off of tourism. So it is generally assumed that the Navajo cops tend to go easy on tourist in those spots. Can't hurt great uncle's buisness after all. It's once you really penetrate the nations that things get tougher.
To top it all off, in New Mexico there is no law preventing the concealed carry of an unloaded firearm (without a permit even). So the gun with a full mag in a separate pocket/ carrier is good to go. (kinda defeats the purpose, but I guess if you practice tac reloads like a master.) [Dunno]
"§926A. Interstate transportation of firearms
Notwithstanding any other provision of any law or any rule or regulation of a State or any political subdivision thereof, any person who is not otherwise prohibited by this chapter from transporting, shipping, or receiving a firearm shall be entitled to transport a firearm for any lawful purpose from any place where he may lawfully possess and carry such firearm to any other place where he may lawfully possess and carry such firearm if, during such transportation the firearm is unloaded, and neither the firearm nor any ammunition being transported is readily accessible or is directly accessible from the passenger compartment of such transporting vehicle: Provided, That in the case of a vehicle without a compartment separate from the driver's compartment the firearm or ammunition shall be contained in a locked container other than the glove compartment or console.
(Added Pub. L. 99–360, §1(a), July 8, 1986, 100 Stat. 766.)
PRIOR PROVISIONS
A prior section 926A, added Pub. L. 99–308, §107(a), May 19, 1986, 100 Stat. 460, provided that any person not prohibited by this chapter from transporting, shipping, or receiving a firearm be entitled to transport an unloaded, not readily accessible firearm in interstate commerce notwithstanding any provision of any legislation enacted, or rule or regulation prescribed by any State or political subdivision thereof, prior to repeal by Pub. L. 99–360, §1(a).
EFFECTIVE DATE
Section effective on date on which Firearms Owners’ Protection Act, Pub. L. 99–308, became effective, see section 2 of Pub. L. 99–360, set out as an Effective Date of 1986 Amendments note under section 921 of this title."

Yeah Tom. At Domingo, even though I pay the pump with a CC, I still go into the station to get that freebie drink with the 10 gal purchase. To play it safe, I will remove the piece/holster (if I am actually carrying) and LOCK the vehicle while inside. That station is always pretty busy and I just saw that their area vendors are starting to set up on the South side of the building.

If you are in the Albuquerque area, I highly recommend "Casa de Benavidez", make sure you sit outside, and like your food spicy.
