Mulitple gun purchase question

I thought I saw a thread about buying two guns within 5 days but my search-fu failed me. Does the flag go up if you do so from two different dealers? I have an out of state transfer coming in this week to one store and picking up a gun I won at another (funny story for another thread). Thanks for any clarification.

That's for Hand Guns. Typical Legislative anti-gun logic. If one's buying2 hand guns within a weeks (IIRC) period, doesn't matter how many different FFL's used, CLEO gets notified along with the ATF. YET, that same purchaser can buy 25 long guns without a blip on radar. If it's 2 hand guns, pay the ffl buy ask him if you can hold off doing the 4473 a few days.

I did find out the other day that if you are doing a private transfer at an FFL and an FFL transfer for something you had shipped to the FFL where you are doing the private transfer, the CBI makes you do two separate background checks with separate fees. [Mad]

It's two or more handguns within 5 business days. An FFL is required to complete a "Report of Multiple Sales or Other Disposition of Pistols and Revolvers" form and immediately fax or mail it to ATF.

So not true. You can have multiple firearms on your 4473 despite the source of where they come from as long as they are transferred at the same time.

As monkey said, not true. Pardon my language but it sounds like your FFL is being lazy and wanted to make a little extra cash. I believe you can fit five items on one 4473. I've seen some dealers charge an additional $5 per item but that's it. The good guys will fit as many as they can for you to save you some money.

The situation was: I had a stripped lower sent to this FFL from in state.
I was also buying a handgun from a private individual. I figured we'd do the transfer at the same FFL in order to only have one background check.
The FFL originally filled out one form for both transfers. When they called it in and told them what I was doing, they were told that they needed to do two separate transfers.
The FFL gave me two new forms to fill out and charged me an additional fee.
Of course it made no sense to me. Just passing on my personal experience.

Sure would be nice if they had some mechanism in place that would allow a gun buyer to go through a background check and be issued a photo ID card.
This card could be good for five years, and could be revoked if the individual violated the terms.
Then, the buyer would only need to show his card and no additional background check would be necessary.

Hmm, what would that look like?

While I would have probably been lazy/cheap and run them on the same BGC myself, I will disagree with the guys here - and say your FFL might be technically correct - or at least he's probably not being a total tool on purpose. The Colorado BGC specifically asks whether the "type of sale" is Dealer or Private, and without doing two separate checks, you're going to be wrong one one of the transfers. I don't know (and am too lazy this morning to look it up) to see if this is due to any legal reason, or if it's just CBI doing "bookkeeping" to see how many private transfers they're handling. I don't doubt they would tell you to run them separate if asked.

Yep, you're right - there's no limit on the form. There are 5 lines on the 4473, but you can attach a separate sheet with as many as you want. There is some extra bookkeeping work required per firearm, and I'm guessing that's why some guys charge a bit more.

Your 4473 has no bearing where the firearms originally comes from as both firearms are in the FFL's possession. It should be on one 4473. CBI help desk can be very confusing when it comes to 4473, as they are not ATF. Once I transferred over 200 firearms from 2 sellers on one 4473 to my name. Misinformation happens... alot.

EDIT: CBI confirmed, COLORADO requires private transfer to be separated from dealer transfer. [fail]

Correct. As per asking CBI this is the exact reason. Basically davsel paid an extra $7.00 to help keep the State of Colorado's powerpoint presentations more accurate.


To answer the original ops question. No the multiple transfer record would not be filed as you are using two dealers. Dealers don't talk to other dealers at the Masonic lodge during some ceremony about who bought what when. It only matters, here in Colorado, if you buy two or more handguns within five consecutive working days from the same dealer.

They did it was called a CCW. Unfortunately it didn't last long AND at that time permits were issued by sheriffs on a whim. Weld cty was one of the few who had no problem issuing permits.
