View Full Version : Questions on C&R FFL Application, Form 5310.16 and 5330.20

So, I'm finally getting around to completing the application for my C&R license and got two questions:

On the 5310.16, Block 11, question A: Has applicant or any person referred to in item 9 above held a federal firearms license?

- I held an FFL 26 years ago for 1 year in California, when the shop failed I voluntarily surrendered the license to ATF at the end of 1988. Do I have to answer "Yes" to this question and then explain it on a supplemental page?

Second question, on form 5330.20, the citizenship certification, who has to sign block 2 certifying my citizenship?

The instructions on the back of the form are no help. Is there another publication to cover these forms?

Well I finally got through to ATF on the phone.

On the first question - Yes, even though it was 26 years ago, they still want the facts related to my FFL listed.

On the second question - No, they no longer need the 5330.20 submitted with the 5310.16. Just the 5310.16 needs to be signed and submitted.

It was around 1994 when I turned in my FFL that I held in Denver. I just put in a explanation that I no longer used it and did not care to continue to maintain it. They never questioned me further and my C&R license was possessed and issued in under 3 weeks. As long as nothing was unusual legally when you turned it in, should be a non issue.
