Laws concerning magazine bodies

I have been out of the shooting game for 3-4 years so I am a little behind the scene on the current magazine situation so please forgive my ignorance.

If I had a couple of 30 round AR mag bodies with no guts or floor plates and I wanted 20 round mag bodies is it legal to trade with the current laws?

Just wanted to find out if I need to modify my 2 mags or if it was possible to trade off and avoid the work.

Technically / by the law it's not possible to buy greater than 15 round mags. If no one knows, who's going to care?

Thanks for the response. Is a mag body considered a mag or is it a part or part kit like the California mag parts kit they use to sell, don't know if they got rid of that loophole.

Not a lawyer: Rebuild kits are sold all over Colorado, nothing is being enforced, even in Denver County(though I would not push your luck there)

According to my understanding of the law, you cannot legally trade or sell your 30rd mag body, nor could the owner of the 20rd one trade or sell his... they're both over 15rds, so you're stuck with them until you move out of this state. Even when you die, they can't be legally bequeathed to your heirs...

The law is so poorly written that it doesn't define what part of a magazine is a magazine. One might argue that the body is the "magazine" but one could easily argue that its the follower ... or one could argue that a magazine is only a magazine when it's complete (which is the argument that those that sell "magazine kits" use).

At any rate, most law enforcement agencies and Sheriffs in the state have flatly said they will not enforce the law so its somewhat of a moot point.

Which, in my little head is still, legally, an "Unjust Taking".. So, it is unconstitutional - and at bare minimum illegal.

Unjust Taking: When the government acquires private property and fails to compensate an owner fairly. A taking can occur even without the actual physical seizure of property, such as when a government regulation has substantially devalued a property.

The private property they 'took' was the value of your magazine - in perpetuity.

But that ship has sailed.. At least until I win the lottery.

Moreover the way the law is written you technically cannot even sell your mags to someone in a state where they are legal.

Also, said magazine kit once assembled, becomes a magazine that you are now in possession of after 7/1/13. Which is now illegal to possess. Especially if there is a date stamp on it that is post ban.

Will you get prosecuted for it ? Probably not, unless it is a tack on charge to go with a more serious charge.

My big problem with Magpul is the damn date stamp on them.

I would never advocate for someone to break the law, no matter how stupid and useless it is, but Cheyenne isn't that far away for most of us and it's a nice place to spend a day.

A magazine body is not a receiver so there really is no law requiring you to leave any marking on them alone. Just sayin.
