View Full Version : Truck hit while parked
My younger son called me this afternoon to tell me a nice young lady lost it on our street and nailed my Tahoe parked in front of the house. Sigh, he took all kinds of pics (even her dl and insurance card), sent them to me. I called her insurance (Progressive) and started the process, now sitting down to fill out the accident report to mail in to the county, oh joy.
It could've been worse, I can drive it no problem. Thankfully I have some of that lovely clear red tape to cover up the tail light but the quarter panel and bumper are toast. Heading over in the morning to get an estimate then let the games begin.
The amazing part is that my son's vehicle was parked about 2 feet behind mine and she didn't hit both of them!
That sucks. I hope it goes smooth for you.
Hell at least she was insured and didn't run! Did your son get a date out of the deal too?
Glad you got the info and he had the knowledge to get everything documented just in case.

You can file the report online. I've had to do it three times now. The last time my truck was hit was in the parking lot at work. Company wide email and no one came forward to take responsibility.

Yeap, as bad as it sucks, could have been a lot worse, a stand up lady that has insurance and was upfront enough to give the info to your son, I'd say it was just a bump in the road. Sucks but could be a LOT worse.
Wish it would have went down like that when some jackass hit my daughter's car in the middle of the night and just split.
This didn't happen without pics. [LOL]
Sounds like you're at fault. Better call a lawyer.

I had jury for a case similar to this. Guy was trying to sue a 16 year old boy (and his parents) for having a parked car in a neighborhood when HE slide into it. I didn't get picked for a few reasons I'm sure.
Could have been worse. You might be able to squeeze a rental out of them.

Waiting to hear back from Frank Azar ahahaha. As I told my son, that's why it's called an accident and I greatly appreciate that she rang the door bell to let him know. Our street gets very icey and she was probably going just a bit too fast.
Arapahoe Co has a link on the SO's web page to print out a report, done and going in the mail today. No need for the driver to get in trouble.

Seriously? People are so damn dumb. I got so tired of hearing people tell me, "he shouldn't have been parked there, THEY WERE ILLEGALLY PARKED!" Shut the hell up.
Anyway, good luck Doc, let me know if you have any questions.

The "he shouldn't have parked there" argument is totally invalid. YOU CRASHED YOUR VEHICLE INTO A STATIONARY OBJECT. lol
Just got off the phone with woman's insurance, Progressive. All set 8a Monday to go meet the adjuster.

This is what I experienced, too. Hit and run with no contact. I was lucky that they only managed to hit the tire that was sticking out up front because the wheels were turned into the curb (manual trans and pointing downhill). Ruined the tire (the only good one I had; was in need of tires).
Clearly the other vehicle suffered more damage. There was a portion of inner fenderwell or wheelwell flare left on the ground, along with a large paint chip (I kept my eyes open for a couple months for passersby with dark metallic blue paint and body damage, but no luck).
I don't keep any parked on the street if I can avoid it.
Here's a pic my son took. You can see the front of his Xterra parked behind mine, amazing she missed it. The service rep I spoke with from Progressive was very pleasant, had spoken to the young woman that hit me already and she told her she lost it coming up the street and hit the parked car. Mine is absolutely legally parked against the curb in front of my home on a very quiet residential street. Most folks in my neighborhood park at least one vehicle on the street-as seen the photo. Between the motorcycle in the garage, my work truck in the driveway I have no where else to park-nor should I.

Doesn't matter if you were legally parked or not. You've got no liability here.

My wife plowed into a parked construction trailer in the hood that was ALWAYS in the same spot and marked with cones. [Bang]
Not a scratch on the trailer really.
Totaled her Suby (IMHO). Alas, insurance company fixed it. Damn car never dove right after so we traded it.

Personally I wouldn't even talk the their insurance company. I'd contact mine and have them handle it. That's what I pay them for.

Doesn't matter either way. Better off talking to the claimant carrier in my opinion.

And have to pay my deductible plus have my rate go up?? No thanks-that's why we have mandated insurance coverage. It was her fault, her insurance pays-no discussion.

She is at fault so your insurance company will recover your deductible from her company. They will work with your interest in mind, her company will not.
Don't be surprised when they try to screw you.

Yup, I've always let my insurance company handle it, never caused me any unnecessary headache or money.
Been down this road before, already talked to my insurance yesterday. I'll see what they offer Monday, nothing says I have to accept it. If I have issues then I'll get mine involved. There repairs should run between $2-3k max, not too concerned.
Progressive has already agreed it's on them, I do appreciate the feedback.

Sure they'll recover the deductible, 6 months from now. Plus, he'll have a claim on his CLUE report forever, at fault or not. If he goes through Progressive, they will pay for everything. If he goes through his own insurance, they'll pay for everything, but then may not get that same amount back from Progressive (which is not his concern in the least). Progressive could very well try to "screw" him, but everything is negotiable with Progressive. If he goes through his own company and they try to "screw" him, they'll have a signed contract (his policy) to back up their decisions and he won't get them to budge an inch. For example, if he doesn't have rental on his policy, he won't get one, period. Since he doesn't have a contract (policy) with Progressive, they will provide him with a rental.
Doc45, you've already made your decision and don't need help, but don't let my bantering with newracer influence any of your decision making. In this case, the accident is minor, no injuries (to you), no attorneys involved, so it's not a big deal either way.

All I know is the two times I tried to directly work with the others persons insurance they tried very hard to limit their costs and drug their feet to resolve it. In both cases after weeks of delays I ended up having my insurance handle it and it was quickly resolved and I was fully compensated.

There are definitely insurance companies out there that you don't want to deal with, and you'd be better to go through your own. Fred Loya is one for sure. Your own insurance company will still try to limit their costs is my point.

Now I'm curious... what companies are the worst to deal with? And which ones will really go to bat for their policy holders? (I'm looking for your opinion, of course)
Fred Loya is the worst I ever dealt with. USAA is the best I've ever dealt with. Even working for another company I was always relieved when USAA was involved. Every other company was about the same, just good and bad adjusters at that point.

Well cool. I insure all my stuff with USAA. Thanks for the response, although off topic.
What a pain in the neck but at least she stopped and admitted to it.

Hope everything gets covered with minimal headache.
Sucks you have to park on the street. I go out of my way not to do it for this very reason. Fortunately i have a big enough driveway. I live on a corner and see cars miss the turn everytime we get a bit of snow. On the rare occasion I do park on the street, I do it down the block away from the corner.
Well went in this morning to McDonald Collision Center off South Park near Broadway and Mineral. Progressive has an office there. Got me in right away and in a rental, tomorrow I'll get the info on how long it'll be.

I'll second what irving said. I'll add Perm General to the shit list, as well as American Family. All three of those companies pay out a LOT on 'bad faith'.. Irv knows what I'm talking about on that.
Seriously.. if you ever question your insurance company when dealing with them. Should it be just adding something to the policy or asking questions and you don't feel as if your best interest is being covered... shop around. I'll add a standard disclaimer that you should carry more than state required minimums on your vehicles. In reality 250/500k should be minimum coverage, then there would be a lot less problems.
Currently I'm dealing w/ USAA on a lady bumping into the ass end of my explorer. They're a bit slow on the call backs, but they called me before I had to call them. Nationwide on my end has been the same.. very proactive.
I do love their reaction when I tell them no the statement can not be recorded and we are ONLY talking about property damage.
Yep, adjusters are trained to take recorded statements, so when you tell them "no," they don't know what to do/say.

My son had to sue both AF (ours) and Progressive (theirs) on a bad faith claim. When you have collectors calling you to pay bills the insurance carrier should take care of, something's wrong.
Several days in ICU, 2 weeks in post op surgery, and a month in-patient at Craig rehab isn't chump change either.

Regarding hit and run, some years ago, I lived at a corner and had an old Chevy 3/4tr ton parked on the street. Some one came around the corner and hit it while we were out of town.
Came back to find the ass end of the pickup driven up on the curb about 3 feet from where I parked it. They had hit just the corner, mostly on the steel liftgate. dent the size of your hand and a broken taillight. But I found Nissan Frontier frontend parts scattered all over. I bought a new taillight for $40 and guessed the Nissan owning scumbag had 5-6 grand of damage at least.

I had Progressive once, NEVER AGAIN! I slid into cross traffic in bad weather and got T-boned. Had full coverage including rental. I knew the car was totaled as soon as it happened. I got my rental the next day, the car was towed to some yard. After a few days, I get a call from the yard wanting payment for towing and storage so I had them tow it to my house. The car sat in my driveway for about 2 months before an adjuster came out to look at it. During this time, every few days I would get a call from Enterprise Car Rental saying they either want money or they want their car back!
At this point I already have a new (used) car picked out at the Dodge dealership and they have it parked inside on hold for me. I told them I was just waiting on the Insurance company to cut me a check so I could take the new car home. Another two months goes by before they finally tow the car from my driveway and haul it to some scrap yard. Meanwhile, I'm having to call the Insurance company every couple of days to get them to pay more money for my rental. At one point the guy says to me "we'll, do you HAVE to have a rental car?" I about lost it at that moment.
Another month goes by and I finally get payed, go get my new car, return the rental and all is done.....or so I thought. Started getting phone calls from the finance company about the wrecked car threatening to repo it cause they haven't received payments! That was fun trying to convince them it was totaled and hauled off to some junkyard!
So needless to say, you couldn't pay me enough to ever have Progressive again!

Spending time at Craig is never a 'good' thing.. Sorry to hear about it. Insurance companies are generally sleazier than the lawyers.
