This exposes a tax loophole that few know about..............just the IRS and those abusing and taking advantage of our system.

It's very frustrating for me to work so hard and know I'm paying for those taking advantage of our nation.

Whose economy?

The recipients get program support/welfare for basics. Surplus gets sent out of country in addition to overt gov payments.

IMHO, it does nothing but create another incentive (public/private agenda) to take jobs from Americans and push down wages/salaries while exporting any cost savings/value outside of our economy.

If people only knew the truth...

So, if I understand the news story correctly, this is a fraud that anyone can perpetrate simply by lying when filling out the addendum for the additional child refundable tax credit.

Is there a specific item in the tax code that makes this loophole apply ONLY to illegals?

Or could you and I do the same thing and lie on our tax returns and take advantage of the same loophole, if we were willing to take the risk?

Or is it that the IRS is unwilling to specifically prosecute illegals?

You would likely get nailed because you have a history and assets. If you can't squeeze blood from a turnip, no turnips will be prosecuted. Someone could probably make the argument for full legalization based on this.

What I don't understand though, is if the IRS knows they can't prosecute anyone, why would they pay in the first place?

I see that as a problem in general with ANY refundable tax credit. A "Refundable" tax credit is one that enables a taxpayer to be refunded more than their actual obligation. In other words, if you owe $5k in taxes and have paid $2.5 in withholding, but you qualify for a refundable credit of $10k, you will get back $7,500 (the $5k difference between what you owe and the refund amt, plus the $2,500 withheld). It's always been a backdoor welfare system.

The fact that people who have already shown a propensity to break our laws are not bothered in the least to break additional laws does not surprise me, but I recommend we be equally outraged at the whole concept of refundable tax credits.

They can find you or I. The illegals are using an address where they don't live.

Most of our earnings and taxes are likely also reported directly to the IRS. I accidentally short paid my taxes by $250 one year...trust me...they noticed.

Because people without an income (or even very little income in many cases) currently don't file their taxes.
