The TL;DW is the 10th Circuit court said the first ruling is getting thrown out and we get a re-do.

It is not a win if they do A, B and C. They need to do their work and it is a long road ahead for anything we want as a win, it could also hurt us in the end. No one knows the ending yet. This was just an update, and a good one, but do not think it is a win for us yet.

Basically the judge told "our side" that they were tossing the case because we didn't have the i's dotted and t's crossed the way the judge wanted them but he told Kopel and the rest of his team exactly what i's needed to be dotted and t's crossed so that he'd accept the case.

So one wonders if this is being helpful, or just a vindictive burning of "our side's" time and effort.

I've always been of the Sir Robert Peel variety- "The police are the public and the public are the police; the police being only members of the public who are paid to give full time attention to duties which are incumbent on every citizen in the interests of community welfare and existence."
Anything LE can have in the performance of their duties, all citizens should be lawfully allowed to own. In fact, Miller addressed this as well. IMHO, anything the military can have (in terms of small arms, or for individual soldier use- ie: rifles and pistols) anyone should be able to own. It would be nice to see some precedent set in our favor out of all of this.

The latest from the Independence Institute is that the fight continues (from the March 22, 2016 Appellate court decision):

On March 22, 2016, the Tenth Circuit vacated the opinion of the District Court. Because of the Tenth Circuit’s decision, the District Court’s decision saying that the anti-gun laws were constitutional is now void. The Tenth Circuit held that none of the plaintiffs in the case had legal “standing,” so the courts did not have jurisdiction to decide the case. Because of the Tenth Circuit decision, the plaintiffs—and, potentially, new plaintiffs—can initiate a new case, following the procedural instructions from the Tenth Circuit. The plaintiffs’ attorneys are already at work, analyzing the structure for the new case. At a press conference, Sheriffs Justin Smith (Larimer County) and Mike McIntosh (Adams County) expressed the Sheriffs’ strong intent to continue fighting to defend the safety and the constitutional rights of the people of Colorado.

They forgot the article 13 of the Colorado Constitution where it says no person shall have his rights questioned. That has as much if not more standing then the 2nd amendment fight.

Article 13 (http://law.justia.com/constitution/colorado/cnart13.html) relates to Impeachment.

Article 2, Section 13 covers the right to bear arms;

Section 13. Right to bear arms. The right of no person to keep and bear arms in defense of his home, person and property, or in aid of the civil power when thereto legally summoned, shall be called in question; but nothing herein contained shall be construed to justify the practice of carrying concealed weapons.

Wonder if they will consider the 10th amendment related to the mags. If you can buy outside of Colorado, but can't transport them into the state that is interference with commerce It may also constitute a taking as you can legally posses until you hit the state line.
