View Full Version : Unique situation. Westminster ditch behind my house is seeping into my yard

Anybody here know about the liability with this. The ditch behind my house is seeping through it's banks or bottom and is causing major water problems in my yard, and in the near future my house foundation. The yard and house is at a lower elevation than the ditch. We dug some holes over the weekend to track where the water is coming from and it is clearly from the ditch. Wondering if this is my problem to pay for or if the ditch owner is responsible for it. Just spent a metric ton of $ on landscaping the back yard and this water issue is causing havoc with it. And no, the landscaping had nothing to do with the water coming in. It has been happening for over a year and I thought it was maybe coming from a sprinkler line. It's not as there are no lines running anywhere near where the water is coming from. The holes proved that and we can see water filling the holes from uphill where the ditch is located.

1st call should be to the town. You can see who owns the ditch through the county's website. BUT.... That's an all day affair, easy.

PM me your address, I work with a lot of the ditch companies in the area and might be able to put you in contact with someone who can look at it.

Call your towns planning or engineering department. They will be able to tell you who owns the ditch and you can go from there.
