View Full Version : Appeals court upholds ban on gun sales to medical marijuana card holders

I will just leave this here...
Was hoping someone would post this. We had a heated debate a few months ago on this wherein folks wanted to re-interpret 4473. No-just because marijuana is legal in Colorado doesn't void that problem question or the consequences of lying.
IMHO, the Feds are holding on to every tool they have to make as many prohibited persons as possible which is one reason they refused to reschedule marijuana.

Yet the opiates prescribed ( yes we've discussed it) mood altering adhd's or raging alcoholic, can buy with no fear of 4473 violation.
It's all about the $$$$$$$$$$$
When they add the line asking if I enjoy the occasional beer I'm screwed.
A few more otherwise legal gun owners are now criminals. A slow erosion
First they came for the pot heads, and I didn't say anything because I wasn't a pot head.
Then they came for the pill poppers, and I didn't say anything because I wasn't a pill popper.
Then they came for the alcoholics, and I didn't say anything because I wasn't an alcoholic
Then they came for me, and there was no one left to throw a great party for all of us.
No-just because marijuana is legal in Colorado...
Marijuana is not legal in Colorado.

Marijuana is not legal in Colorado.
Correct, it's been decriminalized.
Correct, it's been decriminalized.
And still illegal.

We swing, just not like we used to.
And still illegal.
OK, a little bit more specific-
Marijuana is legal but regulated in Colorado by Colorado Law.
By federal law it is not legal in the United States, which includes Colorado, but the federal marijuana laws aren't being enforced.
Another example of the breakdown of the rule of law that is currently happening.
so MJ is like 30rd mags? err mag kits? ;)
The "smarter" pot smokers didn't get their cards for this reason. Possible restrictions and letting "the man" into their business. Besides, why go to the expensive mmj/rec shop when the local dealer is cheaper and can now get as good a product.
Imagine when the government gets complete control of healthcare and no longer has to worry about HIPAA. There are going to be some sad people out there.

when DHS declares the "healthcare" system critical "infrastructure" and "protects" it from "terrorists"?

We probably won't need to wait for the dhs to declare the health system needs their protection. They'll just make sure that Colorado's obamacare amendment passes this November.

With the Feds backdoor to our votes by being placed in charge of the electronic voting security there is little doubt the votes will be what they want them to be.
I guess this ruling kinda puts a damper on my patent for the combination bong/suppressor...damn it. Oh well, back to the drawing board...

Gives a whole new meaning to "Taking a Hit"
I just inspected a grow facility, I hope I can still pass a drug test and a background check!

Most of the Pueblo West grow and retail marijuana facilities are guarded by armed security. They all deal in cash because the banks won't take their deposits. Most of the Pueblo West Metropolitan District large land sales have been to the marijuana industry. If I was Justice Department, I'd be looking closely at Pueblo West and Pueblo County. I bet a lot of illegal cash transactions are taking place. Would not be surprised if a huge amount is making it into political campaign coffers too. At least we got rid of Angela Giron.
What kind of illegal cash transactions?
According to police lately possession of any cash over about .25cents is grounds for seizure as illegal with intent of an illegal cash transaction.
What is illegal about a cash transaction at a cajole only business? Without more information, it just sounds like BS from some dumb cop.

I think he is inferring that these places are likely selling product off the books and not paying taxes.

Which is celebrated in society unless its those greedy big corporations not paying their share.

Didn't realize that was a thing - though I'm not surprised. Thank you for the knowledge!

I'm familiar with civil forfeiture. Have you heard about Oklahoma's newest law?

That sounds more realistic, except it still doesn't mean carrying any amount of cash over a quarter is evidence of illegal transaction. Not as long as cash is still an accepted form of currency.
I had $2k in cash on me while trying to go through security at DIA a while back. I got pulled to the side and questioned about it pretty harshly. The TSA couldn't seem to understand the concept of travel money and seemed to think it was a crime. In the end they inspected each bill and let me go on my way.
Oh I get how cash is scrutinized and is total bs. Once credit cards arrived on scene, the government seemed to forget that cash is legal currency.

How did they know you had the cash? I've been through screening several times with more than that.

I may be the odd man out here, but I am glad that they ruled this way.
One of the things I hear in the 2A community is that we don't need new laws, we just need to enforce our current laws.
Well, currently, it isn't legal to own a firearm and use pot. They ruled correctly.
Part of me likes this because dope is still a federal schedule 1 thing and this ruling is consistent with current law.
Part of me does not like this because a person should be able to do what they want provided they don't hurt anyone. So if a person likes guns and dope as long as they are personally responsible enough to leave their guns alone while they are stoned then why can't they do both.
The reality is that the government has gradually removed the need for personal responsibility by legislating so many things we do so now we have all these laws that quite a few people need because they have no self control.

So true.
Considering the number of 'tards that can't be bothered to follow the rules of legal pot in CO, I wouldn't trust a single one of them to not be screwing with guns while high.

Same.
How'd they know? If you didn't declare, was it all new bills?

I think the ruling was in regard to having a MJ card, not necessarily using it.

Are you actually going to try and tell me there are people that bother getting their Medical MJ card and don't use MJ?
I have a bridge in NY to sell you if you actually believe that...

He's referencing the MJ card holders vs casual pot smokers w/out a card.

Or drunk?

No, I hadn't. What is it?
The amount of people I see drinking or drunk at the national forest shooting spots have lead me to not give any fucks about pot. Stupid people will be stupid either way, I could not care less about a gun owner enjoying a joint after work vs a couple beers.

I'm not trying to tell you anything, other than the argument made in the court case.
No, I hadn't. What is it?
Now they can access your bank accounts, and if they decide that you have too much money in the bank, they can freeze your accounts until you prove you're not a drug dealer or whatever they're accusing you of at the time. We've got a thread about it kicking around somewhere, but I think it was from before you started actively posting this year.

A lot of these problems would be avoided if there was federal legalization. Ya know, like there was with booze after THAT ridiculous prohibition, that didn't work, and in fact failed miserably and prompted more gun laws, and thousands were killed and imprisoned and...........
And then we wouldn't bitch about d-bags moving here for weed because they would just stay where they are. [facepalm]

It's coming. Anyone know how many states have legalization on their ballots this election cycle? I heard a lot of states have medical stuff on their ballots, but I don't know if any are trying for legalization.
I always thought that the medical "step" was something that people would consider "common sense" and that's why it went that way, but it really causes issues on the path to full legalization.

I think the medical step would be viewed more favorably as "common sense" if it so blatantly and transparently a surrogate or fiction for recreational use. I would still have voted against Amendment 64 but I'd have hard much more respect for both the Amendment 64 and MMJ proponents if they had been honest.
Personally, I think it's fruitless and a waste of money to investigate and prosecute people for MJ usage but most of what I hear from the pro-MJ crowd are Clinton-level lies.
I've never been to one of medical or recreational retail stores, and don't plan on it.
Do they just glance at medical paperwork; or glance at ID like liquor stores? Or do they record/swipe/scan? Do kids with a "McLovin" ID have better odds of making a purchase than at an average liquor store?
