View Full Version : Carry of Rifle

So, CO CCW is only handguns, so no Samuria swords or rifles. I see a lot of these back packs for discrete carry of rifles but I can't figure out from the RMGO site how this would stand legally, beyond having a mag inserted and a round chambered is an obvious no-no. If you wanted to go for a walk or have a back-pack at soccer game, is there any legal way to do that? Stowed and the magazine seperate. Obviously not exactly a quick draw. I do like non-tactical looking bags for my guns in general for going to the range. Keeps the neighbors from getting to nosy.

Carrying a concealed rifle, anywhere other than in a private vehcile or on private property, would be a no-go. The magazine/loaded issue wouldn't matter from a legal standpoint (except in your car).

With a rifle, you'd be limited to open carry outside your vehicle/private property, and obviously only in places where it's not restricted.

There would be obvious, common sense exceptions, I'd think...you're parked in front of a gun store and carrying a cased rifle inside for service, maint, trade, etc... There's no statutory exception for that activitiy I'm aware of, just the common sense on the part of any LE officer with whom you come in contact.

Unless someone can come up with a different legal theory 'cuz I ain't no lawyer.

Hmmm... very interesting question actually. Here's a bit from what is covered under unlawful concealment:
18-12-105. Unlawfully carrying a concealed weapon - unlawful possession of weapons.
(1) A person commits a class 2 misdemeanor if such person knowingly and unlawfully:
(a) Carries a knife concealed on or about his or her person; or
(b) Carries a firearm concealed on or about his or her person;

Since it refers to "firearm" and not "handgun", a concealed rifle is covered I'd think. My opinion is that since the general public knows what a rifle case looks like, you could successfully argue that a rifle in the case is not "concealed".

The what is allowed by the licensed concealed carry holder is covered under:

18-12-214. Authority granted by permit - carrying restrictions.
(1) (a) A permit to carry a concealed handgun authorizes the permittee to carry a concealed handgun in all areas of the state, except... blah blah blah

The permit then allows "handgun" not "firearm"...

So based on my non-lawyerly reading of the law, I would advise myself not to do it. Kind of funny though, you can't break it down into a backpack so as not to alarm the public, but you can walk down the street with an AR slung over your shoulder.

Thanks guys, that's what I thought. I wonder if most states have CCW for just handguns or firearms in general? Most Pols wouldn't think of SBRs as a CCW.

I thought maybe there was a distinction between loaded and unloaded. There was a guy in my CCW class that made a lot of talk about his bike (10 speed not motorcycle ;) ) being his mode of conveyance, so he should have the same rights as a person in a car would. I guess you could stretch that stretch if you were walking to the range. All stuff I don't want to argue with the po-po about. I think you'd have a hard time explaining a Sig P556 pistol in a backpack, which most people aren't going to see as a pistol.

Open carry Rifle, now that is hard core open carry.

When I moved here in 2005, I saw a kid on a skateboard with an ar15 slung over his shoulder going on 7th Ave. Parkway. I have to think that someone stopped him eventually for some questions. Gotta think it was an airsoft.

If firepower is your end need....

An AR-15 registered pistol with a 100 round beta drum will fit in a lot of back packs.

If the 223 isn't enough there are always alternate chamber caliber AR's like the 6.8SPC, 6x45, 300 Whisper, etc. Any of these could easily be made as a pistol upper.

I still almost can't belive that it is legal to carry an AR-15 pistol with a 100 round beta drum with a CCW. Seems to be a loop-hole the politicians haven't thought of. I'm pretty sure that any LEO will give you a hard time though for it.

I guess that is what happens when anti-gun guys write gun laws. An AR or P556 with a Beta-mag, now that is a beast.

My main interest was that it seemed there were a lot of discrete carry bags that seem to be coming out, so I wondered if they had any practical use here.

Shhhhh! Don't tell anyone! Just be glad we don't live in Obamaland...in Chigago you have to register your firearm on your CCW. It specifies what kind of gun you can carry. I don't recall...it may be as simple as revolver or auto, but still...

I thought Illinois totally denied the right, and did not issue CCW permits of any kind. Maybe you're thinking of a permit to merely own a firearm?

Nevada is weird. If you qualify with a revolver (and a blind man should be able to qualify, as long as he's pointed in the general direction of the target), then you can carry ANY revolver, as long as it's listed on your permit, but if you choose to carry a semi-auto, you have to qualify with EACH semi-auto listed on your permit. Up to 6 guns can be listed on your permit, and you may not carry any other guns concealed. If you are carrying on an out of state permit in Nevada(that has reciprocity), these restrictions do not apply. I'm still pissed that Nevada rescinded reciprocity on my Utah permit, because Utah has no live-fire requirement. [Rant1]

I've still got half a mind to build an AK pistol

something like this with a 10 round mag would fit under a jacket reasonably easily

Sorry, but I'm finding myself asking the question why? I agree there shouldn't be govt restrictions in this anyway, but I'm looking at it from a 'defending yourself' perspective.

Your access to the gun is drastically restricted.
The over penetration hazard is huge.
Any engagement at a distance the rifle would be an advantage is enough to allow disengagement and escape instead of shooting (short of standing in the middle of the Pawnee Grasslands).

The first one will get you killed. The second one will get you sued and arrested. The third one will get you convicted.

If there's a logical reason, please enlighten me.

I wouldn't be building an AK pistol for concealed carry, but it could be. there are many many more practical pistols to carry.

I want to build one just to have one.

People just tend to imagine their personal defense situations to happen like the shoot out scene in Heat.

People used to bring up the "Heat" shoot-out as the unbelievable movie shoot out, until North Hollywood happened. Don't think you need a rifle? Watch the hour long special on HBO about the 60 hour Mumbia attack. Bolt action rifles and pistols got a lot of cops killed and made others run. We have bomb makers living in Aurora and driving us to the airport. Is it likely that you'd ever need to use a rifle platform to defend yourself, no. I didn't think it was likley I'd get mugged until it happened as I walked three women to their car one night, and what I wouldn't have done for a CCW as they tried to get into the car with the women.

I hope to God that I'm never in a situation that I need one, and it is likely that none of us will ever actually be in that situation, until it actualy happens.

Lot's of capable SBR rifles like the XCR Micro, Sig 556 and even the KAC PDW make it possible to have a rifle handy. There was a hole in my understanding, since we have CCW and open carry, I was intrigued on how rifles fit into the mix.

I don't see people pulling out an SBR in a normal street crime scenario. I hope there is never a scenario where I would need one.

I couldnt have said it better myself. If your backpacking and need firepower for the 4 legged creatures, get a S&W Airlite in 44mag. More then enough of any animal from here to Alaska.

The one who mentioned 100 rnd beta mag etc, you sound like my oldest son. Asks me about automatics all the time and I tell him, full auto isnt necessarily the answer. One well placed round is 100% more effective then 1 million rounds fired and missing its target.
Just dont see any logic. I travel by plane and vehicle all over the country and in some shit holes, sometimes I can not carry a pistol or even a knife, if your sole dependency is a firearm or a weapon, probably shouldnt be carrying one in the first place. YMMV [Beer]
