Theoretical question of the day-

Would the carry of a loaded Shockwave in a backpack be covered by a Colorado issued concealed "handgun" permit?

Inquiring minds want to know...

The verbage in the ATF letter says that concealed carry of the Shockwave MAY result in ATF changing its classification.

While i'm also curious what the correct answer is. The question is, why would anyone carry concealed in their backpack ? Not exactly something you can reach when seconds count.

Well in that case, how can you carry an AR in a rifle case. It's concealed and being carried... just saying silly things happen when we classify firearms.

Colorado CCW law allows for the carrying of a concealed "pistol". It specifies pistol. The shockwave is specifically *not* a pistol...it is a firearm. Per the ATF it falls in a default category that isn't shotgun, rifle, pistol...it simply is a firearm. So Colorado CCW law would not allow the concealed carry of a shockwave. On the other hand an AR pistol could be concealed under a CCW as it is a "pistol".

Personally I like the idea of an HK MP5K style pistol with a folding arm brace in a bag for CCW.

It would be a jury question, but doing so would likely be illegal since the law makes it illegal to (a) carry a firearm (b) out of sight, meaning not discernible or apparent by ordinary observation (c) on or about one's person, meaning on you or easily accessed by you. The State Patrol site says you need to take firearms from the car to the house in full view. (https://www.colorado.gov/pacific/csp/colorado-gun-laws)

That said, I can tell you I felt really weird walking down the sidewalk in Englewood carrying a Garand in full view last week. (I had just bought it; I'm not a psycho.)

Wait, so we can't use firearm cases at all for transporting guns? They have to be taken to/from car out in the open? That makes no sense.

Things that make no sense:

-Can't conceal a shockwave, but can conceal an AR pistol w/ 30rd mag
-Can't put a "stock" on an AR pistol, but can install a "brace" which is visually and functionally the exact same thing
-Can't buy a 20rd mag, but can buy a hundred thousand 15rd mags
-Can't put a 90 degree VFG on an AR pistol, but can put a 89 or 91 degree "AFG" on there
-SBR's are illegal if not registered, but throw an extra few inches on the barrel increasing the bullet velocity and killing power and you're fine

I could go on for days

I knew that someone would be along shortly to clown my use of the phrase "doesn't make sense."

The assertion made by the State Patrol's webpage does not appear to be supported by Colorado statute. CRS 18-12-105 talks about penalties for carrying concealed weapons, but I don't think that transporting your guns in a case would run afoul of that law. Otherwise why don't cops camp out at the airport to arrest all the people who are trying to check in their firearms (which must be in a case) and not "in plain view"? Or at any shooting range to arrest those who pull cased guns out of their trunk? You know at least Denver PD would be all over enforcing that one.

If I'm missing something, please reference the statute or case law that backs up the State Patrol's assertion.
