FORT BRAGG, N.C. (AP) — Army Sgt. Bowe Bergdahl told a military judge on Monday that he's pleading guilty to desertion and misbehavior before the enemy.
"I understand that leaving was against the law," said Bergdahl, whose decision to walk off his remote post in Afghanistan in 2009 prompted intense search and recovery missions, during which some of his comrades were seriously wounded.
"At the time, I had no intention of causing search and recovery operations," Bergdahl said, but he added that now he does understand that his decision prompted efforts to find him.
Bergdahl, 31, is accused of endangering his comrades by abandoning his post without authorization. He told a general after his release from five years in enemy hands that he did it with the intention of reaching other commanders and drawing attention to what he saw as problems with his unit.
It wasn't immediately clear whether his defense has conceded that he's responsible for a long chain of events that his desertion prompted, which included many decisions by others on how to conduct the searches. Despite his plea, the prosecution and defense have not agreed to a stipulation of facts, said one of his lawyers, Maj. Oren Gleich.
This indicates that they did not reach a deal to limit his punishment, and that he may be hoping for leniency from the judge, Army Col. Jeffery R. Nance. The misbehavior charge carries a maximum penalty of life in prison, while the desertion charge is punishable by up to five years.
The guilty pleas bring the highly politicized saga closer to an end eight years after Bergdahl vanished in Afghanistan. President Barack Obama, who approved the Taliban prisoner swap that brought Bergdahl home in 2014, said the U.S. does not leave its service members on the battlefield, but he was roundly criticized by Republicans. Campaigning for president, Donald Trump suggested Bergdahl would have been executed in a previous era.
While Berghdahl's pleas enable him to avoid a trial, he'll still face a sentencing hearing scheduled to begin Oct. 23. His years as a captive of the Taliban and its allies could be factored into his punishment, but the hearing also will likely feature damning testimony from his fellow service members. The judge has ruled that a Navy SEAL who suffered a career-ending leg wound and an Army National Guard sergeant whose head wound put him in a wheel chair would not have been hurt in firefights had they not been searching for Bergdahl.
The defense also was rebuffed in an effort to prove that Trump had unfairly swayed the case with his scathing criticism from the campaign trail. The judge ruled in February that the new president's comments were "disturbing and disappointing" but did not constitute unlawful command influence by the soon-to-be commander in chief.
Bergdahl, who's from Hailey, Idaho, has been assigned to desk duty at a Texas Army base while his case unfolds.

I'd be OK with hanging or firing squad...but that ain't gonna happen.

On the other hand, I'm hoping he spends a substantially long time in prison. Best I can hope for after that is that someone reminds him every day of what he did and what a disgrace he is and that haunts him the rest of his life.

How on earth does someone abandon his post in a war zone, get himself captured through his own negligence, get others killed and wounded due to their negligence precipitating the search effort, and then get no prison time?

I had guys who went AWOL over a girlfriend for a few weeks and got a year in jail!

And they didn't even put others in danger in order to rescue them.

There is more to this traitor's story then we know. He's story never made sense, good men were killed and injured looking for him, Obama paid big to get him back and now he gets no time.

Wish I could say I was surprised but I'm not. In fact, I pretty much figured this is what he'd get (I actually thought he'd get a BCD but he got a DD which is technically even worse than a BCD so there's that, at least.)

I don’t think UCMJ can re trial but I’m not an expert. This is such a terrible ruling for the military. Command authority has been seriously degraded.

What a horrible outcome and a black eye to the military.

How many more assholes will walk off their posts, get members of their platoons and squads killed during the search, and get away with it after trial.

I'm curious, the judge was saying he was using Trump's words as mitigation. As CiC, what authority does Trump have over said judge? Can he remove the judge in any way, or is he basically untouchable (political questions aside)?

How can someone who pleaded guilty be re-tried? I was under the impression all proceedings were for sentence, not guilty/not guilty; pleading guilty saved him the trial, did it not? Pursuant to that, what effect could Trump's words have on a guilty plea entered by the defendant himself? Is the judge making a point he isn't a shill for a kangaroo court? Why?

I had a PAC clerk who drew fraudulent BAH and got sent to Leavenworth. He was supposedly married (but separated) from a woman with kids in Chicago- all made-up to get extra $$$.

Kinda pales in comparison to SGT Jackwagon's escapades.

Yep Send in Bob Lee, shooter was a good movie but the book was better. Just SMDH this opens a door that can't be shut, bad day for the Military Justice system. Btw reading those comments really make me realise how far the left is in thier sick twisted reasoning why this was the right decision.....yep this country needs a purge

It now appears that punishment for the most grievous of offenses under the military justice system (UCMJ) is essentially non-existent.

Bradley (aka Chelsea) Manning illelgally released over 750,000 classified and sensitive documents. The effects of this release are debatable but many believe that it was the catalyst for the "Arab Spring" events in which many lost their lives. Manning was subsequently convicted and sentenced to 35 years in prison (Ft. Leavenworth military prison) 3 years after his arrest. Barrack Obama commuted his sentence to 7 years from Mannings arrest. Manning served just 4 years of his 35 year sentence for all of his heinous crimes.

While the question of whether any lives were actually lost during the Berdahl search operations (I believe there were but some blog claims to have "debunked" this account and many in the general populous are taking this a proof that it didn't occur), the one thing we know without question is that many were injured - destroying their lives forever and that 5 terrorists were released to secure Bergdahl's release. We also know for sure that several of those 5 released terrorists returned to terrorist activities, responsible for the deaths of many more innocents.

Regardless if Bergdahl's intent was to aid the enemy or not, his sentencing should have been based significantly on the lives ended or destroyed because of his wanton and intentional actions.

The saddest thing is that his DD should mean the best he can hope for in employment in the future is as a school janitor or fast food worker but I foresee some liberal douche giving Bergdahl a high paying position in a prestigious firm. Sickening!
