and he doesnt have to register as a sex offender. If he does anything to anyone, the judges and anyone else responsible should be tried, convicted and strung up from a lamp post.

I saw this story yesterday. Totally disgusting judgement on this for a mentally ill scumbag. He WILL do this again.
I will say it again, anyone convicted beyond reasonable doubt of forcible rape of a child should be executed immediately upon conviction.
This is when the fathers of the community take care of the problem. He just disappeared one night. Nobody knows where the offender went.
The courts failed us once again.
The DA is who failed in this case.
This is exactly why we need more gun laws.
Disarm the folks so we don't take matters into our own hands?

No. Just trying to illustrate, in my typically sarcastic way, of the idiocy of people calling for gun laws when guns have nothing to do with the issue.
EX: Man drives truck into crowd on sidewalk then gets out and stabs people. Progressive response is to call for gun control.
District Attorney Rubinstein sent the following statement to 11 News on Thursday:
While there has been some news coverage on the travesty of justice that occurred with the release of Michael McFadden, I think it is important for the community to know what occurred so that they can take action at the next election of court of appeals judges Jones, Graham and Welling. The court of appeals blames both the trial judge and the legislature, but in my opinion, the court of appeals got this one wrong. I have already been in touch with Sen. Ray Scott, Rep. Dan Thurlow, and Rep. Yeulin Willett to change the statute, even though I still believe that they could have affirmed the conviction without the change.
The defendant was charged with sexually assaulting 6 children and being a habitual sex offender against children. The trials of all of these victims were consolidated. On two previous occasions, the defense asked for a continuance and waived his right to a speedy trial in order to secure the continuance. Prior to the third trial date, there was a jury questionnaire which was drafted by the defense which referenced Mr. McFadden's prior offense, which both parties were comfortable with, given the court's ruling that the facts of the prior offense were going to be admissible.

GRAND JUNCTION, Colo. (KKTV) - A man who was freed on a technicality from a more than 300-year prison sentence was put back behind bars Friday night in El Paso County.
Michael McFadden made national headlines earlier this week when he was released from the Arkansas Valley Correctional Facility in Ordway on Tuesday. He had been convicted of sexually assaulting half a dozen children, his latest conviction was tossed out because of issues in the jury selection process that resulted in a delayed trial. According to the Colorado Department of Corrections, the minimum sentence he would have faced was 316 years.
McFadden, 46, appealed his 2015 conviction, claiming pre-trial delays violated state laws for a speedy trial. In June 2017, the Colorado Court of Appeals ruled in his favor and threw out his conviction.
The Colorado Supreme Court decided on Feb. 12 not to hear the appeal, meaning the lower courts ruling which did not allow the case to be re-tried, would stand.
Authorities learned on Thursday McFadden still had to register as a sex offender for a prior sexual assault on a child sentence in 1990. An arrest warrant was issued. He was arrested at the El Paso County Department of Human Services at about 4:30 in the afternoon on Friday. It isn't clear if McFadden has the means or option to bond out. 11 News has a request into the police department for more information.

For a person with a sentence greater than his life expectancy there's no value in discipline. Society really only has two option; warehouse for life, put in ground.
The reason capital punishment was common in history is because a person in the ground can't hurt anyone else. Ever. Less about punishment and more about insurance.

Resources were a bit more limited than they are today. Why would a society waste resources that could be put to good use into a predator being punished that never will add anything positive to the society? Remove the cancer and move on.

Our justice system is designed solely to protect the accused. Not to deliver justice. While we all joke about this stuff and many like to believe it would actually happen; there isn't a citizen alive that will sacrifice their freedom to take care of this individual problem. Our justice system comes down especially hard upon those who seek justice. Career criminals on the other hand? Can't have as much money in the system unless you make it a buffet line they keep coming back to.
So, lets stop believing he's going to be taken care of. Accept the facts - he's going to be registered, but living in a house in another state, until he gets close to someone and molests a child again. Rinse, repeat. Welcome to America. Hell, if he fights it in Colorado he can even get off the registry, because it's "cruel and unusual punishment" according to a pedophile justice here. His record will be cleared from all but the prior offense, and his prior offenses deemed prejudicial anyway; so when caught after molesting another 4-5 children, he'll get little more than a slap on the wrist and they will never be able to address this history in the court.
Any of you going to volunteer for prison time? Nope? Nobody else will either.

You're right, there is not anyone that will step up to make it right.
I can't say that if this happened to my child I would even think about going to jail, I would just make it right. My wife would never forgive me if I didn't. We're just that way, we're old and are from a different time where justice does matter when it comes to family.
I really hope that this guy goes away forever and no longer troubles society.

They seem to do a great job picking the right victim/family. Kind of like street thugs... It's a sixth sense.
There are some people in world whose kids shouldn't be messed with. I'll only say that.
I will also add charges against anyone cleaning up gov's mess for us can be nullified by a jury. Not that I would ever publicly state that is my intention. Nor would I point out the need to stay silent with such intentions until deliberations start.
