So my wife got her vehicle hit outside of Starbucks today. She was standing outside of the vehicle while Theresa L. (Edited by foxtrot to remove PII) hit her while in a Nissan Frontier.
she said she would file with her insurance and how has filed with our insurance. I already filed with Theresa’s insurance on behalf of my wife.
this fucking bitch claimed to my wife she was at fault, asked for pictures from my wife, says she would claim with her insurance and now filed a claim with ours.
how far can I go claiming insurance fraud against her, personal claims, damages, anything and everything I can. J want this bitches house.....she is a pure scam artist.
You have nothing at all to stand on as far as fraud. Sorry to hear about the accident. Tell your wife to tell the truth to both companies when she talks to them.
EDIT: Take a deep breath and let your wife handle it. You shouldn't be talking to anyone at all, since you weren't there. You shouldn't even have called in the claim. Nothing wrong with calling in the claim, but since you weren't there, nothing you say adds any value to the process. Since you're upset (for good reason) I'd just stay out of the entire ordeal altogether.
It's not even fraud unless she (the liar) is somehow awarded something. For that to happen, BOTH insurance companies would have to not believe that Sniper's wife was outside of her vehicle watching the accident happen. As long as she tells the same story to both insurance companies, she has a better chance of having a consistent story than the other lady who is lying.
A dash cam that runs all the time, or turns on at impact, may be in your future. Sniper if you're feeling really cheeky, you could try contacting the Starbucks to see if they have security footage. Most places won't release it to you if they do, especially if you start yelling at them and threatening lawsuits. However, sometimes they will show the video to a police officer, or otherwise verbally explain what they see happening in the video to someone calling on the phone (police or claims adjuster). Good luck either way.

We've been dragging our feet on getting dash cams. A woman admitted to causing a minor accident my wife was in and the womans insurance bitch said "I know she did, but prove it" to me. Talk about pissed off. I'll never go with State Farm for that reason. A dash cam would have made it very easy to prove the womans fault in our case.
We will be at Starbucks as soon as they open. So how do I go about getting them to show me the video, so j need to call the police? Or do I need to get a statement from them for the adjuster?
This makes my blood boil this woman is so fucking worthless.

dash cam in the front, one in the rear and one on each side is the only way to go these days.
They have some that when there is a collision or hard brake or swerve they capture a minute before, the incident itself and a minute after.

In they few accidents I was in that the other party was at fault, I refused to hand over my insurance, nor reported it to my insurance. Never was an issue, and filed an accident report with the PO when they weren't called to respond to avoid hit and run charges. Took plenty of pictures and never had any issues.
Only time I had an issue was when a woman changed lanes into me. Her insurance only wanted to pay 70% since they said I should have known she was going to change lanes. I asked how, since her lane was unobstructed with no need to change lanes. After a BS answer, I hung up and sicked my insurance on hers. 100% payout.
If Starbucks does actually have useful CCTV it is extremely unlikely that they will provide it to you for a civil matter.
Most corporations will not provide their private property (video evidence) to third parties.
Had you contacted the police, they may had requested to view any video from Starbucks andvthen would have documented that into their report or made an official request from them for a copy of it.
I seariously doubt that Starbucks will want to get involved between to civilian third parties.

Pretty much this. I'm assuming if the police weren't called it was because everything seemed amicable enough at the time. Also, there is a chance the police wouldn't even come to such an event since 1) it was on private property, and 2) it was minor with no injuries.

Colorado is a no-fault state. If no police report then your insurance will fix you and the other party will get their vehicle fixed by their own insurance. Unless they don't have insurance then in the end they will be out of pocket. So will you for your deductible. I have already been through this.

For future reference, Colorado is a "Single Party Consent" state when it comes to recording phone conversations. I'm thinking that quote in court would win you the case.

Good luck, my wife had a similar incident where a woman saw her about to park and opened her door at the last second, "oh that's my fault". Next thing I know they wait past the time given by our insurance for her statement so I figure all is done.......that is until we switched insurance companies and find out she hit our policy with a clam and our insurance didn't even notify us so yea screwed till that comes off.

Fair enough, just my way of explaining what will happen in layman's terms. Several years ago that was how it was explained to me by my insurance company (no longer with them) when I was rear ended in a parking lot and no witnesses or police report was filed. No one at fault so you fix your own.
Don't feel too bad about it, I've never once heard someone actually explain "no-fault" correctly. Police are notorious for saying that kind of stuff at accidents as well. It is true that if you have coverage, and there is no one else to get involved you can repair through your insurance carrier (that's the whole point right?). As far as Colorado is concerned, the whole "no-fault" thing has to do with injuries.

I could never understand why it was so commonly misrepresented by people, but I later learned that depending on a state's liability laws, no-fault CAN be understood to mean it the way it is commonly described. I blame convoluted local laws and insurance regulations rather than the people caught in the messy web that is Government+Insurance.

Amazon has a lot of geat dashcams, and they're not terribly expensive.
I'd go with what Irving says....and if you have State Farm, know that they are evil incarnate.

Just installed a dash cam on my car last week. Highly recommend dashcamtalk.com. Lots of sample footage and helpful folks, you can find what fits your needs and budget.
Will update this one thank you all for the advice, almost replied a couple times but wanted to see what different insurance said.
My insurance (allstate) has been awesome. The claims adjuster told me they won’t pay her a dime and made it a non issue to give a statement and go through the process.
The dirty lying thief on the other hand, her insurance had been horrible. I had called her shortly before I made this post to question why she just put a claim through my insurance when her text clearly says otherwise. She answered, talked for 5 minutes and denied anything, then hung up. I told her she was committing fraud and she should go to jail.
The next day I get a call from her Farmers insurance agent Todd Baker down in aurora who proceeds to try and tell me not to call his client. I tell him I can call whoever the hell I want, she gave us her phone number and being that I am the owner of the victor and the insurance policy Who does he think he is to call me and tell me who I can and can’t call at a given time, especially when she answered the phone and talked for about 5 minutes.
So that brings me to my next question, how do I go about filing a formal complaint through farmers against this guy. I never gave him my number, so it is apparent he either took it upon himself to get it from the claim who he told me I should only talk to them (again why is he calling me) or he got it from his lying client, And again I never gave my number to him to call me.
Fast forward to yesterday and farmers finally calls, well it is the second adjuster assigned to the claim and isn’t even the guy assigned by some woman who is filling in for that guy. It was like being interviewed for a damn murder, she had to say she was recording, wanted verified statements from me and my wife, pretty insane compared to what I have dealt with before through Geico and allstate.
So we will see where it goes from here. I knew the lessons my wife had learned which would have made this a non event, but I still find it pathetic a worthless lying woman won’t fess up and tell the truth. She is a scammer and pure lying trash for being so deceitful.
Farmers agent should never have called you. If she (liar) isn't represented by an attorney, it didn't matter if you call her. She likely told her agent you were harassing her, we'll assume that you weren't.
I'm confused why the Farmers adjuster would want a statement from you, assuming you weren't there. If you were there, then that makes sense. Sounds like everyone is trying to stand up for their own guy, which is what agents and adjusters are supposed to do, but only to a point. My opinion is liar told her adjuster that you were some harassing psychopath and that pissed the adjuster off so she was extra mean to you. After all it's said and done, none of this will matter, but I would say that you should still lodge a complaint about the agent. Nothing will come of it, but he shouldn't be playing tough guy and can get a little talking to from Farmers about it. Hope it continues to go well for you.

This is the surest way to keep your statement exactly the same between the two companies. In this case, there isn't much to, "I was standing outside my parked vehicle when I saw X drive into it."

Also most video security is not archived. Its over written unless its flagged and saved for an "incident". So if you don't get to them within a day or two it'll be gone anyway.
As far as the cameras, they didn’t have one covering the parking spots unfortunately.
Glad to hear they actually talked to you though. A lot of places won't tell you anything.
