A friend of mine just posted this on FB about 1 minute ago.

I stopped for lunch at a McDonald’s in Greenwood Village , Colorado today and before ordering I went to the restroom. As soon as I enter the stall there sitting on top of the toilet tank is a brand new Sig P-365. More than likely some poor CCW holder left it behind. Naturally I cleared it and turned it over to the local police. Needless so say somebody is going to be very upset when they realize what they left behind.

Happens to cops all the time. You would think the weight of that pistol would be a noticeable absence but sometimes people are preoccupied with other thoughts.

That is the absolute opposite of what I normally find in a men's room. (Unless you feel strongly about the P-365 and then it's more of the same).

Same thing happened at an Einstein’s in Denver-a Glock on the tank. Got turned over to DPD, half hour later a FBI sa stopped back by-oops. Wonder how that conversation went at the office??

This is why you should figure out how to take a dump without having to unholster/reholster. If you're an IWB+IBS, you're going to glock tank too. Pocket carry for all!

I was taught in my FIRST CCW class... by somebody who had been there...

when you do your business, put your holstered weapon IN YOUR UNDERWEAR (which will be on the floor, but still inside your pants at the time).... you will NEVER forget to put it back.

This scenario has always scared me, thankfully it hasn't happened to me.

On the topic, it does really suck when you have to 1 or 2 in public restrooms and there's nowhere to put your carry. Often I find myself using a stall, sometimes the HC stall, and even then sometimes there's nowhere to put it. Once I did place the holstered weapon in a limbo angle between a grab rail and the wall.....and mid piss it decided to follow gravities idea directly to the ground..... Oh Sheet moment there !! .....other gentlemen were in the facility at the same time as myself. Some shitter paper dispensers are not wide enough to place stuff on top of.

Just my opinion, but if you feel you need to physically remove your pistol from your belt, you need better carry gear. There is zero reason to separate your pistol from your holster, or your holster from your belt. What the hell are people even doing on the toilet?

I must be the oddball. I keep mine in my iwb and am just careful when I drop my drawers and then put them back up.

I basically stated a variation of THIS...

It doesn't leave your person, even when your shit IS...

When you drop your drawers with it IWB, it flops down into your underwear... you forget and pull up your pants with it there, you WILL notice.

No special gear required, I've been carrying for over 7 years now with ZERO issues... it's simple discipline.

I wear cowboy boots most of the time. I slip the bottom of my IWB holstered ccw into the top of my boot to keep it from flopping. It's still on my belt so it comes up with my pants. No chance to forget it.

Just like an earlier thread where someone was talking about unbuckling their belt just to take a piss, I for the life of me cannot understand why folks make shit (pun intended) so complicated sometimes....

when peeing - unzip, heck even unbutton if you want to, but whip it out, pee, and leave your belt alone...
when pooping - leave your gun in the holster and carefully let it flop over into your downed pants, then drop your drawers on top of it so someone outside the stall doesn't see your gun...

Why it needs to be more complicated than that, I have no idea.

I was at Camp Buehring in Kuwait in 2004 when the Marines and NYARNG troops were passing through on their way to Iraq. Since they were getting ready to go into Iraq they were required to carry their weapons 24/7.

For about a month, at least twice a week someone would leave a weapon in the showers or toilets. Usually someone from the same unit would pick it up and turn it over to the unit and then Lcpl or SPC Snuffy would have to explain to the 1SG why he doesn't have his M4.

I'm guessing it was a similarly embarrassing conversation to have as that FBI agent but with more yelling and PT. :D

The 365 is sort of a Glock knock off so those guys probably aren’t into de-cock so much.

I carry at about the 3 o'clock position so I drop my pants down to where my gun is holstered just above my knee on the side where its easy to get to should I need it (and I'd think on a public toilet is probably a slightly more likely place to get robbed than just walking down the street since you're vulnerable).

Just put it in the Ass Gasket dispenser, and be sure to pull the trigger when removing it...... Like in a thread here a few years ago.

If your holster IWB, OWB, SOB or appendix carry won’t retain your piece (handgun) when inverted, you need a better holster.

Not me, but for some, “the put it in the crotch of your underwear while sitting” to take care of business approach is the fact of laying it on skid marks that are there.

After the 2013 law change, I'd assume you'd be in trouble for getting it without a background check, unless you find out that it was your dad that left it in there. :p

To answer the original question seriously, it could be considered theft, theft by receiving, whatever. So long as the glock tank'er reported it as stolen. Then secondary to that - yes an unlawful transfer. Which the seller could be responsible for :D

About 10 years ago I worked downtown and used to find guns. Usually junk. I'd call the police to give it to them. Turns out you don't get to claim it if no one comes for it. At the time, I looked into it and was state or Fed law. You're better of finding money.
