10. In this case the facts show the defendant possessed a gun, in her house, for the purpose of self-defense without a FOID card. To require the defendant to fill out a form, provide a picture ID and pay a $10 fee to obtain a FOID card before she can exercise her constitutional right to self-defense with a firearm is a violation of the Second Amendment to the United States Constitution as applied to the States and a violation of Article I, Section 22, of the Constitution of the State of Illinois, as applied to this case only.

11. Based upon the forgoing, the Court finds 430 ILCS 65/2(a)(l) unconstitutional as applied to this case.

A 2A win is a win, even if small. Especially in IL.

"...as applied to this case."

So...it's an exception, not the rule?

This could go to the US Supreme Court. The FOID cards are no different than a polling tax, a tax on a constitutional right. But then the totalitarian thugs will simply up the fees on background checks. Like a backdoor poll tax.

No poll tax.

No jacket tax.

Constitutional Carry, a recognition that no free citizen should be required to ask any government for permission to exercise a right they were born with is my standard for "doing the right thing" by the Second Amendment.

Of course it is hard to make many see that when the government can legally take away the right to life without due process or in fact the existence of any crime but merely existence causing inconvenience; then infringing on any other right just becomes de rigueur.
