KREMMLING, Colo.- A Kremmling man faces 12 misdemeanor counts of fourth-degree arson after he left numerous burning slash piles unattended, according to a release from the Grand County Sheriff's Office (GCSO).

Just before 4:30 p.m. on Oct. 27, GCSO said deputies were dispatched to the Gorewood Subdivision off of County Road 14S in Kremmling about a possible fire burning near a residence.

Deputies, along with the Kremmling Fire Department (KFD), arrived and found multiple unattended slash piles actively burning near a residence, the sheriff's office said.

KFD was able to get the slash piles knocked down, temporarily extinguishing the flames. Deputies attempted to locate the owner of the property, later identified as Christopher Linsmayer, but couldn't. They later learned that Linsmayer had left the residence that morning, leaving the fires unattended, according to the sheriff's office.

Even with snow on the ground, that's pretty bad given the recent scenarios. HOWEVER, here is the kicker...

Linsmayer is the husband of Denver District Attorney Beth McCann.

I guess the mantra of "laws are for thee, and not for me" is alive and well in the McCann household.

Some other fun facts:

In February of this year, court records show that Linsmayer pleaded guilty to arson charges related to an August 2019 incident. According to a prior report from SkiHi News, he burned a slash pile on a Red Flag Warning day.

In November 2016, Linsmayer was charged with open burning without a permit, but according to court records the charge was later dismissed.

But...it is all ok because the Denver Council recognized that the property Linsmayer was burning things on was once owned by the native races and in recognizing that it helps negate the wrongs of the liberals.

I'm surprised it's "arson" if you burn slash during a Red Flag Warning day. I figured arson would imply intent to do harm or property damage or something, but what do I know. Maybe there's multiple levels of arson, like murder.

Some people just don't like rules. Regardless of ignoring burn rules, I can't even imagine how he convinced himself that just leaving burns unattended was okay. He probably does it all the time and nothing happens, so it must be safe right?

Fourth Degree Arson: An individual knowingly or recklessly starts/maintains a fire or causes an explosion on their own property or another person's property. This act must place someone in danger of death or serious bodily injury or must place another person's building or occupied structure in danger of damage.

Endangered Person: Class 4 felony, punishable by incarceration, ranging from 2-6 years.
Endangered Property ($100 or more): Class 2 misdemeanor, punishable by up to 12 months in jail.
Endangered Property (less than $100): Class 3 misdemeanor, punishable by up to 3 months in jail.
Note: It is not considered fourth degree arson if a person starts and maintains a fire as a controlled agricultural burn in a reasonably cautious manner; and no person suffers bodily injury, serious bodily injury, or death as a result of the fire.

Yep, it's cheap to fix, but the law frowns upon the method.

And in this gem too from KMGH...

According to Sky-Hi News reports, a 10-acre wildfire, known as the Gore Ridge Fire, started on Linsmayer's property in September 2016 and spread to a neighboring property, causing over $100,000 in damage.

Serial arsonist?

At the very least this nutter likes fire. I wonder if he had to pay compensation after the 2016 fire he started.

Am sure his wife had alot to do with his easy ride on past infractions.

She has been a scumbag for years. Very poor prosecutorial judgement. Little to no support for folks in blue.

She let coscumbag Taye Anderson off the hook for assaulting a Denver police officer during the summer rioting/looting.

Serial arsonist?

This was my thought as well. A "Normal" lowly citizen would be charged as a repeat offender.

Some animals something something more equal.....

Isn't it legal to shoot someone who is engaged in committing arson?

My guess is that this well connected fellow will get off of any felony but will see misdemeanors. Burning slash piles in snow is generally acceptable but not during a fire ban and not left unattended.

The Boulder County wildfire mitigation group recently held a podcast on how to safely burn slash piles. Sometimes they light a thousand or more at a time.

Some years ago we had a pyro neighbor who was always burning something, trash, leaves and weeds, anything. And almost always in dangerously dry conditions. So glad he's gone.
