If it wasn?t for the . Coup de grace, he probably would have had no worries of prosecution??

Edit:
OK, this article doesn’t have it in it, but a previous one I read said “The customer shot 9 times, including one time in the direction of the suspects head after he was down on the ground.”
On Twitter the whole video is shown. The last shot is what will end his freedom. Otherwise good shoot and outcome withe the elimination of a criminal and tax payer expense for a hospital stay and room/board.

Can you post a link to the video ? I don’t have a twatter acct.
From what I saw on twitter shots 7 and 8 are questionable and 9 th shot was execution.
As far as I’m concerned I’d nullify if on a jury

We'd have A LOT less theft if this happened more often.
Not saying it should happen more often, just stating a fact.
You have to love Texas:
In the same article linked by the OP, he is justified..............
"...."I can point you exactly where it is in the law, 9.31 and 9.32 of the penal code," said Nathan Beedle with the Harris County District Attorney's Office.
Beedle says Texas law outlines specific instances pertaining to robbery by threat, or aggravated robbery, where deadly force is presumed justified.
"Whether someone uses deadly force in the situation, that is presumed to be correct under Texas law," Beedle said. ........"
I wanna see the whole video too, I've seen the censored YouTube one many times.

He'll walk. No true bill.
No sympathy for the robber, but IMO only two shots were needed, certainly none after he hit the floor. But the BIG no-no IMO was giving everybody their money & stuff back, then everyone hauling ass. That's messing with evidence, and everyone there was a witness/victim that needed to be interviewed. Just sit down and wait for the po-po, have some sopapillas.....

Well, it would surely put the kibosh on recidivism.

Damn, now the linked twatter version is censored..
I'd put money on him being a prohibited person.

He was twitching!

Shots 1-6 were fine in my book. 7-8, questionable, shot 9 is the problem.

I was thinking that as well. Something about his pants and boots was telling me he had done time. I'm not sure why

That video (at least for me) counts down from 21 seconds to zero and stops where the seated shooter points his gun at the back of the thief, then repeats.

Don't go to the video pic, scroll down just a bit and look for the word "view", and click on that. I'm not a twatter-verse user so I don't know how to link it, but even my simple old ass was able to view it.
Poster's name is Gage II, title is "Cont." That link on post #9 takes you right to it.

Damn, looks like he shoots in the direction of the guy sitting by the jukebox. Glad he didn't get shot.
The shooter has been identified and the case is proceeding to a grand jury.

Gee, I thought the police "Only wanted to talk to him."

The deceased was out on parole for another robbery where a cell phone store owner was killed. A lot of mitigating circumstances in favor of the customer.

He lawyered up, talked to HPD detectives yesterday. He was allowed to leave, no charges. TX law requires a GJ review the case. So far, looks like he might slide by. HPD did not release any info about him either. I'd bet he was a prohibited person in some form, as well.

Vigilante: Another word in the war of shifting definitions that we have lost.
Self defense is not vigilantism.

I wonder... if autopsy shows that the robber had already sustained unsurvivable injuries from the first few rounds, it could be argued that any gunshots after those were, at most, abuse of a corpse. Just sayin.

You're in the wrong profession.
Should've been an attorney! "I'd like to motion for a directed verdict and my client will plead to a lesser charges of abuse of a corpse and discharge of a firearm in city limits. As a matter of law, you can't murder someone that's already dead, your honor. How much community service do you want?"

In depth legal breakdown of the shooter's actions and Texas law.
Basically, the first 4 are fine, the next three likely are as well. The 8th and 9th could lead to legal trouble.
