View Full Version : Prop kk Colorado 6.5% gun tax start date?
Everything I can find on line says it starts on 1 April but there is a shop in here that is already charging it, claiming it started 1 January. What say you?

I think I know what shop you are referring to. They were pretty adamant that the tax started on January 1st, and the must start remitting the tax on April 1st. Of course, this shop doesn't like it's customers correcting them.

I am curious to see if smaller online vendors just stop shipping to CO as they don?t want to deal with it.
For the local shops, I guess everything will have another tax on it. Seems like sales and this tax means add another 15% to purchase.

As others have requested, which shop insists they are required to collect this tax Jan 1?

One of the benefits of this local site is to hold members accountable for their decisions, both good and bad. Which shop is trying to stick it to us 3 months early?

You know that's coming. Big retailers, too

Of course, you're aware that this is an intended consequence; right?!
This gives the anti-gunner politicians plausible deniability that their actions directly limit/prohibit the exercise of the 2nd - their end goal. And, if they can add to the government coffers while doing so, all the better in their eyes.
Yup, I read the law, and read the list of BS that DID start on 1 January, which does not include this nonsense, just asking and curious if any other shops are this ill informed. We are all aware of the intended consequences regardless of their lies...
The ffl is not in the Denver metro area.

Anyone selling into Colorado now already has to collect State, County and city sales tax and pay it to the appropriate office.
The worst part is the county and city sales tax as you have to track down where to send it, and in some cases pay for a sales tax license.
It is bad enough on the collection logistics, the legislature should have made a central place to pay it to for all the local taxes.

Absolutely agree - If the Legislature is so business friendly, it is time to run a bill for centralized tax collection without interfering with Home Rule cities taxing authority.
It can not be as complicated as a lot of the other legislation they pass.

Yeah, I collect tax in multiple jurisdictions, it?s a serious pain in the ass and now have to pay my accountant to deal with it, I agree that they should have forced every jurisdiction to go through a single collection portal. Don?t forget the $.29 delivery fees just to add insult to injury.
That said, any retailer that sells in to Colorado that does not have a physical presence in the state does not need to collect sales tax if they sell less than $100k worth of product in to the state in a year.

Why is Colorado charging a retail delivery fee?
The Colorado Legislature enacted the retail delivery fee in 2021 to fund transportation. Revenue from the fee goes to the Highway Users Tax Fund, the Multimodal Transportation and Mitigation Options Fund, and five enterprises: Bridge and Tunnel Enterprise.
And, don't you find the Highways, the transportation choices and ability, and the bridges and tunnels in better shape?
As a Rocky Mountain News columnist said back in the 70's - No Man, nor his dog, is safe when the Legislature is in Session.

t was never the legislature's intent to make it easy for firearms related businesses, actually I think the point is to make it so difficult they stop selling here. So if a guy buys a gun on Gunbroker does the seller tack one the 6.5% after April 1? Does the transferring ffl in Colorado collect it? Is the seller supposed to know whether or not he is going to sell more that $100k worth of stuff to Colorado residents in a year?
Not too long ago A guy in California was going to buy an FAL kit with receiver from me, and ended up backing out because he claimed to not be able to find a dealer to transfer the receiver to him because they couldn't determine what to charge him for tax. BS? I don't know, the guy seemed a little flaky and maybe got cold feet.

The receiving ffl didn't make the sale so they aren't on the hook for collecting any tax. Guy had could feet.
