So I really hate my job and I want to quit.

Here are the questions....


If I give two weeks notice, then they walk me out the next day, do they have to pay me for the two weeks?

Is it true you can't draw unemployment if you quit or get fired?

very simple

I do not believe they have to pay the two weeks.
I believe there is no unimployment if you quit.

You can't get unemployment for quiting or being fired. Sometimes they'll let you 'resign in lieu of termination' and then not contest when you apply for unemployment, but that doesn't sound like your situation.

They are only required to pay you for the time you are on site.
You can't collect unemployment if you quit. I learned this the hard way when I quit my job after being assaulted by a customer and deciding it wasnt worth the trouble to stay.

they're always hiring too, that's part of the reason why it's such a crappy job. you get treated like dirt because they know there's a line of people outside willing to take your place.

What's your exit strategy? I've had a couple jobs I would have left sooner, but having a wife and kid gave me the stamina to stick it out until I found something better.

I always dreamed of quitting in a big way but never had the balls to do it.

If you are laid off or fired, you can file for unemployment. If you are fired for cause, the employer can contest your claim. Quitting would make you ineligible, unless you can prove an unsafe or hostile work environment (tough to do).

but if they decide you must go now, they must pay you anything owed; last paycheck, vacation time etc... right there on the spot. So hang around in the lobby until you're paid...

Another question- I'm in a situation where my company is eliminating my dept. and outsourcing. If the new company gives us an offer we don't want to accept and decline it can we collect unemployment ? Or is that considered quitting ? Thanks.

I'm no expert but if you've been offered a position by company B while laid off from company A the fact that company A laid you off still stands. You may want to talk to somebody who has some hard facts on the matter as these are bad times to be unemployed. In fact you may be better off by taking the offer and while trying to find something else while you're there.

if an offer is tendered even at a lower salary. no bene's for you. a job was offered and you turned it down. thats what's happening here at my state job. which it looks like i'm about to be bumped by a seniority member. 6-12 months of unemployemt here i come. PLUS the state will have to retrain me.
you quit, you are not owed anything for the 2 weeks notice. thats like trying to collect for sick days you have't taken.
w/out any form of documentation to show a hostile work enviroment, there's no basis for unemployment bene's.

I'm not being laid off-my company has decided to eliminate my department and out source the department to an outside company.We are currently waiting on the new company to either offer us a position or not to make an offer to us. If they don't give us an offer I'm eligible for unemployment. If I accept an offer I remain working.BUT what happens if they give me an offer and I decide not to accept it ? Am I eligible in that scenario to collect ? I'm weighing all my options at this point because we've been waiting all month to see what this company is going to do about us. I'm just wondering if anybody on the forum has been in a similar situation.Sorry if I highjacked this thread.

you've been offered employment. turn it down and according to UnEmp stipulation, if offered a job and you do not accept, you lose or forefit your bennies.
