I live in Arapahoe County and was wondering if I even had a chance of the Sheriff signing off on my CCW application. I have two minor in possession of alcohol tickets when I was a kid and a possession of marijuana when I was 18. They are all misdemeanors but I have heard it's hard to get one out here in the first place.

You've heard wrong. This is a SHALL issue state. If you can legally get a CCW, they MUST give it to you. Try giving them a call and asking them directly.

I'm not sure about your other stuff. I would assume that they don't matter as the first two are only tickets with no chance of jail time. What was the maximum jail sentence for the possession of marijuana?

I think there are some issues with 2 Alcohol related offenses. I think 2 is the limit from what I remember, but I had 1 and got mine.

Does it count if they were both when he was a minor though?

From what I know it was in a county (Denver) where it is the lowest level mis. or even a petty crime, all I had to do was pay a $400 fine.

I have passed many a background check to obtain weapons from dealers is it the same criteria? Because if so I would be in the clear.

It's not the same as a background check, they can disqualify you for less than what it takes to pass that. I'm not sure what effect being a minor has on that, but they might be off your record now if you were a minor, but I'm not a lawyer.

You might have to go and get your minor record expunged or whatever. I have a friend that put himself through POST training and he had to do that.

I don't know about the "shall issue state" comment, they don't HAVE to give you a CCW, you can be denied.

I've had two freinds get denied, one for a mental health issue, he spent 1 year in a mental health facility and thats why he thinks he was denied but he was not given a specific reason they just told him, he does not meet the minimum standards for Denver County.

The other friend was denied because if misd. assault but thats a no brainer, he knew he would get denied he just thought he'd try anyway because it was over 10 years ago.

However, I had similar charges on my record and I got one. You should be fine but mine were all over 10 years ago so I don't know if that makes a difference.

The only reason I mention 10 years is because I used to do background investigations for a major corporation, typically courts will not report back farther than 10 years. Its cost prohibitive and most sherrifs offices are under a strict budget. CBI might be different and go back farther than 10 years, I never really dealt with them but you do have to get a CBI check for your CCW.

Well of course they got denied, they didn't meet the requirements. If you meet the requirements, they have to give you one.

Before, the sheriff had the power to deny based on his suspicion of you, but just recently a case was won in court and now the sheriff has to bring tangible evidence to show why you shouldn't get one. No more of that "the guy just rubs me the wrong way" bs.

Yep if you get it expunged it no longer exists, but you can also get them sealed if they wont let you expunge them. I'm not sure if that would help, I'm sure CBI would still know about it.

Boulder County doesn't even wait for the prints to come back, they just give you a card if you make it that far.

This is not entirely true. You have to go through a whole big process to get records expunged and it has to be approved before a judge. Even if it gets approved if the county clerk is a ding bat, which trust me most are, it will sometimes still show up.

When I did backgrounds I saw plenty show up, even sealed records show up, not because they aren't supposed to be expunged but because of a clerical error. That was a whole pain in the ass itself because we'd hire then fire people that were convicted of fraud only to find out we couldn't deny them employment because it was expunged and have to hire them back. And these people had access to peoples banking information. Great system we have here in the US for fair employment I tell ya.

FBI will still show expunged records, don't know about CBI.

The marijuana charge is only 3 yrs. old, the CBI already has my prints because some asshat decided to commit a felony with my name [BooHoo] so I guess I'll just call the sheriffs office and ask, can't hurt right?

That is going to cause you a lot of problems down the road. You need to get documentation from the courts together about that and keep them somewhere safe for future use. Trust me!

You can still carry on your person while your in your car or home. Or owned business, if you happen to be a business owner.

I used to do it some times... usually by forgetting i had it, if it's concealed good and you don't do anything to get caught you probably never will.

Yeah, it usually takes some drunks at a house party taking your passed out girlfriend out of the bathroom, then calling the cops and telling them you have a gun. ;)

Yeah it's already caused all kinds of BS but I think I have everything I need as far as paperwork and I check my credit report every month or so just to make sure he hasn't ventured into taking out mortgages or car loans in my name.
