The nine bills signed into law Wednesday will:

HB 1189, eliminate a sales-tax exemption on direct-mail materials.

HB 1190, suspend a sales-tax exemption on energy used in the industrial process.

HB 1191, eliminate the sales-tax exemption on candy and soda.

HB 1192, repeal a sales-tax regulation that imposed a sales-tax exemption on downloaded software.

HB 1193, attempt to collect sales tax on out-of-state online retail sales in the same way online sales made by retailers with physical locations in Colorado are subject to sales tax.

HB 1194, eliminate a sales-tax exemption on "nonessential" food items purchased by restaurants, such as paper napkins, plastic forks and cardboard containers.

HB 1195, suspend a sales-tax exemption on agricultural compounds such as pesticides and bull semen.

HB 1196, limit an income-tax credit for alternative-fuel vehicles.

HB 1199, temporarily limit the amount of net operating losses companies can carry forward on their taxes.

I highly doubt they will be able to collect the out of state internet sales tax. that means all the retailers will have to start adding another section to their websites, collect the CO state tax, pay the CO state tax when they do not operate in CO. Gonna be extremely tough to do...

I am also amused by the reduction of the income tax credit for alternative fuel vehicles...here is Obama pushing and pushing to get alternative fuel vehicles out there and now the lure to do so is being destroyed by Ritter.

someone should forward it to Obama and tell him the .gov here is killing his chances of reducing baby killing emissions.

From what I understand, right now, if you buy something from out of state, you're already supposed to fill out the tax form and turn it into the state. People already don't do that, I've never even HEARD of doing that, so I can't imagine the online sales tax will get much more attention.

The Colorado Legislative Assembly is discussing a bill that has negative implications for manufacturing companies. Currently manufacturing and industrial companies in Colorado are exempt from paying sales tax on electricity and gas costs. House Bill HB-1190 would eliminate that tax exemption and charge these companies sales tax on both electricity and gas purchases. U.S. based manufacturing companies have been struggling for years to remain competitive in a global marketplace. HB-1190 would effectively create a new tax on Colorado companies and manufacturing sites and thereby make them less competitive. So while it has the potential to increase $48 million in new revenue for the State, HB-1190 is a short-sighted approach that will have the long-term effect of reducing manufacturing jobs in Colorado.
It should be noted that this is one of many bills currently under review that would increase operating costs for businesses. XXXXX has budgeted $12.1 million for electricity and fuel costs in 2010.
The 2.9% sales tax (state portion) on this amount comes to almost $350,000 per year. This increased sales tax expenditure will reduce the competitive advantage that XXXXX currently
has compared to Asian foundries. It is also possible that the City, County and PPRTA would follow the state which would increase the tax to 7.4% and $850,000 per year.


We are competing with companies that manufacture products overseas, and right now - we are competitive.
Force my company to pay $350,000 (up to a possible $850,000) dollars in additional taxes and well - I just might be OUT of a job very soon.
They'll shut this plant down in a heartbeat if costs go up that much.

to add a provision appropriating $94,322 General Fund and 0.9 FTE to the Department of Revenue for FY 2009-10 for implementation of this bill.

Representative Gardner's input is that the only Colorado Springs Representatives in favor of this bill were Dennis Apuan (District 17, which is SE Colorado Springs and Ft Carson)
and Michael Merrifield (District 18, which is downtown Colorado Springs, Old Colorado City and Manitou). All of the other Representatives were opposed to the HB-1190

I really do. Not just Democrats. If Republicans were really all that much better, the first few years of the 21st century would have been a utopia. They're just two sides of the same coin. And that's a problem, 'cause if we don't vote anymore it doesn't get any better. The system needs to be moved back closer to what it was supposed to be, with people who are NOT career politicians elected to serve a term or two and then go back to their lives. Career politicians shouldn't be allowed. This is going to sound wrong, but we need people who don't WANT to be politicians. People who will go back to their lives when they're done, who don't get caught up in the machine and turn into the problem we have now. Being a politician should be more like military service, without the career option. You get elected, you go to Washington (or Denver, or whatever) and you serve your term, you try to make things better because when you get done you'll be going back to what you did before, so you're going to have to work within what you may have done while in office.

Problem is, lawyers/judges/politicians own the system lock, stock, and barrel with the assistance of big bankers.

There ought to be a bounty on politicians and bankers.....
