So, I was outside because of my neighbor kids and their loud noises tonight doing the Neighborhood Watch thing. I only took my ASP [expandable baton] a Root Beer (in a bottle -unopened), and my 2-CR123 cell flashlight. I have a corner lot so I'll stand on the corner and keep an eye on things.

Apparently, one of the cars that went by (so they say) called the cops on me - claiming I was carrying (I guess in my hand) a gun. I had 3 patrol cars pull up, got searched, rad the riot act, chastized for carrying my ASP, threatened about carrying my gun (which I have on occasion, but NOT tonight!!), and had a NCIC check performed.

One of the responding cops is the one who showed up a week and a half ago when th evandals were out. She kept fairly quiet. The other two were hostile and threatened me repeatedly. I reminded them that I do have a right to Open Carry in CO - although I wasn't doing it tonight! I also informed them that I'm aware of what brandishing a weapon is.

They informed me that having my ASP, un-expanded, while standing in my own yard could be considered "threatening" and I could (will be if they are called again) be charged with FELONY MENACING.

The primary cop on the scene did his damnedest to provoke and escalate. Even though I clearly informed hi mthat I haven't carried a firearm for well over a week, he came out at the end and flat out called me a liar and claimed I must have run inside and put my gun up before they arrived (yeah, like I had any idea they were coming!).

Where the hell were they when my neighbors kids were gunning their truck engines(repeatedly, multiple times a day)? Where were they when these kids rolled up with their bass boxes pounding away at all hours of the day and night (repeatedly, multiple times a day)? Where were they when my next door neighbor had his truck (parked right in front of mine) vandalized 2 weeks ago? etc. etc.

Heaven forbid I should remain in my own yard and keep an eye on my home and vehicles. Heaven forbid I should consider excercising my rights to Open Carry a firearm in a two-point secured holster on my thigh - not touching it - IN MY OWN YARD?!.

I've had enough of this SH!T.

I'm going to have an OC party in my front yard VERY soon. EVERYONE IS INVITED!

You might consider going in and having a chat with the chief of police to see what he thinks. Maybe the guy you dealt with is a jerk that they know about and need info on.

Maybe set up a camera up so you have a record of what happens.

On the other hand you can always talk to the kids. They will understand if you would just reach out to them. Oh – and next time kneel in the presence of the cops. (He said jokingly) [ROFL2]

Simple.

Play the game. Call the cops (if you have the butt head officer's name request him) on the kids making noise. Of course ask them to stop first. Then you can say you think they have weapons when you call for the cops.

Keep a log of your calls and if they respond.

Bottom line, start having fun with it and jack with them. Get your neighbors in on it if you can.

Oh, video the conversations with the cops if you can.

Only the female cop was decent in her demeanor towards me. The third cop kept walking around behind me and spouting out little one line comments about how I was provoking a confrontation by being outside in the first place.

That is what I decided to do. This way, if I am arrested and charged with felony menacing, I can show the video of me just standing in my yard (and maybe, heavin forbid, walking around my yard too) without waving anything at anyone and NOT possessing a firearm and see how far that goes in court.

Now I just have to find a system that I can afford.

Keep in mind that I live "in town" and in a sub-division. My "land" is all of 6000 sq ft, and (actually), the police never left the street or public sidewalk. They had ME step into the street with them.

But, yeah, I agree with where you all are going with this.

You know, I understand that they've got a tough job and need to proceed with caution to a supposed firearms call. I also think that, once I showed them I wasn't carrying a firearm, wasn't intoxicated, wasn't aggressive, etc., that they could have changed their demeanor. They could have considered the possibility that I wasn't a threat to ANYONE nad perhaps the call was bogus!

Here's a question. If OC is legal in CO, but OCing a firearm secured in a holster is "felony menacing" if ANY decides that they feel threatened by it, how is it really legal?

They can tell me all they want that simply carrying an expandable baton (in it's CLOSED position) or a holstered firearm without any sort of brandishing is "menacing", "confrontational", "intimidating", "threatening" or "initiating aggression", but I will ensure I have the means to defend myself from potential assault. If the simple possession of a force equalizer is wrong, then we have fallen farther than I realized!

Great ideas about video-taping future events. I'd be slow to let them know you're taping them; let them write down everything and finalize their reports, and then compare the video to the report. Perjury's a bitch.

We could have a nice big gun-cleaning party! A couple long tables, covered with weaponry in various states of disassembly (seems tough to be charged with menacing if all you have are pieces), some brisket and chicken with OC sauce available? Sounds great!

Their threats are idle in my opinion. They can threaten to charge you with whatever they want, but it doesn't mean it won't get thrown out in court. I'd like to go to an open carry party.

He is right... ass*oles wear all kinds of uniforms. You only have to come across one.
Maybe he was just having a bad day... or maybe not.

Remember: If you are OC or CC you will be held to a higher standard - you must try twice as hard to de-escalate the situation in a civilian encounter.
I would definetly consider reporting this up the chain of command, as you were within your rights a a citizen (in my opinion) and having the local patrol officer hassle you is not what I would consider good community interaction.
Perhaps an informative telephone call to CSPD - stating something like - "Hey, I had some interaction with an officer that made me feel intimidated and just wanted to let you know - what is the proceedure to follow in this instance?"

The initial implication was that I had a gun IN HAND, but wasn't clearly stated. They did clearly tell me that OCing IN HOLSTER (even in my own yard!) could bring a menacing charge - if someone "felt threatened" by it.

Yes, I've had the cops out there before - as the caller. In fact, the female officer that was there last night was out on Mar 4 responding to MY call about vandals in the neighborhood (damaged my next-door neighbors truck and a neighbors car down the block - I watched it occur). They have NOT been called out because of me as the trouble-maker!

I try to keep a watch on things in the neighborhood - especially over my yard and my vehicles. I have called the police (non-emergency #) on a few occassions, but ONLY when there is an immediate situation that they need to respond to. If it's a potential situation, I won't call (they really get too many calls as it is). If it's a situation that has already occured, I'll call to make a statement.

I don't go and confront anyone. I don't threaten - directly or indirectly -anyone. I just watch.

Ugh ... don't get me started on CSPD.

If you have to deal with law enforcement in The Springs, pray to GOD its a Sheriff's deputy that shows up, not a CSPD clown (there are a few good guys on the force here, but for the most part I'm not impressed with the professionalism of the department in general ... not sure if I can find a copy of the story online about the "rampaging buffalo" but its indicative of the department).

In searching I found a couple of forum threads that refered to the shooting and linked a story on The Denver channel (that is now dead).

120 rounds fired and ZERO of the buffalo were actually killed by CSPD (the guy from the packing company showed up with a lever gun in 30-30 and killed each of the buffalo with a single shot). Sometime I think that cops act like high school kids. They follow behind whoever is being the biggest dick of the day.

If all the officers are calm and being cool the rest usually follow suit. If one is being a a**hole, the others will often be that way, or just do nothing and let the officer who is being a jerk lead the way.

I have never seen a police officer call out another officer even when they know they are out of line. They will usually just clam up and roll their eyes at him/her.

Sorry that happened to you Ginsue. Sounds like a bogus deal to me.

In my opinion, the cops tend to feel threatened by anyone who makes a stand for the safety of his own neighborhood. They automatically think "vigilante".

A friend of mine was in a very similar situation about a year ago. He actually was charged with felony menacing. His actions went a bit further than yours, but still.....

I'm not generally anti cop, I really do have a lot of respect for them, but sometimes I have to wonder about the lack of common sense they sometimes show in these situations.

I remember being at a house party when a fight broke out and the cops were called. One of the officers lined some of us up, including me, and as he questioned us, he would point the muzzle of his firearm with his laser on at the persons chest. I interrupted him and asked if that was necessary, and he quickly turned to me with the firearm poined at my chest and told me to shut the f*ck up. I never did anything afterwards and wish I would have. Cops like this can just kiss my A$$!!

Sorry for detouring off the main topic but it made me remember this story.

That may be, but the bigger problem here is the culture at CSPD. Its one of paternalism and incompetence ... a lovely mix.

El Paso County Sheriff's Department just has a more professional culture and better leadership so officers with a God complex get put in their place (and often molded into good peace officers).

I would hope they did not, and I wouldn't suggest it be the object of any organized OC gathering.

SO my 0.02¢ -
It sounds as if there is a neighborhood thing going on and I will volunteer to attend and show support to our fellow boardmember.
Not to openly confront CSPD or anyone else on the moral, legal or ethicial questions of OC.
I would attend a friendly BBQ and open carry - until I decided to have a few beers -then I'd have to trunk the firearm and try to enjoy myself and others company.
I do not OC (or carry anything for that matter) for confrontation or coercion or to intimidate.
I do not believe we are an "ends justify the means" bunch here.

Ginsue, sorry to hear of your troubles with CSPD. Sounds as if they are long on LEO and short on Peace Officers. Such behavior should not be tolerated. A short meeting with a commander to make known your concerns about the nieghborhood and how the representatives of the PD handle themselves might not be a bad idea. Done very tactfully as a good citizen of coarse. These days the LEO's seem to only be interested in making sure you understand thier position above you, the citizen. More Peace Officers are needed.

The BBQ idea is a good one. Also invite nieghbors who have issues with slimeballs who have created the strife in your nieghboehood.

Encourage nieghbors to open carry in the nieghborhood and soon it will be known that you folks are responsible law abiding citizens who are not to be trifled with.

I've really been dwelling on this all day. Picking everything apart as bestI can. I honestly believe that if the female officer (she is a trainer for CSPD) had not been there, I would have been dropped to the ground and cuffed.

The behavior of the two male officers was out of line. They were doing everything they could to provoke me into doing something that they could construe as illegal.

When I played cop for the Air Force, I was taught to de-escalate and, while being firm, not provoke aggression. These are a couple of things these cops need to learn. The one thing I kept getting from the two male officers is that they were trying to intimidate me and make me feel afraid of them.

I've always been willing to cooperate with the authorities. That ended last night. For now on it will be "I don't wish to make a statement without representation. Am I free to go?"

Thanks for the input - it is well received and appreciated. I intend to try to get an audience with a commander and, if need be, write to or speak in person with the Chief (I doubt I'll be allowed to do that).

Gloria made me close my eyes and shoved it in my mouth. I knew it was something covered in chocolate. At first I thought it was a chocolate covered cricket or something because it was so crunchy. One of the guys at her work had a bacon party where everyone had to bring something made with bacon, so someone brought chocolate covered bacon. Once you know what it is, it tastes exactly like bacon with chocolate on it.
