View Full Version : I have a strange request for a Colorado FFL

I tried to purchase a hand gun 6 years ago and was denied due to a background check. I was arrested once for a misdemeanor and served probation. That purchase was right after being released from probation, and I believe the system had not been updated yet. Since then, I have re enlisted in the Army, received a security clearance from the Army, spent 4 tours in Iraq. And I am currently still on active duty. The question has now come up as to weather or not I would pass. I am looking for an FFL that can do a background check just to see if I pass or not. I am not currently interested in making a purchase. I am just curious to see how it comes back.

go to this link. pay about 6 bucks and it will do a background check for you. if you pass this, you can buy. i know from experience.

i also called and talked to an agent at cbi. he said the same thing. i cant guarantee anything. but it worked for me.

domestic violence, violent crime

but, here is the misdeamenor thing

if the crime carries less than 1 year in jail it is, to the best of my knowledge, not going to prohibit you from owning, buying. if you get turned down again. take the rejection letter to the CBI or mail, call whatever, and get it worked out.

Misdemeanor 1-2-3.?. A misdemeanor 1 will give you problems. If you get denied again you can appeal through CBI.[Luck]

You should be good according to that, also if you were not able to purchase a firearm it should have prevented your enlistment. So you should be good.

Or at the very least, it should have stopped my security clearance LOL. I listed it on my SF86. And never had any issues.

I hate to derail the thread but I just got my report thing from CBI and it lists my dad's date of birth as mine, he's forty years older than I am...Should I get that fixed?

I think I would probably get that fixed. I just came back from an FFL down the street from my house. I filled out the form and he put it in the system. It came back with a response of DELAYED. He said he has never seen that before, it usually is approved or denied. He looked it up and it says that they have 3 days to approve or deny it. I wonder if it came back delayed because I have a military security clearance (which means I have an FBI file number). I know it wasnt because I have a warrant or anything like that.

Something requires looking at. Like said if they deny it, challenge it to see what it is. But the stuff you have spoken of shouldnt cause a denial. My dad got denied because of a traffic wreck from when he was like 17. When they went to the PC system it was put in wrong, he challenged it and they had to clear it.

Well, after some internet surfing, it seems that a lot of people with a DOD security clearance get a delay response. They say that an FBI file number is created when they are doing the sc back ground check and causes a flag to be seen by the NICS operator who cant tell what the flag is for. So it has to be forwarded up to a supervisor. Sometimes the approval takes a couple minutes, other times it takes 3 days. So I guess I get to just wait and see.

I can tell you as a former military security manager and first-hand (I carry an active clearance too) that your having a military clearance should not effect your ability to get approved at all.

The only time it's taken me any time at all to get an approval has been in the height of purchases a year ago when ALL checks were taking MANY hours to a day.

I thought I would post an update to this. I went to an FFL on Wed the 12th, and he ran me through the NICS system. It came back with a Delayed response. I checked with the FFL dealer today (the 17th), and it still says delayed. Anybody else had a delayed response that lasted this long?

tell you dealer to call the CBI and find out what the deal is.
You might have to make sure your record is expunged of your prior offense which might cause the denial. just depends on how the court handled it and if they cleared your record right away and correctly.
I don't have personal experience with this but have seen many people go through the same issues, and although arduous, it is the right thing to do to make sure you are cleared and GTG.

I called the FFL, he said that he spoke with the NICS people today and they stated that they were waiting for some information from the FBI before they either change it to proceed or indef delay. Since I have never been charged with a felony, I am assuming its because I have an FBI file number due to my DOD security clearance. I have never heard of indef delay, and neither had the FFL.

below is a copy and paste of the delayed response from the fbi website, the way I read it is after 3 days of no answer, the ffl can go ahead with the transfer if they choose so.
After a search of available records, the checking agency
responds with a notice to the licensee that the transfer may
proceed, may not proceed, or is delayed pending further
review of the applicant's record. If further review of a
record indicates the transfer would not violate Federal or
State law, the checking agency notifies the licensee that
the transfer may proceed. If the licensee does not receive a
response within 3 business days, the transfer may proceed at
the licensee's discretion

Yeah, but I was looking for a definitive proceed or deny (so I could get that fixed if it comes back that way). As of right now I don't want to spend the money for a CCW if I cant pass a background check. So I guess I have to either wait for an unknown amount of time, or spend the 150 bucks on the CCW (not including the CCW class) and risk wasting the money for nothing.

FYI Before any one can be a Officer in the Military They have to be able to qualify for Secret clearance or higher
