I looked over my notes from class but I cant find the answer.
If you are carrying concealed and you print or it is briefly exposed and someone notices and calls to cops, what happens if the police approach you saying we hear you may have a gun?
You say yes and show your permit, I got that, but can they issue a warning or fine of some sort? What would they normaly do?

Not to be taken as legal advice.
This post is worth exactly what you paid for it.....

It would depend on the circumstances and the officer that responds to the call. It would be completely under the discretion of the officer.

A "peace officer" understands that life happens, and would probably just tell you to be more careful. Then there are strict LEOs that feel that they HAVE TO do "something" every time they go on a call. Be it arrest you, or issue a citation.

Under Colorado law,

18-9-106. Disorderly conduct.

(1) A person commits disorderly conduct if he or she intentionally, knowingly, or recklessly:

(f) Not being a peace officer, displays a deadly weapon, displays any article used or fashioned in a manner to cause a person to reasonably believe that the article is a deadly weapon, or represents verbally or otherwise that he or she is armed with a deadly weapon in a public place in a manner calculated to alarm.

(3-c)

An offense under paragraph (e) or (f) of subsection (1) of this section is a class 2 misdemeanor.

Did the display "alarm" anyone?
Probably, since they called the police.

Did you "calculated to alarm" probably not.
But you know how "some" people can be.
It would be a discretionary judgment call made by the responding officer.

Will you be charged? Who knows?

There is also the possibility of being charged with "Disturbing the Peace" or "Reckless Endangerment" or even "Felony Menacing" that could be levied. Depends on the circumstances, and if the police officer is a prick.

Clear as mud, huh? [Tooth]

The police can do whatever the hell they want, but that doesn't mean that they will. I'd pretty much never worry about printing. For most people to take notice, they would have to actually see the gun itself. I've only been carrying for just over two years though, and no one has ever said anything.

I agree. A cop can sight you a ticket but doesn't mean he will. Just be respectful and follow what your told like if the cop says to leave the store you leave or if someone sees you carrying in a store where you legally can and asks you to leave then leave or the cop could give you a ticket for menacing. It's just like open carry is legal but walk down the street and see how far you get.

Wives, friends, etc are great for giving you feedback on your concealed ability. When you're out with them shopping or whatever, have them look now and then to see what they see... I've got a friend who always helps determine if it's working well or not.

I always make sure I don't have a huge hip bulge before I go out. I adjust my Glock 27 accordingly to what Im wearing. Being Summer and all it gets a little tricky. Winter and fall is a bit easier with coats and all.
I picked up a 5.11 Tactical shirt that is designed for CC and it works great and looks great to!!! Went to get another today at Sportmens Warehouse but they sold out in my size.
Never had any issues so far.
Just use common sense, situational awareness and avoid hippie hotspots!!!!

You will trust me to cut them up.......right?

Please include any mags and ammo when dropping them off.

a buddy was washing his car when his glock exposed briefly, someone saw it and called the cops. They showed up, walked up casually and asked if he was armed. He replied yes, disclosed that he was licensed to carrry and where the firearm was. They disarmed him, ran his info, BS'ed for a bit (made fun of him for his cheap CCW holster) and let him go on his way.

IMHO they are just doing their job. If they don't see your hands i'm sure they will be more cautious and alarmed. Dont be stupid.

As for the "what if..." question, it all depends on how you get approached but I would anticipate the possibility of being temporarily disarmed while LEO checks your permit and info. Just like a traffic stop, be compliant and polite and allow the officer to do his or her job and while it will certainly be inconvenient I cannot imagine a ticket coming from it unless you're really going out of your way to make it known you're carrying a gun.

The key in avoiding this comes from adjusting your lifestyle so you DON'T put yourself in this position. At first, you're going to think EVERYONE sees it... then you'll realize that, as long as you're properly concealed and not inadvertently showing it off, you'll be OK.

Mas Ayoob's book on CCW (good read, especially for "new" CCW permit holders but great for all of us) speaks briefly about "flashers" and his thoughts are pretty clear -- he and his brothers and sisters in the LEO community don't care too much for those who just barely conceal or do a poor job of hiding their handguns. In his words: "Concealed MEANS concealed."

Not trying to sound preachy or jack the thread, but it's important to maintain an elevated level of awareness, and that includes how you've chosen to conceal your firearm.

If I run into you on the street I'll be sure to use the secret handshake before letting you know if you're printing [Muaha]

Cheers, and happy carrying!

SonOfTheGriz,

What is the name of Massad Ayoob's book of which you speak? I have seen a few of his videos and I am a regular reader of his blog. Would love to read his book. Thanks in advance!

Considering that CO is an open carry state I wouldn't worry too much about it. You think you're printing way more than you really do. If you're new to CCW you probably think everybody is staring at your gun...they're not. That feeling goes away after a month or two. I've walked into stores OCing (wal-mart, gas station whatever) and nobody even bats an eye let alone stares at the thing. Sheeple don't notice bulges in shirts...unless those bulges are on the ladies.

Since Colorado doesn't have any specific regulations (that I have ever seen) that specifiy the manner in which a handgun must be concealed, printing is a non-issue. Some other states have more restrictive laws where printing can cause trouble. I agree with OgenRwot. I too OC everywhere (outside of Denver) and no one bats an eye. If you're printing or even if the weapon becomes fully visible while bending over or something, it's not illegal (again: outside of Denver). Until you start fiddling around with it, or get into a situation where you are somehow threatening someone, you're good. Worst case: an ignorant cop arrests you, you keep your mouth shut, get a lawyer, and cash in later.

a few of the metro area municipalities have open carry restrictions

State pre-emption nullifies those restrictions with the exception of Denver under the Meyers decision. Certain specific areas can be prohibited by posting signage at every public entrance, but there are few places (such as Jefferson County Open Space parks) that are properly posted. While I'll admit that since I've only been living in Colorado a year and haven't been everywhere, I can't speak from direct in-person knowledge of the entire state. That said, I have personally OC'd throughout the entire southern end of the metro area on a daily basis, as well as mutiple other areas with somewhat less frequency. I have encountered LEOs from Parker, Lakewood, Centennial, Aurora, Adams Co., Arapahoe Co. and a few other jurisdictions, and have had only positive encounters. In fact, the only place that I have had any sort of (minor) reaction was in a PetSmart on Parker Rd.

Taking this back to the original topic then, there is really no worry about printing or accidentally displaying a legally concealed handgun outside of Denver, since OC is almost certainly permitted anywhere one would be able to CC.
