Colorado Springs Police Say Woman Shot While Entering Apartment Of Ex

COLORADO SPRINGS, Colo. -- Colorado Springs Police say a woman who was shot and killed Saturday morning fired shots into the lock of the door at her ex boyfriend.

It happened at 2555 Paragon Drive in Colorado Springs.

Colorado Springs Police investigators have identified the victim as 46-year old Cristen Ann Cox of Colorado Springs. Police say the investigation revealed Cox fired a handgun into the lock of the door of her former boyfriend's apartment. According to police she then entered the apartment with the gun in her hand and the resident shot her one time. Police say Cox and the man had been involved in a previous relationship.

The man who shot Cox and an adult woman were both in the apartment. Neither has been identified by police.

Neither has been arrested and information regarding the investigation will be turned over to the district attorney's office, which will determine if any charges will be filed.

Police say an autopsy revealed Cox died of a single gunshot wound to the torso. Her death was ruled a homicide, however police point out that a homicide is not necessarily a crime.


Sounds like clear case of self defense...

I know that you were just pointing out the body of the 10 ton elephant we're all walking around, but it sounds like the woman who got shot got exactly what she came looking for. My take is that she had planned to do harm (i.e. KILL) her ex-boyfriend and would have more than likely killed the other woman as well.

If you go looking for trouble, you can usually find it.

As Will Smith's character in Men In Black said: "Don't start nothing and there won't be nothing."

Yes, I'm saddened than a human life had to be lost, but having someone willing to initiate a violent confrontation - with a firearm - walking free on the streets doesn't give me a warm fuzzy. The fact that she died is, sadly, probably for the best for our entire community.

Are both of the women dead? Or are they talking about arresting the shooter and referring to him as Mr. Neither? Poorly worded story I'm thinking. Or am I just missing something?

Haha, I think Ginsue has it right. I believe that the ex-girlfriend broke into the apartment, and was shot by the ex-boyfried. It sounds like the ex-boyfriend had a female guest of his own in the apartment.

Cristen Ann Cox, 46, was killed at the Windtree Apartments on Paragon Drive at about 1 a.m. Saturday. Police said Cox showed up at her ex-boyfriend's apartment with a gun, then fired several shots at the lock on the door. They said Cox entered the apartment and then was shot by her ex-boyfriend, who was there with a woman.

Police said Cox died at the apartment from a gunshot wound to her torso.

Police have made no arrest, and said that the man and woman at the apartment have been cooperative with the investigation. CSPD will hand the case over to the district attorney's office for a final decision on whether criminal charges will be filed.

"Generally, we can make a fairly quick decision," said Dan May, Fourth Judicial District Attorney.

May can't comment yet on the case, but we talked to him about the state's Make My Day law.

"If someone breaks into your home and you think they're going to use any violence at all, you're allowed to defend yourself in any way you think appropriate, including deadly force," said May.

The law gives people much greater self-defense protections when they're at home.

"With the general self-defense law, you actually have to believe, 'They're about to kill me,' and you have to use the amount of force that's appropriate for the situation," explains May. "With Make My Day, you just have to believe, 'They're about to attack me,' is one difference. And the other is, you can use any amount of force you want."

May said the Make My Day law could still apply if an intruder doesn't fully enter a home.

"Even if you've just broken a screen door, you have broken into the home under Make My Day," said May

No question: She was obviously a threat, based on reckless indifference in shooting the lock(knowing there were people on the other side of the door). It sucks that someone had to die, but at least it was the aggressor.

Hell, in some agencies it takes that long just to write the report and get it approved, let alone forward a case file to the D.A.'s office. Given its their 22nd known homicide and unknown how many unattended deaths they handle as homicides, the D.A. will be lucky to get the case file by the end of the month.

Months before shooting woman warned: 'watch your back'

A year before she was killed after shooting her way into his apartment, Cristen Ann Cox pointed an unloaded gun at her partner’s head, and pulled the trigger.
She told him she “just wanted to know what it felt like,” according to court documents.
Richard Lynn Cox, 43, was granted a permanent restraining order against Cristen Cox in January, after he claimed she also left him threatening voicemails.
Early Saturday, Cristen Cox, 46, shot through the lock of Richard Cox’s apartment at the Windtree Apartment Homes near Union Boulevard and Vickers Drive. Once inside, she was shot and killed by a man who police said lived there. Police have not released the name of the shooter. Another woman also was inside the apartment at the time.
The investigation is continuing and police said the district attorney will decide whether the man will face any charges. The Colorado statute commonly called the “Make My Day Law” protects people from criminal charge or civil suit if they use force — including deadly force — against someone invading their home.
In his motion for the permanent restraining order, Richard Cox wrote that Cristen Cox said in one voicemail, “A restraining order never stopped a bullet so you better watch your (expletive) back.” In the same message, she warned Richard Cox she was in his complex with a .357 Magnum in her pocket.
The address where the shooting occurred, apartment I of 2555 Paragon Drive, was listed as off limits to Cristen Cox, who was ordered to have only phone contact with Richard Cox.
Though Richard Cox listed Cristen Cox as his spouse in court documents, it is unclear whether the two were married. Cristen Cox legally changed her name from Cris Ann Elwell in 1994.
A Colorado courts search revealed no record of a divorce or legal separation involving the Coxes.
