+1...I almost gag every morning I wake up. I need a bucket by the bed.
So what's the big deal? She'll just have to schedule it and use her vacation time. Unless she has to do it right now and wants it paid for nothing. In which case its BS and the mandatory trip to mecca says nothing about having to do it during school hours.

She DID Ask for UNpaid leave. I can see the uproar if she was demanding to get paid leave.
It is a technical violation of the EEO act.
Letter of the law says they were supposed to let her do it .......... a nearly 50 year old law at that. has nothing to do with obama.
I think allowing "reasonable religious" exercise wouldn't include having to pay a substitute for 3+ weeks b/c she decided she'd rather worship a child rapist than work.
Would a scientologist be able to take off a few years and travel to Xenu?
She could do it over Christmas Vacation.

Don't they have to do the hajj ( or however its spelled) at a certain time ? That was my understanding.... not like you can just go whenever or what not .

I meant a certain time of year... and apparently it vary's since the time to go is based on lunar calendar and not the Gregorian one we use.
I personally would wanna do something like that while young rather then when in retirement.

well if thats the case then I have at least 3 causes for suit.
Unfortunately they can deny any leave except FEMLA.
If the unpaid leave would cause undue hardship, they can deny it (as I understand it) so long as it is NOT based on religious or ethnic reasons.
ie: Reason denied is, you are (whatever)
Can you imagine if everyone at the hospital took off for a religious holiday?
I kinda want her to win her case.
Imagine all of the service members, Civilians overseas not allowed to celebrate their religious holiday with their family.
There will be so many lawsuits, They will have to increase your taxes to more than your income.

The EEO act has no authority over the situation at hand. The School isn't discriminating against the woman because she's Muslim, they are discriminating against the fact that she wants to take time off, for an event that her religion participates in. It's no different than the fact that if I am a Christian, but scheduled to work Sunday's (when worship takes place), then I am expected to work Sundays, period.

Straight from the EEOC website. Seems to me that having to pay a substitute for 3 weeks, in order for this lady to take her trip, would cause more than a minimal burden on the operations of that employer's business, especially if that school/district is already hurting financially (which most of them are).

which means she was not getting paid. your telling a sub makes more then a teacher ? ... Some how I doubt it .
She asked for two years in a row ....... then quit... and now the lawsuit....

Hmm. Let me see, once they stopped calling it "Christmas" and started calling it "holiday", the federal government failed to reasonably accommodate MY religious practices.
Once all of the nativity scenes who ordered removed from "public" (as in yours and mine) property, they failed to reasonably accommodate MY religious practices.
Once the 10 Commandments were ordered removed from courtrooms, they failed to reasonably accommodate MY religious practices.
Oh, but I suppose it's okay to violate this law as it applies to/protects you if you're a Christian.

Ok you got me on the UNPAID LEAVE thing. It still doesn't change the fact that if a teacher being gone for nearly a month, places more than a minimal burden on the School, then they can deny her.

Teachers are told to keep vacations until the summer when you have several months off - she violates her contract and the government sues our own school anyway. This teacher tries to take almost a month off during the school year and the government sues the school b/c they won't let her.

That's not the muslims fault... it's the damn atheists ( which some would call ME .. I more just don't care .. do what ya wanna do when it comes to god and what not )

Also as for taking the summer to go .. well they are supposed to do the Hajj on the 12th day of the 12th month of the lunar calendar.......... sure she could go in the summer .. but that would be like having your family do christmas in march ........

That is not the part that bothers me.
Why is the USDOJ spending so much time suing and persecuting States, Cities and in this case a school district?
As far as this school case is this not the turf of the ACLU?

If I used the date converter correctly-
The Hajj ends on August 24 in 2018. I happens earlier every year. In 2020 it ends August 14.
Is it reasonable to ask her to wait that long to take it when school is out?
Does she really need 3 weeks? The actual Hajj dates are only 4 days long.
I also wonder if she could have transferred to a summer class or something that would have left her have the time off.

Requesting unpaid leave for religious reasons and being flat out denied is just wrong. First year being denied was fine, second year that is unreasonable. The school administration could have started planning after the first rejection to cover the unpaid time off.

My wife is a school teacher. It says right in her contract that she cannot take more than 2 days of personal time EVER. If she is out for more than 1 day from illness she needs to get a DR's note written to the principal of the school.
People have absolutely ZERO idea what goes into teaching a classroom, and a teacher leaving for 3 weeks fucks everything up. I just got married in April. ya wanna know why we chose April? it was spring break. We got married during spring break and took our honeymoon right when she got out for summer.
I say go screw yourself teacher as you new the job issues when you took it.

While there is a specific time of year for the major Hajj where millions of folks are all there at once, I believe you can actually go whenever you are able. Islam is very flexible in as many ways as it's extremists are not.

I beg to disagree with you Elhero. The Justice Dept. did do something about the three Black Panthers at the polling booth. But you probably never heard about it. Is it maybe because all the news information you recieve is from right wing radical media?

I disagree completely. I don't think it was a discrimination thing until the media got a hold of it and or her attorney figured this is a way to win this case and get public outcry. It doesn't matter what the reason for her wanting to take the time off is, 3 weeks is over and above what any school district would approve.
My wifes family is flying the whole family to Hawaii for 2 weeks in May 2011 for my mother in laws retirement party. Say My wife requested 4 days off to be able to go and it was denied because it was so close to the end of the school year with testing and closing things up for the year. Does that mean we should sue and claim we were discriminated against by the school district? No....it says in her contract she isnt allowed.

I'm with Boosted on this. I have public school teaching blah, blah, blah. I would like the judge to look over her contract before reaching a descision. In all fairness, the case would most likely be dismissed. Three weeks during the school year is unheard of. Three DAYS is pushing for non-renewing or re-placement.

The rapist comment is kind of ridiculous. I think the main point is that her request wasn't reasonable. Personally, I couldn't really care if they are muslim or whatever, and people can worship whoever they want, but asking for that much time, when it really didn't require it, is unreasonable.
I can't believe she's even out of the kitchen.

Again, pretty much what I was thinking. Thank you for asking her, and filling us in. What some may not realize, is most teachers have a program that they follow, the students are accustomed to that certain program and certain schedule, when you take nearly a month off, that is a LONG time, and if substitutes are anything like they were when I was a kid, you do more screwing around then learning. My mother is in the daycare/pre school field, and even she has a very strict program that she has put together (in accordance with the State of course), she was sick with pneumonia recently and had to take some time off, she has some very good subs she pays, and even then she said it throws everything off, that's why she rarely takes any time off.
Screw the kids tho, it's not about the kids, it's about this lady getting to perform her ritual.
I can't believe she's even out of the kitchen.

riddle me this: if that polling place had been in montgomery alabama, and the two men with clubs had been white, what do you think mr. holder's recommendation would have been? do you think he would have dropped the case?
do you think men brandishing weapons outside a polling place is a legitimate part of the democratic process?

Thanks Elhuero - that's my take on that whole deal as well.
I believe that voter intimidation/obstruction is a felony. The fact that 2 of the three individuals actively engaged in intimidation techniques had their charges dismissed is unacceptable. For the third person to get such a minor slap on the wrist is in-excusable. Not one of those 3 had any charges levied against them for the acts of voter intimidation/obstruction. Sadly, I expected nothing less from this current administration.
That whole election was fraudulent. There was plenty of evidence that ACORN had committed MULTIPLE acts of voter fraud all across the country, yet the worst that happened to them (only after LOTS of public outcry for action) was that the .gov removed their funding and disbanded them. So what did ACORD do? They went underground and are popping up in many of their previous locations under a different name.
