"Cops: Ohio man charged after barking at police dog"
I'm not going to bash the LEO's here. It sounds like the guy was totally drunk and arresting him probably did him a favor. It gave him a place to sleep it off rather than wandering around and getting into more trouble. I'd love to see him explaining this to the judge.

The dog is a member of the police force and a police officer. They even have a badge and everything. Messing with one is like messing with a human officer. You will lose, except have a few puncture wounds to prove it.

here is the problem with an LEO dog.
LEO isnt supposed to search without a warrant but,
LEO dogs search without warrant. then they use the evidence against the person. seems like a violation of the 4th ammmendment to me.
Dogs don't search w/o a warrant just because they can 'hit' on scents that are imperceptible to humans.. part of their nature.. just as seeing a bag of weed on a dash gives cop reasonable suspicion to search..smelling it gives the dog such.

a dog is not a cop.
then explain to me why my brother in laws dog has a badge and is listed as an officer on the PD website? Why my uncles dog in the Mass state Troopers has a badge and is listed as an officer? When I asked them they said the killing of a police dog or attacking a dog is considered assault on a police officer.
If you could explain it to me and where they are wrong I would greatly appreciate it..thanks.

Well this isn't entirely true, there are tons of warrant-less searches.
I have no idea about the K9 portion but I am sure a big part of the arrest or detention had to do with the intoxication...
A great clue to intoxication, other than the odor, would be comments like, "He started it."

im sorry, i didnt respond to the story. just my observation.
the courts have allowed a police dog to be a police officer and not a police officer, when it suits their needs.
a dog smells a controlled substance...not an officer.
obsruct a police dog... and its now an officer.
I do see your point, but if I smell a controlled substance it can often be considered "Plain view, plain smell" and not require a warrant...
But I am not a dog handler so I don't spend a lot of time researching the dog rules

Here in Colorado, the state supreme court came out several years ago and stated officers in Colorado cannot run a dog on a vehicle for no reason. Can't do it because you're bored, can't do it because the driver is a jerk. There has to be some articulable reason to do so, and they are very specific as to what those reasons are.
Now, if the vehicle has been towed as part of an arrest, then I'm not sure on that. I've heard two different statements from the K9 officers on that situation.

im not one of the antis on the site.
lets say a dog is trained to smell explosives. then he is at a roadside checkpoint and the officers run him by the car. if he alerts to a smell. they there is pc for a search. but, if a human officer cant smell the explosive, then it shouldnt be pc at least in my way of thinking. but the courts dont see it that way. officers are given tools by the legislature, i dont fault them for using them.
It wouldn't work that way here in Colorado, based on my previous post.
Maybe some other state...I don't know.

hey if your family wants to pin a badge on a dog and call him a fellow boy in blue, that's fine. but it doesn't make that dog a cop any more than dressing a dog up in a lion costume makes him king of the jungle.
the dog doesn't care. he does what he's trained to do, and does what he's told by his master.

k9 unit dogs are considered cops so that they can charge people with assaulting an officer in case they decide they'd rather kick it (or worse) than get bit.
can a police dog fight crime on its own? go out and make arrests, find criminals, conduct investigations, or write tickets?
no. without it's handler to control it a police dog is just a well trained dog.
does the dog have a pension? a salary? vacation time? medical and dental? if not the PD is violating labor laws by paying in kibble and belly rubs rather than money.
a police dog is a living, breathing tool for law enforcement.

the meaning of the badge comes from the people, not the animals.
just because someone paints an elephant pink, sprays it with glue, showers it with feathers and calls it flamingo doesn't make it so.
and it has been shown that police dogs can and are used to signal false positives to allow for (illegal) searches.

I wonder if they could make my dog an honorary police dog/officer. he listens pretty well, hunts great, and he is black and white just like cop cars.

and how does a dog back up an officer? by covering his blind side while clearing a house? giving him an extra set of eyes while in a chase? pointing the radar gun at the cars on the corner while partner pulls speeders over?
how about a domestic disturbance call? or a drunk driver.
fleeing suspect is hiding in the garage, may be armed. that's dangerous, he could be waiting to ambush. send the dog.
we think the subject may be transporting drugs, requesting K9 to sniff the vehicle.
all of the things that I can think of that police dogs do are specific actions that are carried out on command in situations where those specific skills are needed.
the dog is a tool of law enforcement.

heh, this is usually what I hear from LEOs online after I've crushed their arguments under a mountain of logic and diced their rebuttals with my shiny katana of truthful wit.
you know what, I do hate cops: the bad ones.
the police are given the authority of violence over the public (YOU AND I) to enforce the law, protect people, and serve the public. (YOU and I)
they are supposed to protect those that can't protect themselves, and when they abuse that power it is the ultimate insult to the public trust.
ever see that movie The General's Daughter? there's a line in it.. "what's worse than rape? BETRAYAL." and when police break the law, trample rights and generally do shit they're not supposed to do it is a betrayal of everything they're supposed to stand for.
most cops are good, yes. there are bad apples, yes. but a cop breaking the law is more damaging to our society than say, a safeway clerk or truck driver.

this is recent. the officer saves a man by pulling him from a burning car.
That is, I think, fucking awesome and I admire him. and I cry like a baby when I watch video of the first responders on 9/11. or when I think about the female trooper that got assassinated by a guy hiding in a trailer. or Patrolman Dabling.
but that doesn't mean that when I see a report of a cop breaking the law, or see a video of an officer ordering someone to shut off their camera that I'm not going to hope they get nut cancer.
tonight before I go to bed I'll say a prayer and ask God to watch and protect your uncle and bro in law in the days ahead while they carry out their duty. and their dogs.

How can a fleabag be considered an officer? They do not have to ability to complete the required steps to be an officer. Ask any of the brave individuals who serve as police officers what makes them an officer and they will say, "I took an oath". (sidenote: Thanks to all of the Oathkeepers out there) A dog can not speak, and therefore can not take an oath. Without understanding the oath and speaking it one can not become an officer. The dog remains a mutt that has been highly trained to fight and satisfy a bloodlust for everyone involved in its handling. It is not an officer.
Ok I have spent my 2 cent worth, and now have to get to work so Obama can feed more crack babies.

My previous post is a response to Boostedxt on why dogs can not be cops no matter what kind of brain washing you have been told to repeat by the academy. Just because your chief says the dog is a cop does not make it a cop no matter how much metal he pins on it.

Nah, my Marine friend. Post away. I'm happy to answer questions that I know the answer for. I just know the situations presented so far here on the forum regarding the dogs would not fly due to the state supreme court decision. Other states...I don't know. I've never been a cop in any other state.

They are living breathing contributing members of the department who have done training courses to improve their skills and go to work with their officer. The department has invested time and money into the dog just like it has their human officers. The department says they are officers, therefore they are officers, hurting one is a serious offense. That is all I am saying.....

Well, Cool for the department saying so. So If the department says so that is the final word on everything? I say I am a suave billionaire. Does that make me one? Or are the departments the only ones on God's green earth that get to define terms. I thought that the departments are to enforce the law not add to it or define it.
I did not ask if a law was broken. I asked if a crime was committed. They are two different things. Committing a crime is causing injury to another, monetarily, physically, etc. The breaking of a law is typically not following a rule that is designed to enrich the state through fines, seat-belt laws come to mind along with barking at a tool used by the department. If time was spent on stopping crimes that are committed police would be busy enough with out the headache of chasing down petty law breakers. Your jobs would be easier and probably more fulfilling too.
I wish I knew where Obama was keeping the extra cash for everyone. He has taken nearly all of mine and I need some of it back. If I find the secret stash I will cut you in on the deal. [Beer]

i would believe its not 100% coming from the department. Part of probably, but I am sure the department has it as such due to state law. Every state is different so I will ask my family members.
A large portion of criminals are caught while breaking a small law like speeding, not wearing seat belts, and things like that. I cant even tell you how many warrants I have seen come out of a "routine" traffic stop like rolling through a stop sign.
Thanks! If I find out where the stash is I will let ya know too! I sure could use a few billion!
