Strip Club Customer Wants His Money Back (http://www.courthousenews.com/2011/04/26/36086.htm)

An attorney sued a strip club, claiming it got him so drunk he became "temporarily unconscious," and it rang up $18,930 on his credit card...[he was served] alcoholic beverages to the extent that he was rendered intoxicated, partially or temporarily unconscious, and further to the extent that he had a complete loss of judgment, rational thought,..."

LOL...complete loss of judgment and rational thought, yeah...no shit! [LOL]

I suppose he needs a new law to protect him from himself? Never understood stuff like this. [Coffee]

Pretty much every time I've been to a strip club, there is a very drunk guy out front, surrounded by bouncers because he is out of cash and they are trying to get a credit card out of him for "services rendered."

Well, he makes a few good points.

First, they could lose their liquor license for continuing to serve a visibly intoxicated person alcohol.

Second, contracts entered into under the influence of intoxicants can be deemed void and non-binding.

Third, and most importantly, they charged him TWENTY THOUSAND DOLLARS. He wasn't gambling, he wasn't getting a reverse gangbang, he certainly wasn't buying a new car. That is fraud and possibly extortion. I could see someone racking up a couple grand in "lap dances" and overpriced champagne because they are stupid and stay there for 12 hours, but even if he was buying lap dances and drinks for everyone in the room no way does he owe twenty grand. There's a difference between a "clip joint" that demands a few hundred bucks and mobsters who try to take everything you own. They went too far in this case.

It's not so much that they don't have rational thoughts, they just choose to ignore them in the interest of mo' money.

What contract was involved?

I'm guessing since he used his credit card technically any services rendered in exchange for his money could be considered a contract. It's a long shot, but these are lawyers we're talking about.

I don't really see how that could work though...people could just go around buying stuff and then getting their money back the next day because they were "drunk" when they bought it...

Except they'd have to give the goods back. Can't give a lap dance back.

Because it wasn't the purchase of goods, it was the purchase of services. Different set of laws exist for services rendered. The agreement began when he agreed to buy his first drink before he was intoxicated. While the charge is exorbitant, it's his responsibility and I doubt the intoxicated/contract angle will play unless they get a SUPER conservative judge/jury and play up the good old boy just out for a innocent drink that was taken advantage of by the bad old strip club and it's Satan's helpers employees. I'm still not sure how one spends almost $20k in one night at a strip club. A buddy and I managed to spend $2k at a strip club in Vegas and we were there for like 8hrs (10:00pm-6:00am) and didn't even realize it. How this guy managed 10x that amount is beyond me.

I not siding with the guy, but I wouldn't doubt that the place screwed him over, I've seen it happen.

Because he did not receive twenty thousand dollars worth of services -- no way -- what happened was the girl behind the bar kept swiping his card until the plastic melted. That constitutes fraud and theft.

Same thing could and does happen at gas stations, fast food restaurants, and online merchants. Once someone has the magic numbers they can attempt to charge you repeatedly until it comes up "denied." Strip club employee probably expected it to come up "denied" after a few thousand, lost count, and kept swiping. Few people would complain about a few thousand out of embarrassment, but twenty thousand is a new car.
