Concerned with the amount of farm equipment making short hops between fields and down public roadways, U.S. Department of Transportation (DOT) is considering whether or not to classify agricultural machines like tractors as "commercial vehicles," requiring a CDL to operate.

How ever they do not cross state lines, well maybe some do, so I don't think the have the authority to regulate them at all.

But farmers have brought this on themselves.

If you don't realize it, farmers can operate heavy trucks without a CDL with some restrictions. (and no medical cards, pee tests, logs, etc) One of the big restrictions is that they do it for their own farm.

if they are getting paid to drive, then it's commercial work and they need a CDL.

Same thing with "custom farming" and other work. In colorado if you buy equipment for farm use, there is no sales tax. (this is 8% savings off a 100,000 dollar purchase), nor do you need SMM plates (and just like the rest of colorado plates they are Fing expensive). But that's only for YOUR land (or leased land which is legally your land)

If you get paid for it, on someone else's property, it's commercial and you are subject to the commercial rules.

Which of course, many (not all, but most) farmers completely and totally ignore. Now that's fine, it's a stupid law, BUT BY GOD the playing field should be level. I didn't vote for the stupid law and it's pretty Fing hard to compete with someone who's costs are 10% or more lower than mine because they don't pay their taxes/inspections/etc.

either repeal the laws for everyone, or make them apply to everyone. (and yes, this includes RV's, who also don't need a CDL/inspections/etc)

Depending on the current "type" of federalism we have, the commerce clause could be translated broadly or narrowly. It can be as broad as, if it affects another state with something as minor as the oil/gas for the tractor comes from another state than it's interstate commerce. Sometimes the definitions are way out of control...depending on what law makers want to make work for them.

Either way, this hopefully will not pass. Way too many farmers and farm equipment out there being used for legitimate purposes...this would be bad for the farming and rural communities. I think.

It will hopefully be shot down. Out in the country it has always been understood that a driver's license was for public roads not private property.
