Can an 18 year old legally purchase a hangun from a private party in Colorado?

Hey Guys,

Thanks for quick responses. I think you are right, however, after posting I called CBI and got an emphatic no. I'm going to err on the side of caution and not sell to him.

18-12-108.5. Possession of handguns by juveniles - prohibited - exceptions - penalty.

(1) (a) Except as provided in this section, it is unlawful for any person who has not attained the age of eighteen years knowingly to have any handgun in such person's possession.

From private party = legal.


I'm going to err on the side of caution and not sell to him.

Total bullshit on CBI's part but I'm not surprised. Bought a ton of handguns from PP before I was 18. I'd suggest selling to the guy. As for CBI they'd probably say no if he was 21 as well[ROFL1].

It is not ilegal I have heard cbi say that before. However in colorado it is not illegal for a privite party to sell. Ffl is a differnt story

Handguns private party yes.

Handguns FFL no.

This is for the ages 18-20 of course.

Do you know who it was at CBI? Remember a lot of times you are not speaking to an officer or agent when you call these organizations.

And I was thinking about this the other day and now that we are on the topic...

Are CO and FL the only states you can do that in?

The administrative assistant you talked to in Lakewood doesn't know what she is talking about. You most certainly CAN sell FTF 18-20.

I was commenting along the same line as Cochese in that the assistant that answers the phone might not know and shouldn't be giving legal advice either. I'm not a lawyer so don't listen to me either. Make up your own mind. If you want to wait and sell your pistol to someone over 21 that is alright with me and I'm sure the other guy understands too.

I appreciate all the input. I called the guy and he sounded rather flakey (bragging about he has been open carrying for a long time). I'm comfortable with the decision not to sell to him.

Legal or not, gut feeling trumps all.
I wouldn't care if he was 50 and had a CCW, if my gut tells me no, there IS a reason.........No sale.

Good luck selling it.

it is an absolute YES. you can sell private party to 18 and under. state law allows it. federal laws (governing FFLs) do not allow it. 90% of dealers will tell you that you are breaking the law, and they are worng. THEY, as an FFL can not under federal law sell a handgun to a person under 21, but a FTF transaction in colorado can legally sell at handgun to an 18 year old.

I have passed on selling handguns in the past to 18 year olds, just as I have passed on selling guns to people because I didn't like the gut feeling and my gut feeling is always right.

KNOW the laws, but follow your gut.
