View Full Version : Completing a Form 1
I'm working on my first SBR and have a question. I have a down payment on the components from Rainier Arms in WA.
I previously ordered an upper then lower from them. The upper was a 14.5 with a pinned (non-NFA) FS. I've been using this carbine at work as a personally owned patrol rifle.
I decided I want a short upper. Rainier sold me the lower and 14.5 upper. Rainier is assembling a 7.5 inch Daniel Defense/Noveske Diplomat creation for me as parts come in. Once it is assembled, they will ship it. I understand I cannot assemble the lower and upper until I get my Form 1 back.
My question is, who is making the SBR? Is Rainier the manufacturer, since they sold me the lower which I am using as the SBR host? Or am I the maker since I will be putting the upper and lower together by snapping two pins in place?
I ask because I want to get it submitted asap. I know I may need it engraved with something as well.
I'm just looking for Cliff's notes on it. Not a link to the ATF handbook.

As I understand it, you will be the MFG. Because there where there was no SBR before, there will be now, by putting the shorty upper and rifle lower together like you said. So you'll have to get the lower engraved with the maker's name city and state. I just got my first SBR form one back about two weeks ago. Don't forget to send along a Certification of Compliance with 18 U.S.C. (g)(5)(B) with the Form 1 or they will not approve your form until they recieve that one. I didn't send one with mine, and I got a letter inthe mail with the blank form saying I needed to complete it, and either snail mail or e-mail it to them. I e-mailed it that same day and my form was placed in the mail for me on the next day. It is a stupid form, it is basicly you certifing that you are in fact a US citizen. Its stuipd, they could just call and say "Yo, you a US citizen?" and you say "yeah" then they would say "who will attest to this?" and then you go "me" they they go, "okay, cool". Its the dumbest form on the face of the planet, literally.
Line 1: Name under which the application was filed (your name)
Line 2: Name of person certifying to citizenship (your name)
Line 3: What is your country of citizenship? (usa)
Line 7: signature of individual who is identified in question 2
....thats the whole form, lmao, no notary, no copy of an ID sent along with it, just that. lmao, gotta love uncle sam.

Cool. That's why I asked. Never heard of that cerificate. In fact, I didn't send one in when I I sent my Form 4 in for the Serbu Super Shorty I bought.
I assume they need one for a form 4 too?

I have no idea, this was my first time with the form 1 thing. I had never heard of it either before I sent it in, it only delayed my application by about a day or two, so no biggie. It seemed like they get that alot, as they had pre-made letters about it where they just add your name and info to it to let you know you need one. The one big thing I want to know is, if I have my SBR with me, do I have to have my Form 1 with me too? Will a copy suffice? I want to keep the original in a safe place, so I'd rather keep a copy with me.
First off you are the Maker not manufacturer. Individuals a makers, businesses that make them for sale are manufacturers.
Your name goes on 3a Applicants name and address.
Ranier's name goes in box 4a Name and location of original Manufacturer.
You can use the original serial number in box 4g. Same for caliber in 4c. OAL and barrel length have to be filled in also. Do not put anything in 4h.
You will need to engrave your (applicants) name and city and state on it. You can't cover it up but you can put it someplace not obvious.
You cannot have a short barrel upper in your possession with a lower it will fit, assembled or not, without an approved form in your hands.
You need to have the a copy of the form with the gun. Some people shrink it down to wallet size but I would not make it smaller than is easily readable. Actually you don't have to have a copy with you but it is the only proof that what you have is legal.
You need a Certificate of Complience with both a Form 1 and Form 4.
I'll mention Form 5230-20 Application to Transport Interstate ... NFA firearms. If you take and NFA firearm out of state temporarily you need to fill out this form.

Call the NFA branch, ask who your examiner is and then forward the completed form to them. Once your form is at the top of the pile it will remain there until you send in the required documents. You don't get sent to the bottom of the pile.

You are not legally required to keep the form (original or copy) with you, but you'd be wise to do so.
A Form 1/4 is a tax document. You are only legally required to show it to the Secretary of the Treasury, or someone who works for them (e.g. ATF agent). However, keeping a copy with you is cheap insurance against less-than-well-informed LEOs who ask you "is that thing registered?"
Having some paperwork to flash at them usually will satisfy them, rather than riding in the back of the cop car and bonding out.
